A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF HUNTIhGTON BEACH
TO LEASE CITY PROPERTY FOR OIL AND
GAS, IN ACCORDANCE WITH SECTION 3
OF ORDINANCE NO. 526.
WHEREAS, the City of Huntington Beach is the owner of
property described as follows:
The S_0' of the NW-,'I- of the SEg and all that portion of
the SWg of the SE4 of Section 13, Township 6 South,
Range 11 West, S.B.B.& M. , lying north of the southerly
line of the land conveyed by billow Land Co. to A. C.
Thorpe by deed recorded June 13, 1917, in Book 302,
page 69, of Deeds, Records of Orange County, California; `
and
WHEREAS, George C. Atha has made a proposal to the
City for the leasing of said described property for the pur-
pose of exploring for oil, gas and/or hydrocarbon substances ;
and
VTHEREAS , the terms of said proposed lease are gener-
ally as follows: A lease for one year dated January 15, 1952,
with rentals commencing March 15, 1952, unless drilling opera-
tions in good faith have been commenced prior thereto, at the
rate of $5.00 per acre per month, payable monthly in advance,
and the payment to the City of the sum of $220.00 as rental
for the period from January 15, 1952, to March 15, 1952, said
lease calling for the payment of royalty as follows: 1/8 on
each well producing 50 bbls. or less; 1/6 on each well pro-
ducing at least 51 bbls. but not more than 200 bbls. ; 115 on
each well producing 20`.l,, bbls. or more; and
!WHEREAS , Section 3 of Ordinance No. 526 provides

. that the City Council may enter into an immediate lease with-
out the necessity of published notice of its intention to
lease when the City Council resolves , finds and declares that
the best interests of the City be served and protected by
entering into said oil and gas lease; and
WHEREAS , the City Council does hereby resolve, find
and declare that the best interests of the City will be served
and protected by immediately entering into said oil and gas
lease with said George C. Atha, upon the terms and conditions
as herein contained:
NOW THEREFORE BE IT RESOLVED that the City Council of
the City of Huntington Beach do resolve, find and declare
that the best interests of the City will be served and pro-
tected by entering into an oil and gas lease with George C .
Atha on the property above described, upon the terms and
conditions herein set forth.
BE IT FURTHER RESOLVED that the Mayor and the City
Clerk be instructed and directed to execute said lease on
behalf of the City of Huntington Beach.
BE IT FURTHER RESOLVED that this resolution be null
and void unless adopted and passed by a 4/5 vote of the City
Council of the City of Huntington Beach.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach, California, at a regular meeting thereof
held on the 21st day of January, 1952.

I, JOHN L. HENRICKSEN, the duly elected, qualified and
acting City Clerk of the City of Huntington Beach, and ex-
officio Clerk of the City Council of said City, do hereby
certify that the whole number of members of the City Council
of the City of Huntington Beach is five; that the foregoing
Resolution was passed and adopted by the affirmative vote of
at least four-fifths majority of all the members of said City
Council, at a regular meeting thereof held on the 218t day of
January , 19529 by the following vote:

Greer, Talbert, LeBard, Sesbridge, Langenbeek.
NOES: Councilmen: •
None.
