RESOLUTION No.
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF HUNTINGTON BEACH REAFFIRM-
ING THE POLICY OF SAID CITY RELATING
TO THE USE OF THE HUNTINGTON BEACH
PIER FOR RECREATIONAL PURPOSES
WHEREAS, the electors of the City of Huntington
Beach in 1912 voted bonds for the acquisition and con_,
struction of a municipal pier to extend seaward into the
Pacific Ocean from the southerly end of Main Street in the
City of Huntington Beach; and
WHEREAS, said pier was constructed from the funds
received from the sale of said bonds; and
WHEREAS, the electors of the city did, in 19309
vote additional bonds to reconstruct and to extend said
municipal pier approximately 500 feet further seaward to the
total length of approximately 1800 feet; and
WHEREAS, the City of Huntington Beach has consist-
ently maintained, operated and controlled said pier for the
benefit and use of the general public and the electors of
said city for recreational purposes and such other incidental
uses which contribute to the fuller enjoyment of the pier
for said recreational purposes; and
WHEREAS, private interests have requested the use
of said pier for commercial purposes; and
WHEREAS, the people of the City of Huntington Beach

and their duly elected officers, have consistently main-
tained that said pier belonged to the City of Huntington
Beach for the use of the public for recreational purposes.
NOW THEREFORE, BE IT RESOLVED by the City Council
of the City of Huntington Beach that the City Council does
hereby find, declare and determine that it is in the pub-
lic interest and for the general welfare of the residents
of the City of Huntington Beach and the general public, that
the Huntington Beach Municipal Pier, constructed from funds

secured from the sale of bonds voted by the electors of
said city, be operated and maintained for the use, - benefit
and enjoyment of the residents of said city and the gener-
al public for recreational and pleasure purposes.
BE IT FURTHER RESOLVED that it is the position of
the City Council that the Huntington Beach Municipal Pier
is the property of the City of Huntington Beach and that
the City of Huntington Beach has the right, power, author-
ity and duty to operate, maintain and control the Hunting-
ton Beach Pier for the general welfare, benefit and enjoy-
ment of the citizens of Huntington Beach and the general
public, and that the action taken by the City Council at
its meeting on September 6, 1955, relating to the Hunting-
ton Beach Municipal Pier and the request of the State
Lands Commission relating to the Life of the Structure
Permit be and the same is hereby rescinded.

BE IT FURTHER RESOLVED that the City Council
reaffirm the policy heretofore established that the
Huntington Beach Municipal Pier be used for recreational
purposes and such other incidental uses which contribute

to and assist in the fullest use and enjoyment of said
pier by the public for recreational and pleasure purposes.
PASSED AND ADOPTED, by the City Council of the
City of Huntington Beach! California, at a regular ad-
journed meeting thereof held on the 9th day of November,
1956.

• and acting City Clerk ,of the City of Huntington Beach,
and ex-officio Clerk of the City Council of said City, do
hereby certify that the whole number of members of the City
Council of the City of Huntington Beach is five; that
the foregoing resolution was passed and adopted by the: af-
firmative vote of more than a majority of all the members
of said City Council at a regular adjourted neeting there-
of held on the 9th day of November, 1956, by the fol-
lowing vote .
