HomeMy WebLinkAboutCity Council - 1233 • RESOLUTION No. 1233 AN ORDER OF THE CITY COUNCIL VACATING A PORTION OF BUSHARD STREET IN THE CITY OF HUNTINGTON BEACH WHEREAS, the City Council of the City of Huntington Beach, California, did, by unanimous vote on the 6th day of December, 1954, at a regular meeting of said body, • regularly and duly adopt Resolution No. 1231, entitled "A Resolution of Intention of the City Council of the City of Huntington Beach to Vacate a portion of Bushard Street in said City and giving Notice of a Hearing on said Vacation"; and WHEREAS, the City Council of the City of Huntington Beach did elect to proceed under the provisions of the Street Vacation Act of 1941; and WHEREAS, the portion of the street to be vacated lies • within the City of Huntington Beach and is not a portion of a state highway; and WHEREAS, the City Clerk of the City of Huntington Beach did cause a copy of said resolution of intention to be pub- lished in the Huntington Beach News, a newspaper of general • circulation printed and published in the City of Huntington Beach, by one insertion on the 16th day of 'December ,1954; and WHEREAS, said resolution contained a notice that, the 3rd of January, 1955, at the hour of 8:00 o'clock P.M. in the • Council Chamber in the City Hall, Huntington Beach, was the 1. Reso. 1233 time and place when and where a public hearing was to be held upon said resolution of intention, at which hearing all persons interested in or objecting to the proposed vacation may be heard; and WHEREAS, notice of street vacation was posted as required by law; and WHEREAS., there were no protests or persons appear- ing against said proposed street vacation at said hearing; and WHEREAS, the City Council of the City of Huntington Beach finds and determines from all the evidence submitted that the portion of Bushard Street described in said Resolu- tion No. 1231 is unnecessary for present or prospective public street purposes: NOW, THEREFORE, the City Council of the City of Huntington Beach hereby resolves as follows: Section 1: That it is ordered that that portion of Bushard Street in the City of Huntington Beach described as "That portion of Bushard Street as described in a Deed to the County of Orange recorded in Book 1039, page 414, Official Records of Orange County, lying northerly of Parcel I and Southerly of Parcel II as said parcels are described in a Deed to the County of Orange recorded in Book 2551, pages 301 and 302, Official Records of Orange County, California." be, and the same is hereby vacated for public street purposes. 2. Reso. 1233 subject to the reservation of easement and rights set forth in Section 8330 of the Streets and Highway Code of the State of California. Section 2: That the City Clerk is hereby authorized and directed to cause a certified copy of this order, at- tested by the clerk under the seal of this city, together with a certified copy of Resolution No. 1231 to be record- ed in the office of the County Recorder of Orange County, • California.
