HomeMy WebLinkAboutCity Council - 1038 RESOLUTION NO. 1039 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIF- ORNIA, DECLARING A NUISANCE TO EXIST AND PROVIDING FOR THE ABATEMENT THEREOF. The City Council of the City of Huntington Beach, California, do resolve as follows: WHEREAS, there are, growing upon the follow- ing described streets and sidewalks and private property within the City of Huntington Beach, California, weeds which bear seeds of a wingy and downy nature , and which attain and have attained such large growth as to become a fire menace when dry, and which have become dry and are of such growth and density as to constitute a public nuis- ance and obstruct the public streets and. sidewalks ; NOW THEREFORE, BE IT RESOLVED, that the said condition and the said weeds , all and singular, do constitute and are hereby declared to constitute a public nuisance, and BE IT FURTHER RESOLVED, that the Superintend- ent of Streets shall post conspicuously in front of the property on which such nuisance exists , at not more than one hundred (100) feet in distance apart, but not less than three in all , notices headed: "NOTICE TO DESTROY ADS" Such heading to be in words not less than one inch in height and 'substantially in the form prescribed in an Act of the Legislature of the State of California entitled: "AN ACT AUTHORIZING .�l® Rsolutin 10 Reso. No. 1038 M- UNICIPALITIRS TO DECLARE OBNOXIOUS OR. DANGEROUS WEEDS GROWING UPON THE STREETS OR SIDE1v ALMS OR UPON PRIVATE PROPERTY WITHIN -MUNICIPALITIES TO BE A PUBLIC NUISA?VC.E', CREATING A LIEN UPON THE PROP- ERTY FRONTING UPON WHICH SUCH NUISANCE EXIST FOR. THE COST OF ABATING THE SAE'" approved May 26, 1915, as amended , (Act No. 5197) ; said notices shall be posted at least five ( 5) days prior to the time of hearing objections by the City Council.
