HomeMy WebLinkAboutCity Council - 1075 RES OLU1'ION NO. 1075 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF IUNTINGTON BEACH, CALIF- ORNIA, PROCLAIMING RESULT OF ELECTION. The City Council of the City of Huntington Beach do resolve as follows. WHEREAS, under date of September 10, 1948, the City Council of the City of Huntington Beach passed and adopted Resolution No. 1053 by which resolution two Charter Amend- ments designated as Charter Amendment No. 1 and Charter Amendment No. 2, and a proposed ordinance designated as Proposition No. 1 were submitted to the electors of the City of Huntington Beach and said election was consol- idated with the general election held on November 2, 1948, and WHEREAS, the propositions voted upon at said special election called by the City Council and consolidated, with said general election as set forth in said resolution were submitted by said. Board of Supervisors to the electors as follows: D 1. CHARTER AMENDiViENT NO. 1: Shall Charter Amendment No. 1 proposed by the City Council be adopted, said amendment pro- viding that a Department of Public Ser- vice be created, prescribing the powers 1 Reno. 10715 and duties thereof and providing that the department shall be self-sustaining and shall have the power to establishr, YES I ) revenue producing projects when auth- C t orized by the City Council or by vote ( NO ' of the qualified voters of said city? F 3. PROPOSITION NO. 1: Shall the ordinance repealing Ordinance No. 396 be adopted? YES' C NO } WHEREAS, the County Board of Supervisors have filed with the City Clerk of the City of Huntington, Beach its resolution stating the result of the canvass of election returns of special election, which resolution is hereby incorporated herein by reference and made a part hereof as if herein fully set forth, and have filed with said City Clerk a resolution stating the results of the canvass of the absent voters ballots cast at said election and giving the total of all votes east on each of the said propositions , which resolution is incorporated herein by reference and made a part hereof as if herein set out in full, and 2 WHEREAS , said Board of Supervisors found that the total of all votes cast, including absentee ballots, on the charter amendments and proposition at said election are as follows, to wit: YES NO TOTAL D 987 1003 1990 E 1320 659 1979 F 1092 807 1899 3399 2469 5868 NOW THEREFORE, the City Council of the City of Huntington Beach do hereby resolve, find, determine and declare as follows: Section 1:: That the said Charter Amendments and Proposition were adopted and defeated as follows: Charter Amendment No. 1 - Defeated Charter Amendment No. 2 -M Adapted Proposition No. 1 - Adopted Section 2 The City Clerk is hereby directed to enter on the records of the City Council a statement of the result of said election as required by law. Section 3s That the Mayor and City Clerk are hereby authorized to prepare or cause to be prepared a Certificate 3 Rene, 1075 of Ratification of the said Charter Amendment No. 2, and submit the same to the Mate Legislature for rati- fication. Section 4: That the said proposition appearing on the ballots as set forth in the said resolution by the Board of Supervisors, County of Orange, State of California, as tAn Ordinance of the City of Huntington Beach repealing Ordinance No. 396 of said Cityt shall be known as Ordinance No. ;38 of said City. Section 5: That the City Clerk shall attest and certify to the passage and adoption of this Resolution by a majority of the votes of the members of the City Council of the City of Huntington Beach.
