HomeMy WebLinkAboutCity Council - 584 -RESOLUTION No. 584 RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH RFGULATING AND FIXING THE FEES FOR THE USE OF THE MUNICIPAL AUDITORIUM IN SAID CITY. The Board of Trustees of the City of Huntington Beach do resolve as follows : Section 1. RESOLVED, that the Municipal Auditorium in the City of Huntington Beach is a public building erected by and at the cost of the people of said City, and shall be at all times, subject to the necessary regulations hereinafter specified, open to the conv6ni.ent use of the same by the people of the Qity of Huntington Beach. And Section 2. RESOLVED, That the board of Trustees of said City shall have and retain the control of said Municipal Auditorium, and shall from time to time prescribe its uses and rules and regulations governing the same. And Section 3. RESOLVED, that the City Clerk of the City of Huntington Beach shall be the custodian of the keys to and personal property of said Municipal Auditorium, and shall re- ceive all applications and fees, and issue all permits for the use of same, and may, in. his discretion and in the interests of the people of the Qity of Huntington Beach, subject to the final decision of the .Board of Trustees, reject any application for the use of said building. And Section 4. RESOLVED, that said Municipal Auditorium may be used by the people of the City of Huntington Beach for any purpose for which persons may lawfully assemble together provided, that in no case shall said building be used for the regular meeting place of any person or association, except by special permission of the Board of Trustees of the Uity of Huntington Leach. And . Section 5, RESOLVED, that any person desiring to use said Municipal Atiditortun shall first apply to the Uity Clerk therefor, upon application form to be furnished by the City Clerk. The applicant shall be required to state the day or days, time and purpose for which such use is desired, the name, address and character of the person applying, and shall in writing upon the applicatiop agree to assume all responsi- bility and liability for damage or loss to the building or equipment thereof, and if the applicant is a corporation or ssociation of persons, the City Clerk may require evidence of the authority from the person signing the application to bind the corporation or association. And Section, 6. RESOLVED, that no charge shall be made for the use of the Municipal uditorium for any religious, fraternal, civic, political, social, patriotic or educational association or society of the Uity of nuntington Beach, whether such use result in profit to such association or society or not, it being the intent of this enactment to secure the people of the City of Huntington J�eaeh in their free and unobstructed use of the Municipal Auditorium for all lawful purposes and for their benefit. RESOLVED, that the use of said gunicipal Auditorium be, and the same in here by extended to religious, fraternal, civic, political, social, educational and patriotic associations and societies, other that those of the City of Huntington Beach, likewise free of charge, when the same shall not be otherwise in use; provided, that such associations and societies of the City of Huntington Beach, or whose membership shall be composed principipally of citizens of the said City, and shall ,at all-' times have preference over associations and societies not of said City, And Section 8. RESOLVED, that any person other than t:nose enumerated in Sections 6 and 7 hereof, to whom permission shall be hereafter granted by the City Clerk or the Board of Trustees to use said Auditorium for profit or gain, shall pay to the City clerk," at the time of making application, the following fees : For each day or fractional day not exceeding two successive days or fractional days the sum of $25.00 per day; for each successive day or fractional day thereafter the .sum of $40.00 And: Section 9. . RESOLVED, that the word "person" when used in this Resolution shall include firm, co-partnership, association, society or guild, incorporated or unincorporated. And: Section 10. RESOLVED, that any person Alssatisfied with the decision 'dif the Uity Clerk in rejecting any application, or modifying any 'application made to him hereunder may appeal to the Board of Trustees from such decision, and the decision of the -3- Board of Trustees shall be final and conclusive: and SECTION 111. RESOLVED, that the City Clerk shall at all times keep the Municipal Auditorium securely locked when not in use, and shall from time to time inspect the premises and the personal property thereof, and shall require the city jani- tor to report to him promptly any and all damages and loss occasioned by the use of said building and personal property, and shall promptly notify the person responsible for such damage or loss to make proper settlement therefor with the City Clerk. And Section 12. RESOLVED, that the City Clerk be, and he is hereby instructed to send by mail to the associations and socie- ties in this Resolution specified and located in the City . of Huntington Beach, .copies of this Resolution. SECTION 13. Every person using the kitchen and equip- ment of said Auditorium shall pay to the City Clerk at the time of making application the sum of 5.00. This charge is intended to cover the actual cost of restoring the kitchen and equipment to a condition of order and cleanliness. The Board of trustees may, however, in their discretuin remit such charge. SECTION 14. Resolution No 400 is hereby repealed.
