That Section 1 of Ordinance No. 2ng as �mTn need, entitled "An Ordinance of the City of T-11_Tntin`n- ton Beach, California., uotablishin a bus'ness and residence -2- • district in said City, and prohibiting the establishment ' or maintenance of certain businesses and industries in said districts" be and the same is hereby amended so as to read as follows: SECTION 1. That all of the City of Huntington Beach within the following described boundaries is here- by established and declared to be a residence district, to-wit: Beginning at the point of intersection of the center line of Twelfth Street extended bouthwesterly with the Pacific Ucean running thence northeasterly upon and along the center line of Twelfth Street and a prolonga- tion thereof upon -md along the common boundary line between Blocks 411 and 412 and between Blocks 511 and 512, thence continuing upon and along the center line of Twelfth Street to an intersection with the center line of Palm Avenue; running thence Southeasterly and Easterly along the center line of Palm Avenue to its int rsectio Lake Avenue; thence So-.ztherly �lonr the center 11.e, of ie ceits with the Center line of/intersection with the center line of First Street, thence bouthwesterly along the center , i line of First Street and a prolongation thereof southwest- erly, to the Pacific ocean; thence along the Coast line of said Pacific Ocean Northwesterly to the point of begin- ing. " SECTION 2. The adoption of this Ordinance shall not, nor are its or any of its provisions intended to linit or prohibit the Board of Trustees of the City of Huntington Beach from adopting such Ordinances amendatory hereof, in the exercises of Police Power for the preservation of public peace, health, safety and welfare, or in emergencies, or for public convenience, as the Board of Trustees may. deem neces- sary. SECTION 3. The City Clerk shall certify to the Adoption of this Ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper printed, published and circulated in the City of Huntington Bea.eh, and this Ordinance shall take effect ten (10) days after canvass of the election at which this Ordinance is submitted, if the the same is adopted by the requistite number of votes of the electors voting at said election. -5- • Passed and adopted by the people of the City of Huntington Beach at a special Election :Held on the 16th day of November, 1926. President of the Board of Trustees of the City of Huntington Beach. and RESOLVED, further, that Proposition No: Two shall be a proposition for the adoption of an ordinance for the City of Huntington Beach, which said Ordinance shall be in words and figures as follows; to-wit: ORDINANCE No. AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING ORDINANCE NO. 209 OF SAID CITY ENTITLED "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, ESTABL LISHING A BUSINESS AND RESIDENCE DISTRICT IN SAID CITY AND PROHBITING THE ESTAB- LISHMENT OR MAINTEWICE OF CERTAIN BUSI- NESSES AND INDUSTRIES IN SAID DISTRICTS" The People of the City of Huntington Beach do ordain.. as follows: Section 1. That Section 1 of Ordinance No.209, as amended, entitled "An Ordinance of the City of Hunt- ington Beach, California, establishing a Business and Residence District in said City, and prohibiting the es- tablishment or maintenance of certain businesses and in- dustries in said districts" be and is hereby amended so as to read as follows: "Section 1. All property in and part of the City of Huntington Beach situate within 250 feet of any public school building is hereby established and declared to be the residence district of said City. All that portion of the City of Huntington Beach within the following; described boundaries is here by es- tablished and declared to be Business District No. 1 of said City, to-wit: Beginning at the point of intersection of the center line of rirst Street, projected with the Pacific Ocean and running thence Northeasterly to the intersection of the said center line of First Street with the South- westerly line projected of the first alley Northeasterly from Ocean Avenue; thence Vorthwesterly along said last mentioned line to its intersection with the Northwesterly line produced of the first alley Southeasterly from Third Street; thence Northeasterly along the last mentioned line to its intersection with the Northwesterly line produced of the first alley Southeasterly from Third Street; thence Northeasterly along the last mentioned line to its intersee- tion with the Southwesterly line of Olive Avenue; thence Northwesterly along the southwesterly line of Olive Avenue to its intersection with the Southeasterly line of the first alley Northwesterly from Third Street; thence Northeasterly and Northerly along the last mentioned alley line to its in- tersection with the South line of Acacia Avenue; thence -7- iv esterly and Northwesterly along said last mentioned line to its Intersection with the Southwesterly line of Sixth Street; thence Southwesterly along said last mentioned line to its intersection with the Northeasterly line of Orange Avenue; thence Southeasterly along said last mentioned line to its intersection with the South- easterly line of the first alley Northwesterly from Fifth Street produced Northeasterly; thence Southwesterly along--the last men- tioned alley line produced to its Intersection with the South- westerly line of the first alley Northeasterly from Ocean Avenue; thence Northwesterly along the last mentioned line produced to its intersection with the center line of Sixth Street; thence South- westerly along the center line of Sixth Street and a prolongation thereof to the Pacific Ocean; thence Southeasterly along the mean high tide line of the Pacific Ocean to the point of beginning. " SECTION 2. The adoption of this Ordinance shall not, nor are its or any of its provisions intended to limit or prohi- bit the Board of Trustees of the City of Huntington Beach from adopting such ordinances amendatory hereto, in the exercise of Po- lice Power for the preservation of Public peace, health, safety and welfare, or in emergencies, or for public convenience, as the Board of Trustees may deem necessary* SECTION 3. