HomeMy WebLinkAboutCity Council - 1229 RESOLUTION NO. 1.229 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIF- ORNIA, REGULATING AND FIXING THE FEES FOR THE USE OF THE HORSESHOE CLUB BUILDING IN SAID CITY AND REPEALING RESOLUTIONS IN CONFLICT HEREWITH. The City Council of the City of Huntington Beach, California, do resolve as follows: Section 1: RESOLVED, that the Horseshoe Club Building In the City of Huntington Beach is a public building, erected by and at the cost of the People of said City, and thereof shall at all times be, subject to the necessary regulations hereinafter specified, open to the convenient use of the same by the people of the City of Huntington Beach, and Section 2: RESOLVED, that the City Council of said City shall have and retain the control of said Horseshoe Club Building, and shall from time to time prescribe its uses and ruTles and regulations governing the same, and Section 3 : RESOLVED, that the word "person" when used in this Resolution shall include firm, copartnership, association, society or guild, incorporated or unincorporated, and Section 4: RESOLVED, that the City Clerk of the City of Huntington Beach shall be the custodian of the keys to and personal property of said Horseshoe Club Building, and shall receive all applications and fees, and issue all permits for the use of the same and may, in his discretion and in the interests of the people of the City of Huntington. Beach, subject to the final decision of the City Council, reject any application for {1) Reso. 1229 the use of said building, and Section 5: RESOLVED that said Horseshoe Club Building may be used by the people of the City of Huntington Beach for any purpose for which persons may lawfully assemble together; • provided, that in no wise shall said building be used for the regular meeting place of any person or association except by special permission of the City Council of the City of Huntington Beach, and Section 6: RESOLVED, that any person desiring to use said Horseshoe Club Building shall first apply to the City Clerk therefor, upon application form to be furnished by the City Clerk, and Section 7: RESOLVED, that the following charges shall • be made for the use of Horseshoe Club Building where the object of the meeting is not financial gain: A, LOCAL USERS: 1 3,00 • B. OUT OF TOWN USERS: 1. $5.40 Section 8: RESOLVED, that the words "local users" as used herein shall be defined to be persons living within the City of Huntington Beach and shall include any established club, • church, lodge, society, or association, or corporation that has a regular established office, meeting place or headquarters within the City of Huntington Beach, and shall include the Orange County League of Cities, the Associated Chambers of Commerce of Orange County, the Orange County Coast Association, • and the Orange County Peace Officers Association, and the words 2 t ) Reso, 1229 • "financial gain" as used in this Resolution shall mean and shall be construed to mean that said applicant expects to derive any profit"s from the use of said Horseshoe Club Building, whether or • not said profits are to be obtained by a charge for admission or by taking up a collection and whether or not said profits or receipts are to be used for charitable, philanthropic, civic, political or any other purpose, and • Section 9: RESOLVED, that any person, other than those mentioned in Section 7 hereof, to whom permission may be herein- after given by the said City Clerk or the City Council to use said Building, shall pay to the City Clerk at the time of making appli- cation, a fee of Five (45,00) Dollars for each day, or any part thereof, that said person might wish to use said Building, and Section 10: RESOLVED, that any person dissatisfied with the decision of the City Clerk in rejecting any application made to him hereunder may appeal to the City Council from such • decision, and the decision of the City Council shall be final and conclusive, and Section 11: RESOLVED, that the City Clerk shall at all times keep the Horseshoe Club Building securely locked when not in use, and shall from time to time inspect the • premises and the personal property thereof, and shall require the City janitor to report to him promptly any and all damages and loss occasioned by the use of said building and personal property, and shall promptly notify the person responsible for such damage or loss to make proper settlement therefor with the City Clerk, (3 ) Reso, 1229 • PASSED AND ADOPTED by the City Council of the City of Huntington Beach, California, at a regular meeting thereof held on the lst day of November, 1954, • ATTEST: Mayor City Clerk STATE OF CALIFORNIA ) County of Orange ) ss: City of Huntington Beach ) I, JOHN L.
