HomeMy WebLinkAboutCity Council - 1195 RESOLUTION NO. 119,E A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, DECLARING A NUISANCE TO EXIST AND PROVIDING FOR THE ABATEMENT THEREOF. The City Council of the City of Huntington Beach, California, do resolve as follows: WHEREAS, there are, growing upon the following described streets and sidewalks and private property within the City of Huntington Beach, California, weeds which bear seeds of wingy and downy nature , and which attain and have attained such large growth as to become a fire menace when dry, and which have be- come dry and are of such growth and density as to constitute a public nuisance and obstruct the public streets and sidewalks, and which are otherwise noxious and dangerous, and whereas there is now upon the following described streets, sidewalks and private property within the City of Huntington Beach, California, rubbish, refuse and dirt which constitutes a. public nuisance and obstructs the parkways, public streets and sidewalks. NET THEREFORE, BE IT RESOLVED, that the said condition and the said weeds, rubbish, refuse and dirt, all and singular, do constitute and are hereby declared to constitute a public nuisance, and BE IT FURTHER RESOLVED, that the Superintendent of Street shall cause notices to be conspicuously posted on or in- front of the property on or in front of which the nuisance exists, -1- Resolution No. 119 5 as follows: (a) One (1) notice to each separately owned parcel of property of not over fifty (50) feet frontage. (b) Not more than two (2) notices to any such parcel of one hundred (100) feet frontage or less. (c) Notices at not more than one hundred (100) feet apart if the frontage of such a parcel is greater than one hundred (100) feet. BE IT FURTHER RESOLVED, that the headings of the notices shall be "NOTICE TO DESTROY WEEDS AND REMOVE RUBBISH I REFUSE AND DIRT" And such heading shall be in letters not less than one (1) inch in height, and shall be substantially in the following form: NOTICE TO DESTROY WEEDS AND REMOVE RUBBISH, REFUSE I AND DIRT Notice is hereby given that on the day of , 1953, the City Council of the City of Huntington Beach passed a resolution declaring that noxious or dangerous weeds were growing upon or in front of the property on this street, and that rubbish, refuse and dirt were upon or in front of property on this street in the City of Huntington Beach and .more particularly des- cribed in the resolution, and that they constitute a plxblic nuisance which must be abated by the removal of the weeds, rubbish refuse, and dirt. Otherwise they will be removed and the nuisance abated by the city and the cost of removal assessed upon the land from or in front of which the weeds, rubbish? refuse, and dirt are removed and will constitute a lien upon such land until paid. Reference is hereby made to the resolution for further particulars.. A copy of said resolu- tion is on file in the office of the City Clerk. All property owners having any objections to the proposed removal of the weeds, rubbish, refuse -2- and dirt are hereby notified to attend a meeting of the City Council, City of Huntington Beach, to be held on the day of 1953, when their objections will be heard and given due con- sideration. Dated this day of 1953.
