A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH REGULATING AND
FIXING THE FEES FOR THE USE OF THE
PAVALON BALLROOM! IN SAID CITY AND RE-
PEALING RESOLUTIONS IN CONFLICT HEREWITH
The City Council of the City of Huntington Beach,
California, do resolve as follows:
Section 1: That the Pavalon Ballroom in the City of
Huntington Beach is a public building erected by and at the
cost of the people of Huntington Beach, and that the ballroom
portion of said building, with the exception of the concession
in the northwesterly corner thereof, shall at all times be
open to the convenient use of the same by the people of the
City of Huntington Beach, subject, however, to the necessary
regulations hereinafter specified.
Section 2: RESOLVED, that the City Council of said
city shall have and retain the control of said Pava,lon Ball-
room, and shall from ,time to time prescribe its uses and
rules and regulations governing the same.
Section 3: RESOLVED, that the word "person" when
used in this Resolution shall include firm, copartnership,
association, society or guild, incorporated or unincorporated.
Section 4: RESOLVED, that the City Clerk of the City
of Huntington Beach shall be the custodian of the keys to
and personal property of said. Paavalon Ballroom, and shall
receive all applications and f ees, and may in the interests
of the people of the City of Huntington Beach, subject to

the final decision of the City Council, reject any applica-
tion for the use of said ballroom.
Section 5: RESOLVED, that upon the receipt of any
application for the use of the Pavalon Ballroom, such appli-
cation shall be immediately referred to the Publics Relations
Director of the City of Huntington Beach, and the City Clerk
shall not issue any permits until he has received a report
from the Public Relations Director approving such application.
Section b: RESOLVED, that said Pavalon Ballroom may
be used by the people of the City of Huntington Beach for any
purpose for which persons may lawfully assemble together;
provided, however, that in no shall said building be
used for the regular meeting place of any person or associa-
tion except by special permission of the City Council of the
City of Huntington Beach.
Section 7: RESOLVED, that any person desiring to use
said Pavalon Ballroom shall first apply to the City Clerk
therefor upon application form to be furnished by the City
Clerk, but no application shall be accepted by said City
Clerk unless the application form is accompanied by the fee
required by this Resolution.
Section S: RESOLVED, that the following charges
shall be made for the use of the Pavalon Ballroom where the
object of the meeting is financial gain:
(a) Local users, 25. 00 for Fridays, Saturdays and
holidays; all other days, $10.00.
(b) Out of town users, $50. 00 for Fridays, Saturdays
and holidays; all other days $25. 00.

Section 9: RESOLVED, that the words "local users"
as used herein shall be defined to be persons living within
the City of Huntington Beach, and shall include any established
church, club, lodge, society, association or corporation that
has a regular established office, meeting place or headquart-
ers within the City of Huntington Beach, and shall include the
Orange County League of Cities, Associated Chambers of Com-
merce of Orange County, the Orange County Coast Association,
I'0 the Orange County Peace Officers Association, and the Orange
County Firemen' s Association.
Section 10: RESOLVED, that should a local user desire
to use said Pavalon Ballroom for purposes other than for
financial gain then the City Clerk may waive the fee required
herein.
Section ll: RESOLVED, that "financial gain" as used
in this Resolution shall mean and shall be construed to
mean that the applicant expects to derive some profit from
the use of said Pavalon Ballroom, whether such profits are
to be obtained by a charge for admission or by taking up a
collection, and whether said profits or receipts are to be
used for charitable, philanthropic, civic, political or any
other purposes.
Section 12: RESOLVED, that any person dissatisfied
with the decision of the City Clerk and Public Relations
Director in rejecting any application made hereunder may
appeal to the City Council from such decision, and the de-
cision of thb City Council shall be final and. conclusive.

Section 13: RESOLVED, that the City Clerk shall at
all times keep the Pavalon Ballroom securely looked when not
in use, and shall from time to time inspect the premises and
the personal property thereon, and shall require the head of
the Beach and Pier Department to report to him promptly any
and all damage and loss occasioned by the use of said build-
ing and personal property, and shall promptly notify the
persons responsible for such damage or loss to make the
proper settlement therefor with the City Clerk,
Section 14: RESOLVED, that the Beach and,P ier Depart-
ment shall furnish all necessary and required custodial and
janitorial services for the Pavalon Ballroom, and in this
respect shall be subject to the orders of the City Clerk.
Section 15: RESOLVED, that no permit shall be issued
by the City Clerk unless the applicant shall have complied
to the satisfaction of the City Clerk with all applicable
ordinances of the City of Huntington Beach, including business
licenses and permits.
Section 16: RESOLVED, that all persons who have been
granted permits for the use of the Pavalon Ballroom for pur-
poses of holding dances, whether public or private, shall
comply with all the provisions of Chapter 25 of the Hunting-
ton Beach Ordinance Code.

and acting City Clerk of the City of Huntington Beach, and
ex-officio Clerk of the City Council of said City, do hereby
certify that the whole number of members of the City Council
of the City of Huntington Beach is five; that the foregoing
resolution was passed and adopted by the affirmative vote
of more than a majority of all the members of said City
Council at a regular meeting thereof held on the 7th day
