A RESOLUTION OF THE CITY .COUNCIL OF THE
CITY OF HUNTINGTON BEACH, CALIFORNIA,
SUBMITTING TO THE ELECTORS OF SAID CITY
A PROPOSED CHARTER AMENDMENT FOR ADOPTION.
The City Council of the City of Huntington
Beach, California, do resolve as follows:
Section 1: That . a special municipal election
shall be held in the City of Huntington Beach on the
21, day ofvPber , 1939 for the
purpose of submitting to the electors of said City of
Huntington Beach the proposition of adoption of- a pro-
posed amendment to the Charter of said City framed by the
legislative body of the City of Huntington Beach, which
charter amendment is hereto annexed and made a part hereof,
as if herein fully set forth, and is designated as Exhibit
"A", and is entitled "PROPOSED CHARTER AMENDMENT OF THE
CITY OF HUNTINGTON BEACH, CALIFORNIA".
Section 2: That at said special election there
shall be four (4) voting precincts, consisting of a con-_
solidation of the regular election precincts last establish--
ed for holding general state or county elections, as follows:`
Consolidated voting precinct "A", comprising
state and county election precincts numbers Huntington Beach
One and Two, and the polling place thereof shall be in the

Memorial Hall located on Sixth Street near the inter-
section of Magnolia Avenue and Sixth Street in said
City.
Consolidated voting precinct "B", com-
prising state and county election precincts numbers
Huntington Beach Three and Four, and the polling place
thereof shall be at the home of J. F. Catching located
at 416 Tenth Street between Orange Avenue and Magnolia
Avenue in said City.
Consolidated voting precinct "C", com-
prising state and county election precincts numbers
Huntington Beach Five and Six, and the polling place thereof
shall be the Windsor Club House on Thirteenth Street between
Crest Avenge and Main Street in said City.
Consolidated voting precinct "D", comprising
state and county ,erection precincts numbers Huntington Beach
Seven and Eight, and the polling place thereof shall be
Maggie Hallicy's Store on the corner of Frankfort Street
and Alabama Avenue in said City.
Section 3: That the election board for consoli-
dated voting Precinct "A" shall be as follows:

That the election board for consolidated
voting Precinct "D" shall be as follows:

Section 4: That said election officers shall
each receive as compensation for his services in serving
upon said election board the sum of FAvP (S5.00) Dollars.
Section 5: That the polls for said special
election shall be opened at 6:00 o'clock A. M. of the
day of said election and must be and remain open continu-
ously from said time until 7:00 o 'clock P. M. of the same
day, when the polls shall be closed; except and provided,
however, that if at said hour of closing there are any

voters at the polling places or in line at the entrance
thereof who are qualified to vote and who have not been
able to do so since appearing, the polls shall be kept
open a sufficient time to enable them to vote, but no
one who shall arrive at the polling places after 7:00
o'clock P. Mo of said day shall be entitled to vote
although the polls may be open when such person shall
arrive.
Section 6: That the said proposed charter
amendment shall be submitted to the electors at the said
special election under the following proposition:

Section 7: That the City Council of said
City shall meet and canvass the returns of said election
at the regular meeting place of said council, said meeting
to be held in the Council Chamber of the City Hall of said
City on Monday, th.e 4th day of December 1939
at the hour of 7:30 o'clock P. M. , said time being; the time
for the next regular meeting of said City
Council after the expiration of three full days after said

election. If at the time of such canvass it shall be
found that at least a majority of the qualified voters
of the City of Huntington Beach at said election upon
said proposition voted in favor thereof, said proposition
shall be deemed approved and adopted,
PASSED AND ADOPTED by the City Council of the
City of Huntington Beach, California, at a regular
meeting thereof held on the 2nd day of October, 1939.

PROPOSED CHARTER AMENDMENT
of the
CITY OF HUNTINGTON BEACH, CALIFORNIA
ARTICLE VIII--A.
Section 1; BOARD OF EDUCATION
The control of the public school depart»
cent of the City of Huntington Beach, including the
whole of the Huntington Beach Elementary School
District as the same now exists or may hereafter be
changed and exist as provided by law, shall be vested
in a Board of Education which shall consist of five
(5) members elected from the district at large.
Section 2: POWERS AND DUTIES
The powers and duties of the Board of
Education shall be such as are prescribed by the
Constitution of the laws of the State of California.

Section 3: ELECTION AND TEAM.
The members of the Board of Education
shall serve for terms of three (3) years from the let
day of July in each year and until their successors are
elected and qualified; provided, however, that the
Trustees of the Huntington Beach Elementary School District
who shall be in office at the time this Charter Amendment
Is approved by the State Legislature shall become members
of the City Board of Education. Each of said members shall
remain in office until the expiration of the term for
which he was elected School Trustee, provided that within
thirty (30) days after the effective date of this Charter
Amendment the three members of the Board of Education shall
appoint the two additional members to serve until the meat
succeeding regular election, at which time three members
shall be elected; the two receiving the highest vote to
serve for three years and the third highest to serve for
two gears. At each annual school election, which shall be
held at the same time set forth in the School Code for
the regular annual election of School Trustees, there shall
be elected members of the Board of Education to fill the
terms of members expiring in that year. All vacancies in
the Board of Education shall be filled by vote of the re-
maining members of the Board of Education for the unexpired
term 1hereof.

being a Union High School, is not affected by this
Article.
