HomeMy WebLinkAboutCity Council - 676 t_ RESOLUTION NO. 676 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH The City Council of the City of Huntington Beach do resolve as follows; WHEREAS, the City of Huntington Beach is the owner in fee simple of the lands hereinafter described and of the oil and gas deposits, if any, in and under said lands; and WHEREAS, it has been fairly shown by the drilling upon and producing from other nearby lands that said City hands do contain valuable deposits of petroleum oil and gas which can only be obtained and protected by drilling for and producing the same, and which are now being depleted and drained away by wells on nearby lands, to the great and permanent loss of said City and its taxpayers; and WHEREAS, the actual use of the surface of said lands is not now and will not in the near future be required by the public or for any public purpose, insofar as said use could be temporarily pre. vented or interfered with by the drilling of oil wells, and no permanent obstruction to the full use of said lands for all public street purposes is necessary or contemplated in the development of said lands for oil and gas; and WHEREAS, subject to and upon the protective provisions re- quired fully to secure all rights of the public in the premises, it is desired by the City Council of said City to provide for the drilling of said lands and the production therefrom of the oil and gas deposits therein contained, and to that end to lease to and contract with Carr Oil Corporation for the exclusive right to drill for, develop and produce petroleum oil, gas and other hydrocarbon substances upon and from said lands; and • 9 WHEREAS, said Carr Oil Corporation desires to enter into said lease; THEREFORE, BE IT RESOLVED by the City Council of said City of Huntington Beach that said City Council of said City of Huntington Beach hereby authorizes and directs the making and entering into by and on behalf of said City of an oil and gas lease to and with Carr Oil Corporation, a corporation organized and existing under the laws of California, and the execution, signature and acknowledgment of said lease by and on behalf of said City of Huntington Beach by the Mayor of said City and the attestation of the same by the City Clerk -- which said lease shall bear date August 12th, 1932, and shall cover, describe and demise, for the development and production of petroleum oil, gas and other hydrocarbon substances, the following described lands situate in the said City of Huntington Beach, Orange County, California, to-wit;: Commencing at a point on Ocean Avenue in said City of Huntington Beach, County of Orange, State of California, where the Westerly line of 23rd Street intersects the Pacific Electric right-of-way; thence Northwesterly along the line of said Pacific Electric right-of-way to the North westerly boundary line of the City of Huntington Beach; thence Northeasterly along said Northwest•. erly boundary line of said city Thirty ( ,30) feet to a point on Ocean Avenue; thence South- easterly on Ocean Avenue along a line parallel to and thirty (30) feet equidistant from said Pacific Electric right-of-way to the westerly line of 23rd Street; thence Southerly along said Westerly line of 23rd Street to the point of beginning; but it is contemplated and intended that said lease shall not secure to said lessee any permanent use whatever of the surface of said lands, saving only such means of access to underground installations as shall not in any wise permanently interfere with the public use of the surf#t3e-s of said lands for street purposes -2- • J or with the necessary uses of said street for watermains, sewers or other street purposes, but all such uses shall so far as practicable be so planned and located as not to be on said thirty (30) foot strip of land; and that a copy of said #ir:Apida lease, as submitted to said City Council, is hereby attached, marked Echibit #AN and by this reference made a part hereof, and is hereby approved by said City Council; and IN WITNESS WHEREOF, the City of Huntington Beach has caused its corporate name and seal to be hereunto affixed by its Mayor and attested by the City Clerk under authority vested in them by the said Council at a regular adjourned meeting held on the 12th day of August, 1932. —ayor o Beach A City Clerk STATE OF CALIFORNIA COUNTY OF ORANGE SS CITY OF HUNTINGTON BEACH I.
