A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTGN BFA.CH REQUESTING GRANT
OF HIGMY USERS' TAX FUND FOR CONSTRUCTION
OF A NEU HIGHWAY GRADE CROSSING AT SEVENTEENTH
STREET OVER THE NEIBLING SPUR OF THE PACIFIC
ELECTRIC RAILWAY TRACKS.
WHEREAS, the City of Huntington Beach, in the County of Orange,
desires to construct a new Highway Grade Crossing at Seventeenth Street
over the Weibling Spur of the Pacific Electric Tracks, a crossing within
the incorporated limits of the City of Huntington Beach, the nature and
extent of the contemplated project being more fully described hereafter;
WHEREAS. Section 2150 of the Streets and Highway Code authorizes
a County, if it so desires, to expend funds apportioned to it out of
California Highway Users' Tax Fund for aid to Cities in the improvement,

construction or repair of a street within a City, provided that the Board
of Supervisors of such County, determine that the project is in the General
County Interest;
NOW, THEREFORE, be it resolved by the City Council of the City
of Huntington Beach, that the City of Huntington Beach hereby requests the
County of Orange for a grant of aid in the sum of Five Thousand Three
Hundred Twenty Eight ($5028.00) Dollars out of the County's Apportionment
of the California Highway Users' Tax Fund, the amount requested to be used
exclusively for the following purposes:
1. - The construction of a new highway grade crossing at
Seventeenth Street over the Weibling Spur of the Pacific Electric Railway
Tracks, as per plans and specifications on file in the City Engineer's
Office, City of Huntington Beach.

2. - The nature and extent of the project and the estimated
cost thereof are substantially as follows;
The portion of Seventeenth Street which is from Pine
Street, to Yorktown Street is the location of the proposed improvement.
The existing subway structure for Seventeenth Street is to be abandoned
and removed. The new roadway will be realigned so as to cross the railroad
track at a short distance north of the existing underpass. It is proposed
to remove the present surfacing between the slope stakes from station
13 + 00 to station 22 4 60, and to surface the new roadway with a 24 foot
strip of 211 asphaltic concrete pavement and 8 foot oiled shoulders. Width
of the improvement is 46 feet and length 1400 feet involving an estimated
cost of $28,224.00 as follows:

DE IT FURTHER RESOLVED, the the Board of Supervisors of the
County` of Orange be and is hereby requested to find that the construction
of the Grade Crossing on Seventeenth Street in the manner aforesaid is
in the general County interest in that; It is a street of major import-
ance running from State Highway 39 into and through the City Limits of the

City of Huntington Beach connecting with Ocean Avenue (State Highway '101).
This street is now carrying large portions of the traffic from State
Highway 39 and adjacent unincorporated area„
BE IT FURTHER RESOLVED, that the grant of the aid hereby
requested is contingent upon an independent finding by the Board of
Supervisors of the county of Orange that the purpose for which aid is
hereby sought is in the general County interest.
BE IT FURTHER RESOLVED, that it is understood that upon
acceptance by the City of Huntington Beach of any grant which may be made
by the County of Orange, pursuant to this request, this Resolution, the
Resolution of the Board of Supervisors of the County of Orange specifying
the terms and conditions of the grant, and any and all laws applicable,
shall constitute the agreement between the City of Huntington Beach and
the County of Grange respecting the grant.
BE IT FURTHER RESOLVED, APM ORDERED, that the City Clerk of
the City of Huntington Beach be and he is hereby directed to forward a
certified copy of this Resolution to the Board of Supervisors of the
County of Orange, State of California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach, California, at a regular meeting thereof held on the
19th day of May, 1952.
