A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH SUBMITTING AN ALTERNATIVE PRO- POSITION PROVIDING FOR THE ELECTION OF COUNCIL- MEN BY DISTRICTS. The City Council of the City of Huntington Beach do resolve as follows# SECTION I. That at the special election heretofore called to be held in the City of Huntington Beach, on the 29th of April, 1937, there shall be submitted to the electors the proposition of the adoption of a proposed alternative to Section I of Article IV of the Proposed Charter for the City of Huntington Beach, California consisting of Section I, Section I a, Section I b, Article IV, providing for the election of councilmen by districts. Said proposed alternative is hereto attached and f made a part hereof and _designated as Exhibit "A". SECTION II. That the foregoing'proposed alternative shall be submitted to the electors at said election for adoption under the following prop4ition# PROPOSITION NO. II. SHALL THE PROPOSED ALTERNATIVE YES PROVIDING FOR ELECTION OF FIVE COUNCILIAEN BY DISTRICTS BE LNO ADOPTED? (EXHIBIT A) PROPOSED ALTERNATIVE TO PROPOSED CHARTER. ARTICLE IV. ELECTIONS SECTION I; Districts established. For the purpose of electing members of the City Council, the City shall be divided into Five (5) districts as nearly equal in registered voter population as practicable. The members of the City Council shall be elected by districts, one from each of said five districts as follows; District 1. One councilman from District No. 1, which is in the first instance hereby established as all that portion of the City of Huntington Beach,. California, lying and being within the following described boundary lines: Beginning at a point, being the intersection of the center line of Palm Avenue with the center line of the Pacific Electric right-of-way (which right-of-way lies parallel to and between Lake Avenue and Alabama Avenue) ; thence Southerly along the center line of said right-of-way to the intersection with the center line of Atlanta Street; thence Easterly along the center line of Atlanta Street to a point, being the intersection with the Easterly city boundary; thence Southerly and Southwesterly and Northwesterly along the Easterly, Southerly and Westerly boundary of said city to a point, being the intersection of the center line of Sixth Street as produced Southwesterly; thence Northeasterly along the center line of said Sixth Street as produced and the center line of Sixth Street to the intersection of Walnut Avenue• thence Southeasterly along the � Y � center line of Walnut Avenue to the intersection of the center line of Fifth Street; thence Northeasterly along the center line of said Fifth Street, to the intersection with the center line of Main Street; thence Northerly along the center line of Fain. Street to the intersection of the center line of Palm Avenue; thence Easterly along the center line of Palm Avenue to the point of beginning. DISTRICT 2. One Councilman from District No. 2, which in the first instance is hereby established as all that portion of the City of Huntington Beach, California, lying and being within the following _l_ described boundary lines: Beginning at the intersection of the center line of Palm Avenue with the center line of Main Street, and running thence Southerly along said center line of Main Street to the intersection of the center line of Fifth Street; thence Southwesterly along the center line of Fifth Street to the intersection of the center line of Walnut Avenue; thence North- easterly along the center line of Walnut Avenue to the center line of Sixth Street; thence southwesterly along the center line of Sixth Street and the prolongation thereof to the Southwesterly boundary line of the City of Huntington Beach; thence Northwesterly along said boundary line to the intersection of the prolongation Southwesterly of the center line of Ninth Street; thence Northeasterly along said prolongation and the center line of Ninth street to the intersection of the center line of Palm Avenue; thence Southeasterly along the center line of Palm Avenue to the point of beginning. District 3. One councilman from District No. 3, which is in the first instance hereby established as all that portion of the City of Huntington Beach, California, lying and being within the following described boundary lines; Beginning at the intersection of the center line of Palm Avenue and the center line of Ninth Street thence Southwesterly along the center line of said Ninth Street and the center line of the prolongation of said Ninth Street to the intersection with the Southwesterly city boundary line ; thence Northwesterly along the Southwesterly city boundary to the intersection of said boundary with the center line of the prolongation of Sixteenth Street; thence Northeasterly along the center line of said prolongation of Sixteenth Street and the center line of Sixteenth Street to the intersection of the center line of Palm Avenge; thence South- easterly along the center line of Palm Aver** to the point of beginning. DISTRICT 4. One councilman from District No. 