The City Council of the City of ImtlMttoyr Beach,
California, do resolve as f ollowei
Section It That the pavilion located on the beach
easterly frum. the municipal pier of the City, of Huntington
Beach shell be placed under the charge and control of the
City Engineer, and it shall be the duty of the City Lneineer
to exercit�ir general sup rvision of said pavilion; provided,
however, tl he amoeesion located in said pavilion shall
be deemed excepted herefrom.
Section 2: That the City Engineer is hereby author•
lzed to appoint and employ, with the advice and consent of the
City Council, a pavilion manger iho, dx,923► be deemed an employe .
of the City of MWntIngton Beach and shall hold his employment
at the pleasure of the City S41aeerr
Section 3t That the pavilion manager shall, subject
to the + trul of the City sneer, supervise 'sind manage
the pavilion and advertising oonneeted therewith, eolleet all
monies derived from the operation of said pavilion and deposit
the same with the City 'treasurer daily, taking receipt- therefor;
he shall have charge of and be responsible, to the City Engineer,
for the acts of any subordinate employe or employee workirik;* under
his direction, management or control; he shall devote all of
his time to said employment and shall make a detailed monthly
report of the operation of said pavilion, giving such information
as the City Council may from time to time require; he shall baV6

no authority to obligate or bind the City under any contract
or agreement, except with the consent of said City.
Section 4s That the City Council .of the City of
Huntington Beach shall adopt a schedule of charges for the
use of, renting of, or admission to said pavilion or any functtion,
entertainment or amusement connected therewith.
Section 61 That said pavilion man eger "shall receive
as compensation for his services one-third of 'the net proceeds
from said pavilion; said hot proceeds to be computed- as followsl
expenses, oonsisting of labor# inaludtng janitor and watchman#
bands, music, advertising, office sup :lies, clerical work, tele•
phone, tickets$ and other expenses connected with and incident
to the operation and management -of said pavilion, sha11 be
deducted from the gross receipts, and the difference shall be
considered the net proceeds for the purpose of computing the
compensation of said -pavilion manager; providedf however, that
charges for light, gas, water, insurance and repairs shall not
be charged against the gross proceeds or deducted therefrom in
computing the net proceeds,*
