RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON
BEACH DECLARING THE RESULT OF THE SPECIAL MUNICIPAL ELECTION
HELD IN SAID CITY ON THE 8th DAY OF FRBRUARY, 1927, DIRECTING
NOTICE FOR BIDS AND PRESCRIBING FANNER FOR CONVEYANCE OF A
MUNICIPALLY OWNED PUBLIC UTILITY,TO-WIT: THE GAS DISTRIBUTING
SYSTEM, WORKS, EQUIPMENT AND APPURTENANCES OWNED BY THE CITY
OF HUNTINGTON BEACH.
The Board of Trustees of the City of Huntington Beach do resolve
as follows:
WHEREAS, at a Special Municipal Election held in the City of
Huntington Beach, Orange County, California, on Tuesday the 8th day of
February, 1927, pursuant to Ordinance No. 296 of said City; the whole
number of voters voting at said Special Municipal Election was 497, the
whole number of legal votes cast was 497, and that thereof 425 legal votes
were cast in favor of the adoption of the following proposition, to-wit:
"Shall a Public Utility owned by the City of Huntington
Beach, to-wit, the Gas Distributing system, works, equip-
ment and appurtenances, located in the said City of Hunt-
ington Beach, County of Orange, State of California, be
sold, and the Board of Trustees be authorized to sell the
same as provided by lawn
AND VMEREAS, due notice of Special Municipal Election was given, and
said Special Municipal Election was held at the time and in the manner
/'e yvired
in all respects as 4=0 A- by said Ordinance No. 296, of said City,
and that in all particulars not recited in said Ordinance, said Special
Municipal Election was held as provided by law for holding Municipal
Elections in cities of the fifth and sixth class, and the general Election
laws of the State of California.
AND �iMEREAS, said election was legally and fairly conducted and the
returns thereof were duly and regularly made a.nd certified. to by this
Board; that said returns have been duly and legally canvassed. by this
Board:

AND MEEREAS, said proposition was submitted to the qualified
voters of said City of Huntington Beach at said Special Municipal
Election, was carried by more than two-thirds of all the voters
voting at said Special Municipal Election, to-wit; there were 425
legal votes cast in favor of said proposition out of a total of 497
voters voting at said Special Municipal Election.
BE IT AND IT IS HEREBY RESOIVED,AS FOLLOWS:
That said Special 1unicipal Election was ,held and conducted in
the City o Huntington Beach,. State of California, on Tuesday the 8th
day of February, _192'7, in time, form and manner as.required by law:
That there were four (4) voting precincts established: for the
purpose of holding said election, consisting of a consolidation of
the regular election precincts established for holding general State
and County elections as follows:
Consolidated Voting Precinct "A", comprising State and County
precincts numbers 1, 2 and 3:

precincts numbers 4, 5 and 6:
Consolidated Voting Precincts "C" , comprising State and County

That the whole number of votes cast in said City was Four Hun-
dred ninety-seven (4971 :
That the proposition voted upon, the number of votes given in
each precinct for and against said proposition, together with the
whole number of votes which they received in the entire City are as
follows

RESOLVED, FURTHER, by the Board of Trustees of the City of
Huntington Beach, that said proposition was, and_ this_ Board hereby
finds and declares that said proposition was carried ancl adopted by
the voters of more than two-thirds of all the voters voting at said
Special Municipal Election, and that said proposition be and the same
is hereby. declared to be carried., and
RESOLVED, FURTHER, that Monday, March the 7th, 1927, at the hour
of 7:30 otclock P.M. on said day, be, and is hereby fixed as the date
on which bids for the sale of the public utility, to-wit, the Gas Dis-
tributing system, i,,rrks, equipment and appurtenances owned by the City
of Huntington Beach, will be received. by said Board of Trustees , and
that any and all such bids will be received, opened and considered by
the said Board of Trustees at said time at the Council Chambers of said
Board in the City Hall in said City, at a regular. meeting, of said Board
to be held on the 7th day of March, 1927; that all bids be filed with
the City Clerk of said City of Huntington Beach not. later than 5 O'clock
P.M. on said 7th day of March, 1927; that all bids be -accompanied by a
certified check certified by some reputable bank or .banker_, or a money
deposit be made at the time of filing said bid,_ in a sum equal to ten
(10%) per cent of the total amount of said bid,; and.
RESOLVED, that the City Clerk give notice of .time, place and manner
of receiving bids for the sale of said public utility by publishing such
notice for two weeks in HUNTINGTON BEACH MYS, a weekly newspaper, printed,
published and circulated in said City of Huntington Beach, and hereby de-
signated for such purposes by the Board of Trustees., the first publication
of said notice to be made at least two weeks prior to the time fixed here-
in for receiving such bids. Said notice _.shall contain a statement to the

effect that the public utility will be sold to the highest bidder for
cash; the manner and time for filing bids, and the time when the same
will be received by the Board of Trustees; th
each and every bid shall be accompanied by a certified
check certified by some reputable bank or banker, or a ..cash deposit in
a sum equal to ten (10%) per cent of the total amount_.of such, bid; that
if the bids received, in the opinion of the Board of Trustees of the
City of Huntington Beach,are inadequate or disproportionate to the value
of such said public utility such legislative branch shall have the right
to reject all bids and may proceed to give new _notice of_. sale, and,
RESOLVED, that the President of the Board of Trustees of the City
of Huntington Beach, and the City Clerk of.said .City, be, anti they are
hereby authorized to execute, acknowledge and deliver for and on behalf
of the City of Huntington Beach, in its name and under its corporate
seal, a good and sufficient deed conveying said public utility unto the
successful bidder, upon receiving from such successful bidder, in cash,
the full amount of bid, and the promise of such bidder to continue to
operate such public utility, and such conveyance shall operate to convey
to the successful bidder all of the right , title and interest of the City
of Huntington Beach in and to said public utility, to-wit: the gas dis-
tributing system, works, equipment and appurtenances owned by the City of
Huntington Beach.