4, which in the instance is hereby established as all that portion of the City of Huntington Beach, California, lying and being within the following described boundary lines: -2- Beginning at the intersection of the center line of Palm Avenue with the center line of the Pacific Electric right-of-way; thence Westerly and Northwesterly along the center line of Palm Avenue to the inter- section of the center line of Sixteenth Street; thence Southwesterly along the center line of Sixteenth Street and the center line of the prolongation thereof to the intersection of the Southwesterly boundary of said City of Huntington Beach; thence Northwesterly along South- westerly boundary, and Northeasterly along the Northwesterly boundary, and Easterl along the Northerly boundary, and Southerly, Easterly and Southerly Yong said boundary as it meanders in a Southerly direction to the intersection of said Easterly boundary with the center. line of the prolongationEasterly of Memphis Street; thence Westerly along the center line of said prolongation of Memphis Street, and the center line of Memphis Street to the intersection with the center line of the Pacific Electric Right-of-way; thence Southerly along the center line of said Right-of-way to the point of beginning. DISTRICT One Councilman from District No. 5, which for the first instance is hereby established as all that portion of the City of Huntington Beach, California, lying and being within the following described boundary line: Beginning at the intersection of the center line of the Pacific Electric right-of-way with the center line of Memphis Street; Thence Southerly along the center line of said right-of-way to the intersection of the center line of Atlanta Avenue; thence Easterly along the center line of Atlanta Avenue to the intersection of the Easterly boundary line of the City of Huntington Beach; thence Northerly along the Easterly boundary, as said boundary meanders Northerly, Northeasterly and North- westerly to the intersection of the center line of the prolongation of Memphis Street; thence Westerly along the center line of the prolongation p of Memphis Street and the center line of Memphis Street to the point of beginning. Provided, however, that that portion of District No. 41 as herein described, bounded as follows: Beginning at the intersection of the center line of Indianapolis Street and the center line of the Pacific Electric right-of-way; thence -3- r Westerly along the center line 6f Indianapolis Street to the intersection with the center line of Crest Avenue; thence Northwesterly along the center line of Crest Avenue to the intersection with the center line of Vain Street; thence Northerly along the center line of Main Street to the intersection with the center line of Tenth Street; thence Easterly along the center line of Tenth Street and the prolongation thereof to the center line of the Pacific Electric right-of-way; Thence Southerly along the center line of the Pacific Electric right-of-way to the point of beginning--shall be considered to ve a portion of District No. 5 and shall be added thereto for the purpose of a special or general election held prior ta -the' second Tuesday in April 1940, affecting any councilman within said District No. 5 as enlarged as herein provided and said portion shall be excluded from District No. 4 until the election to be held on the second Tuesday in April, 1940. SECTION I a; REDISTRICTING. The City shall be redistricted by ordinance for the purpose of .maintaining approximate equality of regist- ered voting population, at least once in every Ten (10) years, but shall not be redistricted with Your (4) years after any such redistricting. Any territory hereafter annexed to or consolidated with the City of Huntington Beach, shall at the time of such annexation or consolidation be added to an adjacent district or districts by an ordinance of the Council, provided that if any territory annexed or consolidated at any one time shall contain qualified voters sufficient to upset the approximate equality of the established districts the Council shall at least Sixty (60) days before an election after such annexation or consolidation, redistrict the City regardless of the time limitation. of Four (4) years heretofore mentioned. In any redistricting, the districts shall be comprised of continuous territory and made as equal in registered voters, as shown b the registration records and s Y S , geographically compact as possible, and the district so formed shall., as far as possible, be bounded by natural boundaries, by street lines and/or by City boundary lines. -4. SECTION I bt Every councilman must have been, at the time of his election or appointment In the event of a vacancy, an actual resident in the district from which he was nominated for One (1) year immediately preceding his election or appointm%at4 Any councilman who moves from the district of which he was a resident at the time of his election or appointment, forfeits his office, but no council- man shall forfeit his office as a result of redistricting. j
