HomeMy WebLinkAboutCity Council - 1247 RESOLUTION NO. 124-7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH FINDING AND DECLARING THAT IT BE FOR THE BEST INTERESTS OF THE CITY TO ENTER INTO AN AGREEMENT AMENDING AN EXISTING OIL AND GAS LEASE COVERING CERTAIN CITY-OWNED PROPERTY; AND FINDING AND DECLARING THAT THE USE OF PORTIONS OF SAID CITY-OWNED LANDS AS A DRILL SITE FOR OIL DRILLING WILL NOT SUBSTANTIALLY INTERFERE WITH THE USE OF SUCH PROPERTY FOR OTHER PURPOSES NOW EXISTING ' WHEREAS, the City of Huntington Beach under date of January 24, 1955 entered into an Oil and Gas Lease with Signal Oil and Gas Company, as Lessee, covering certain City-owned lands in the general vicinity of the intersection of State Highway 101 and Hampshire Avenue, which said lease is recorded in Book 2946, Page 198, Official Records of Orange County; and WHEREAS, said lease contains certain limitations and restrictions upon the use by Lessee of the surface of the lands covered by said lease; and WHEREAS, it is to the mutual benefit and advantage of the City and its said Lessee that said Lessee be allowed to occupy and use other portions of said leased lands in addition to the portions thereof now permitted by said lease, all subject however to limitations, restrictions, and controls deemed appropriate by this Council; and WHEREAS, this Council hereby finds that the appropriate, controlled use of additional portions of the surface of said lands now under lease as a site for oil drilling and 0 producing operations would not in its judgment substantially ' 1. Re so,#124 • -interfere with the uses to which said lands are now being put nor any other contemplated municipal uses or functions, nor with other uses now existent in the vicinity; NOW THEREFORE BE IT RESOLVED by the City Council of • the City of Huntington Beach that 1. The City Council hereby finds, declares, and resolves that the statements of fact and of opinion contained in the foregoing preamble are respectively facts, or the best • opinion and judgment of this body 2. That it is for the best interest of the City to immediately enter into an amendment of said Oil and Gas Lease dated January 24, 1955 between the City and Signal Oil and Gas Company, which Lease and amendment covers lands owned by the City in the vicinity of Highway 101 and Hampshire Avenue, all more particularly described in said lease and in the proposed amendment thereto, a copy of which amendment ® is attached to this Resolution, and 3. Therefore, the Mayor and City Clerk are hereby authorized and directed to execute said Amendment of Oil and Gas Lease on behalf of the City Council of the City of Huntington Beach on the form as attached hereto and • presented herewith.