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same. to be published by one insertion in the Huntington Beach News, a weekly newspaper printed, published and circulated in the said City of Huntington Beach, and this Ordinance shall take effect ten (10) days after canvass of the election at which this ordinance is submitted, if the same is adopted by the requisite number of votes of the electors voting at said election. Passed and adopted by the people of the City of Huntington Beach at a special Election held on the 16th day of November, 1926. President of the Board of Trustees of the City of Huntington Beach, Calif. and RESOLVED, further, that the said propositions for the adoption of said Ordinance shall be placed on the ballot in the following words and figures: PROPOSITION No. 1 Shall the Ordinance providing for the exclusion from the residence district of the City of Huntington Beach of the property bounded by the Pacific Ocean on the Southwestf Palm Avenue on the Northeast, Seventeeth Street on the Northwest and Twelfth Street on the Southeast, except property situate within 250 feet of any public school building; and for the extension of the limits or boundaries of business district No. 1 of the City of Huntington Beach, to include all of Fire District No. 1 be adopted. No. 2 Shall the Oridance providing for the exclusion from _9_ f the residence district in the City of Huntington Beach of all the property now within said district, except property situate within 250 feet of any public school building; and for the extension of Business District No. l of said City so as to include all property within Fire District No. 1, and all that portion of the City of Huntington,._Beach lying South- westerly from the Northeasterly line of Ocean Avenue, between the center line of First Street produced into the Pacific Ocean and center line of Sixth Street produced into the Pacific Ocean, be adopted. Opposite such propositions to be voted on amU to the right thereof the words "Yes" and "No" shall be printed on separate lines with voting squares. If an elector shall stamp a cross (X) in the voting square after the printed word "Yes'nis vote shall be counted in favor of the adoption of the Ordinance voted upon; and if he shall stamp a cross (X) in the voting square after the word "NO" his vote shall be counted against the adoption of the same. RESOLVED, further, that there shall be four (4) voting precincts for the purpose of holding said election, consisting of a consolidation of the regular election precincts established for holding State and County elections, as follows: Consolidated voting precinct " A" comprising State and County precincts numbers one, two and three, and the polling place thereof shall be the Municipal Auditorium, near the Weat- erly corner of the intersection of Main Street and Fifth: Street in -lO- is said City; Consolidated voting precinct "B" comprising State and County -k'leetion precincts Number four, five and six, and the polling place thereof shall be at the Methodist Uhurch Bungalow Sunday School room on the Northerly corner of the intersection of Eleven- th Street and Orange Avenue in Said City; Consolidated voting precinct "C" comprising State and County Election precincts number seven and eight and tLL-.e polling place shall be therefor at the Grammar School building located near the intersection of Fif- teenth Street and Palm Avenue, on the northeasterly side of Palm Avenue in said City; Consolidated voting precinct "D" comprising State and County pricincts numbers nine and ten, and the polling place there for shall be at M. M. Hallicy's store, located on the Southeasterlr corner of Frankfort Street and Alabama Avenue in said City. The polls shall be open between the hours of 7:00 o'clock A.M. and 6:00 o 'clock P.M. That the Board of Trustees shall appoint an„Election Board for each consolidated precinct, to be composed of one .Ir- speetor, one Judge and three clerks for each such consolidated pre- cinct, each of whom shall be a qualified elector and resident of consolidated precinct in which he or she acts as a member of said Election Board, and RESOLVED, further, that the City Clerk shall procure the necessary voting booths and see that they are properly erected, and shall have all the necessary ballots printed according to the requirements of law and secure the necessary ballot-boxes, stamps, -11- s ink-pads, voting lists, roster, instruction cards, affidavits of registration and index thereto, tally lists, returns, envelopes, and all other necessary supplies, and see that they are properly distributed to each voting booth prior to the opening of the polls on the day of election. The City Clerk shall also give notice of said election, as required by law, aid shall cause notice thereof to be published in Huntington Beach news, a weekly newspaper printed, published and circulated in said City, by three (3) in- sertions thereof, and shall cause the proposed Ordinance and pro-- positions to be printed and a copy thereof enclosed in an envelope with a sample ballot and mail the. same to each voter not later than ten days (10) prior to the election, And RESOLVED, further, that the Ordinance adopted, if any, receiving the highest number of affermative votes shall control. Passed and adopted by the Board of Trustees of the City of Huntington Beach at their regular adjourned meeting held on the 6th day of October, 1926. CHAS. G.
