HomeMy WebLinkAboutCity Council - 1209 4 RESOLUTION 90. 1209 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH TO ESTABLISH SETBACK LINES ALONG PORTIONS OF CERTAIN STREETS AND PUBLIC WAYS IN SAID CITY AND GIVING NOTICE OF THE TIME AND PLACE OF A PUBLIC HEARING ON SAID PROPOSED SETBACK LINES. WHEREAS, the City Planning Commission of the City of Huntington Beach has by its Resolutions Nos. 29, 30 and 31 recommended to the City Council of the City of Huntington j Beach the establishment of setback lines along certain I portions of streets and public ways in this city; and WHEREAS, said resolutions were accompanied by a map or sketch showing the street or lot lines and the proposed setback lines and the distance thereof from the legally es- 'tablshed property lines; and WHEREAS, the City Council is authorized and impowered under Chapter 95 of the Huntington Beach Ordinance Code to establish setback lines within said city; and WHEREAS, the City Council feels that it is for the best interests of the City of Huntington Beach and that the public peace, health, safety, comfort, convenience, interest and welfare of its citizens requires that said setback lines be established: NOW THEREFORE, the City Council of the City of Huntington Beach, California, does resolve, determine and declare as follows: Section 1: That the City Council of the City of _1_ xeso, 12O9 Huntington Beach does hereby declare its intention to establish setback lines within the City of Huntington Beach as follows: a. A setback line on the east side of Delaware Avenue from Quincy Street to Memphis Street, said setback line to be parallel to the center line of Delaware Avenue and 10 ft. east, measured at right angles, from the present east property line of Delaware Avenue. b. A setback line on the west side of Delaware Avenue from Memphis Street to Nashville Street, said setback line to be parallel to the center line of Delaware Avenue and 10 ft. west, measured at right angles, from the present west property line of Delaware Avenue. c. A setback line on the west side of Delaware Avenue from Oswego Street to Quincy Street, said setback line to be parallel to the center line of Delaware Avenue and 10 ft. west, measured at right angles, from the present west property line of Delaware Avenue. d. A setback line on the east side of Huntington Avenue from Quincy Street to Oswego Street, said setback line to be parallel to the present west property line of Hunting- ton Avenue and 60 ft. east, measured at right angles, from the present west property line of Huntington Avenue. e . A setback line on the north side of Memphis Street from Huntington Avenue to Hampshire Avenue, said setback line to be parallel to the south property line of Memphis Street and 60 ft. north, measured at right angles, from said south property line of Memphis Street. f. A setback line on the north side of Oswego Street 002- Reso o 1209 b from Huntington Avenue to Delaware Avenue, said setback line to be parallel to the south property line of Oswego Street and 60 ft. north, measured at right angles, from the present south property line of said Oswego Street. g. A setback line on the west side of Hampshire Avenue (State Highway 39) from Coast Highway (State Highway 101 Alternate) to Indianapolis Street, said setback line to be uniformly distant 100 ft. west of, and measured at right angles to, the center line of Hampshire Avenue, said center line being the east line of Sections 11 and 14, T. 6 S. , R. 11 W. , S.B.B.& M. h. A setback line on the east side of Hampshire Avenue (State Highway 39) from Coast Highway (State Highway 101 Alternate) to the city boundary line, said boundary line being the south line of the NWJ- of Section 13, T. 66. 7 R. 11 W. , S.B.B.& M. , said setback line to be uniformly distant 138 ft. east of, and measured at right angles to, the center line of Hampshire Avenue, said center line being the east line of Section 14, T. 6 S. , R. 11 W. , S.B.B.& M. i. A setback line on the northeasterly side of Coast Highway (State Highway 101 Alternate) from Huntington Avenue to the most easterly city boundary line, said setback line to be uniformly distant 50 ft. northeasterly of, and measured at right angles to, the northeasterly property line of said Coast Highway. Section 2: That notice is hereby given that on the Ut day of February , 1954, at the hour of 8 o'clock P.M. in the Council Chamber in the City Hall, Huntington -3- Reno* 1209 Beach, California, is the time and place when and where a public hearing shall be held upon said resolution of inten- tion to establish setback lines, as above described, at which hearing any and all persons having any objection to the es- tablishment of the proposed setback lines may appear before the Council and present any objections which they may have to said proposed setback lines. Section 3: The City Clerk is hereby authorized and directed to cause a copy of this resolution of intention to be published in the Huntington Beach News, a newspaper of general circulation printed, published and circulated in this city, by one insertion at least ten days before the i date of said hearing. Section 4: The City Engineer is hereby authorized and directed to post copies of this resolution as required by the Huntington Beach Ordinance Code.
