The City Council of the City of Huntington Beach, California, do resolve as J-oll.owsa Section It RE OLVEM, that the Memorial Hall in the City of Hunting beach is � pu'olic �uildirg, erected by and at the cost of the People of said City, and the ground floor thereof shall at all times be, subject to the necessary regulations hereinafter specified, open to the convenient use of the same by the people of the City of Huntington Beach, and Section 2s RESOLVED, that the City Council of said City shall have Pand retain the control of said Memorial Hall, and shall from time to time prescribe its uses and rules and r gulations govern-Jr the same, and Section 3: RESOLVED, that the word "person" when used in this Resolution shill include firm, copartnership, association, society or u�ld, incorporated or unincor- porated, and Section 4; RESOLVED, that the City Clergy of the City of Huntington Beach shall be the custodian of the a keys to and personal property of said Aemorial Hall, and shall receive all applications and Nees, and issue 1, Resolution No. Reso. No. 989 all permits for the use of the same and may, in his discretion and in the interests of the ;people of the - City of Huntington Beach, subject to the final decision of the City Council, reject any application for the use of said building, and Section 5. RESOLVED, that said Memorial Hall may be used by the people of the City- of Huntington Beach for and purpose for which persons may lawfully assemble together; provided., that in no wise shall said building be used for the reg .lar meeting place of any person or association except by special permission of the City Council of the City of Huntington Beach., and Section C. RESOLVED, that any person desiring to use said. Memorial Hall shall first apply to the City Clerk therefor, upon application ford to be furnished by the City Clerk, and Section 7. RESOLVED, that the following charges shall be made for the use of Memorial Hall where the object of the meeting is not financial gain. A. LOCAL USER 1. = 5.00, where no meals or lunches or refreshments are served., and the kitchen is not included in said permit; . $10.00, here the use of the kitchen for the serving of light refreshments is included in said permit; . $15.0b, with the full use of kitchen privileges. 2 Reso. No. 989 B. OUT OF TOWN U `RS: 1. $25.00, where no meals or lunches or refreshments are served, and the kitchen is not included in said permit; 2. $35.00, with the full use of kitchen privileges. 0. DEPOSIT: M� 1. =$10.00 cash deposit to cover broken, lost or stolen dishes, silverware, cooking utensils and ether equipment belonging to the City of Huntington Beach., shall be required of all applicants for sqld hall with kitchen privileges, any unused portion of which shall be returned to the applicant, and Section : RESOLVED, that the `cords "local users'' as used herein shall be defined to be persons living within the City of Huntington Beach aria shall include any established club, church, lodge, society, or association, or corporation that has a regular established office, meeting place or headquarters within the City of Huntington Reach., and shall include the Orange County League of Cities, the dissociated Chambers of Commerce of Orange County, the Grange County Coast Association, and the Orange County Peace Officers Association, and the words "financial al gain" as used in this Resolution shall mean and shall be construed to mean that said applicant expects to derive an/profits from the use of said Memorial Hall, whether or not said profits are to be 3 Reso s No. 989 � 4 obtained by a charge for admission or by taking up a collection and whether or not said profits or receipts are to be used for charitable, philanthropic, civic, ;political or any other purpose, and Section 9« RESOLVED, that any ?person, other than those mentioned in Section 7 hereof, to whom permission may be hereinafter given by the said City Clerk or the City Council to use said Hall, shall pay to the City Clerk- at the time of making application, a fee of Thirty FiYe C 00 Dollars for each day, or any part thereof, that said person might wish to use said Hall , a;n.d, Section 10t RESOLVED, that any person dissatisfied with the decision of the City Clerk in rejecting any application made to hire hereunder may appeal to the City _ Council .from such decision, and the decision of the City Council shall be final and conclusive, and. Section 11: RESOLVED, that the City Clerk shall at all times keep the Memorial a Hall securely locked when not in use, and shall from tine to time inspect the premises and the ersonol property thereof, and shall require the city janitor to report to him promptly any and all d..wa es and. Loss occasioned by the use of said building and personal property, and shall promptly notify the person responsible for such damage or loss to make proper settlement therefor with the City Clerk. 4 -- mesa® No. 989 Section 12: Resolution numbered 682 is hereby repealed. Passed and adopted by the City Council of the City of Huntington Beach, Calis ornia, at the reZular meeting thereof held on the ?nth dp.y of March 1946. �. MR, the duly elected, qualified and acting City Clerk of the City of Huntington Beach, California, and ex—officio Clerk of the City Council of said city, do hereby certify that the whole number of members of the City Council of the City of Huntington Beach is five; that the foregoing Resolution was passed and adopted by the affirmative vote of more than a majority of the members of said City Council at a re ular meeting of the City Council hold on the nth day of ---maxill 1946.
