HomeMy WebLinkAboutCity Council - 1290 RESOLUTION No. 1290 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH TO VACATE A PORTION OF NEWLAND STREET IN SAID CITY AND GIVING NOTICE OF A HEARING ON SAID VACATION WHEREAS, the Highway Department of the State of Calif- ornia, in the interest of safety of the general public, has for some time desired all access roads on Pacific Coast High- way, Highway 101 Alternate, to enter said highway at right angles; and WHEREAS, Newland Street as presently existing does not enter Pacific Coast Highway, Highway 101 Alternate , at right angles; and WHEREAS, the City has for some time considered the ad- visability of relocating a portion of Newland Street so that said street will enter said Pacific Coast Highway, Highway 101 Alternate , at right angles; and WHEREAS, Southern California Edison Company has offer- ed to the City a proposal to relocate a portion of Newland Street so that said street enters said Highway at right angles; and WHEREAS, said proposal further provides that the re- location of said Newland Street shall be at the sole cost and expense of Southern California Edison Company; and WHEREAS, the City Council desires to vacate that por- tion of Newland Street as hereinafter described, after said i 1. No. 1290 Newland Street has been relocated to enter Pacific Coast Highway, Highway 101 alternate , at right angles and the High- way Department of the State of California has given its ap- proval to the access to Pacific Coast Highway, Highway 101 Alternate , of Newland Street at its new location. 1 NOT+ THEREFORE, the City Council of the City of Hunting- ton Beach,California, does resolve , determine , find and de- clare as follows: Section 1: The City Council of the City of Huntington Beach does hereby declare its intention to vacate a portion of Newland Street within the City of Huntington Beach de- scribed as follows: That portion of Newland Street lying within the Fractional South half of Section 13 in Township 6 South, Range 11 Wiest, in the Rancho Las Bolsas and which extends Norther- ly from the Northeasterly line of the Pacific Coast Highway, Highway 101 alternate , as now �► established, to a line described as follows: Beginning at a point in a line that 'is parallel with and 40 feet Southeasterly, measured at right angles, from the Northwest- erly line of the land conveyed by deed to Southern California Edison Company, dated 2. Resol. No. 129p .August 2, 1956 and recorded in Book 36029 page 171, of Official Records in the office of the County Recorder of said County, said point being South 31+0 351 30" West 48.36 feet measured along said parallel line from the intersection thereof with the West line of said Newland Street, said point being the beginning of a curve concave Westerly and having a radius of 370.00 feet, said curve being tangent to said parallel line at said point and being also tangent to the East line of said Newland Street; thence Norther- ly along said curve 227.78 feet, to the end of same , being a point in the East line of said Newland Street. For further particulars as to the proposed vacation, refer- ence is hereby made to a map on file in tl�B office of the City Clerk of said City. Section 2: That notice is hereby given that the 1st day of October , 1956, at the hour of 8:oa o' clock P.M. in the Council Chamber in the City Hall, Huntington Beach, California, is the time and place when and where a public hearing shall be held upon said resolution of intention to vacate said above described portion of Newland Street, at which hearing all persons interested in or objecting to the proposed vacation may be heard. 3. Re sol. No. 1290 Section 3: The City Clerk is hereby authorized and di- rected to cause a copy of this resolution of intention to be published in the Huntington Beach News, a newspaper of gen- eral circulation, printed and published in the City of Hunt- ington Beach' by one insertion prior to the hearing as set r forth in Section 2 hereof. Section 4: The City Council of the City of Huntington Beach, in vacating the portion of Newland Street, as above described, does elect to proceed under the provisions of the Street Vacation Act of 191+1, Division 9, Part 3, of the Streets and Highways Code of the State of California. r Section 5: The Street Superintendent is hereby author- ized and directed to post notices of street vacation as re- quired by law.
