HomeMy WebLinkAboutCity Council - 1297 I RESOLUTION No. 1297 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH CONSENTING TO THE COMNENCEMIENT OF ANNEXATION PROCEED- INGS FOR THE ANNEXATION TO THE CITY OF HUNTINGTON BEACH OF CERTAIN INHABITED AND UNINCORPORATED TERRITORY IN THE COUNTY OF ORANGE, STATE OF CALIFORNIA, COETIGUOUS TO THE CITY OF HUNTINGTON BEACH, DESIGNATED AS "NORTH ANNEXATION" 14THEREAS, on December loth, 1956, a petition was present- ed to the City Council of the City of Huntington Beach re- questing the Council to give its consent to the commencement of annexation proceedings in connection with that certain inhabited territory therein referred to and generally describ- ed, which is contiguous to the City of Huntington Beach; and WHEREAS, said petition was referred to the Planning Commission of the City of Huntington Beach for investigation, report and recommendation_•, and WHEREAS, the Planning Commission rendered its report and recommendation to the council on the 21st day of December, 1956, favoring the commencement of annexation pro- ceedings; and WHEREAS, the County Boundary Commission of Orange County has heretofore approved the proposed boundary of said Extension as to definiteness and certainty; and WHEREAS, it is the desire of the City Council to give I its consent to the commencement of such annexation proceed- 1. No. 1297 • ings upon condition that tht electors within said territory be informed at the time the petition for annexation is cir- culated that the question to be submitted to said electors shall be whether the territory shall be annexed and the prop- erty in the territory subjected to taxation. after annexation • equally with the property within the City of Huntington Beach to pay the entire bonded indebtedness of the City of Hunt- ington Beach outstanding or authorized at the date of the filing of the petition for annexation for the acquisition, construction or completion of municipal improvements. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach: Section 1. That consent be and hereby is granted for the commencement of annexation proceedings in connection with said inhabited territory in accordance with the Annexa- tion Act of 1913 provided the petition for annexation con- tains a request that the question to be submitted to the electors residing in the territory proposed to be annexed shall be whether the territory shall be annexed and the prop- • erty in the territory subjected to taxation after annexa- tion equally with property within the City of Huntington Beach to pay the bonded indebtedness of the City of Hunting- ton Beach outstanding or authorized at the date of the filing of the petition for annexation for the acquisition, construc- tion or completion of municipal improvements. 2. Reso. No . 1297 i Section 2: That said unincorporated territory be and hereby is designated as the"North Annexation" , is bounded generally as follows: Northerly of the North City limits, easterly of Edwards and Graham Streets as shown -and pro- jected, westerly of Newland Street and Southerly of Smeltzer Avenue. The following is a legal description of said territory: Beginning at the Southwest corner of the North half (N*) of the Northeast quarter (NET) of Section 3, Township 6 South, Range 11 West, San Bernardino Meridian, said corner being in the North Boundary line of the City of Huntington Beach, as now estab- lished; thence North 1290 feet, more or less, to a point in the South line of Garfield Street sixty feet (601 ) wide as now laid out; thence West 20.00 feet, along said South line of Garf5e ld Street; thence North 2690 feet, more or less, along the Wiest line of Edwards Street, Forty feet (401 ) wide as now laid out, and its Southerly prolongation, to an intersection with the North line of 3. Resol.No. 1297 Ellis Avenue , Forty Feet (401 ) wide as now laid out; thence East 20.00 feet, along said North line ofEllis Avenue, to a point in the North, South quarter section line through Section 34 Township 5 South, Range 11 West, San Bernardino Meridian; thence North 2620 feet, more or less, along said North, South quarter section line, to the North line of said Section 31+; thence West 261+0 feet, more or less, along the North line of said Section 31+, to the Northwest corner thereof; thence North 2620 feet, -_--nore or less, along the Westerly line of Section 27, Township 5 South, Range 11, West, San Bernardino Meridian, to a Point in the South line of Slater Avenue , Forty feet (401 ) wide as now laid out; thence West 1320 feet, more or less, along the South line of Slater Avenue to its Westerly terminus; thence North 20.00 feet to the East-West quarter section line through Section 287 Township South Range 11, West, San Bernardino Meridian; thence West 1320 feet, more or less, along said quarter section line to the center of said Sec- tion 28; thence North 2610 feet, more or less, to an intersection with the South line of Winters- burg Avenue , Seventy feet (70' ) wide as now laid out; thence West 20 feet along said South line to an 4. No . 1297 intersection with the Southerly produced west line of Graham Street, Forty Feet (1+01 ) wide as now laid out; thence North 2650 feet, more or less, along said West line of Graham Street and its Southerly prolongation, to an intersection with the South line of Gerhart Avenue , Forty feet (1+01) wide as now laid out; thence West 2650 feet, more or less, along said South line of Gerhart Avenue , to an intersection with the West line of Bolsa Chica Street, Sixty feet (601 ) wide , as now laid out; thence North 2630 feet, more or less , along said West line of Bolsa Chica Street, to an intersec- tion with the South line of Smeltzer Avenue , Sixty feet (601 ) wide as now laid out; thence East three (3) miles, more or less, along said South line of Smeltzer Avenue, to an intersection with the East line of Huntington Beach Boulevard, One hundred thirty two feet (1321 ) wide as now laid out; thence South 4590 feet, more or less, along said East line of Huntington Beach Boulevard, to an intersection with the North line of the South half (S-J) of the Southwest quarter (S6LJ) of the Southwest quarter (SWJ-) of Section 21+, Township 5 South, Range 11, West, San Bernardino Meridian; thence East 1232 feet, more or less, along the North line of said South half (S--) of the South- 1 5. Resol.No. 1297 west quarter (SWJ) of the Southwest quarter (SW ) of said Section 24, to the Northeast corner of the South half (S-j) of the Southwest quarter (SWJ) of the Southwest quarter (SW ) of said Section 24; thence South 3280 feet, more or less, along quar- ter, quarter section lines to an intersection with the North line of Slater avenue, Forty feet (401 ) wide as now laid out; thence East 1340 feet, more or less, along said North line of Slater Avenue , to an intersection with the East line of Newland Street Forty feet (401 ) wide as now laid out; thence South 1340 feet, more or less, along the East line of Newland Street, to an intersection with the Easterly produced Southerly line of the North half (N-J) of the Southwest quarter (S*) of Section 25, Township 5,South, Range 11, West, San Bernardino Meridian; thence Vest 680 feet, more or less, along said Southerly line , and its East- erly prolongation to the Northeast corner of the 1 West half ( -) of the Southeast quarter (SSE ) of the Southwest quarter (SWJ-) of said Section 25; thence South 2640 feet, more or less , to the South- east corner of the West half (W-J) of the Northeast quarter (NE-) of the Northwest quarter (NW ) of Section 36, Township 5, South, Range 11, West, San 1 6. No . 1297 Bernardino Meridian; thence West 660 feet, more or less , to the Northeast corner of the Southwest quar- ter (SW-J) of the Northwest quarter (NU-J) of said Section 36; thence South one (1) mile , more or less along quarter, quarter section lines to the South- east corner of the Northwest quarter (NW ) of the Northwest quarter (NW-j) of Section 1, Township 6 South, Mange 11 West, San Bernardino Meridian;thence Vest 132 feet, more or less, to the Northwest corner of the East 4 Acres, of the Southwest quarter (SW ) of the Northwest quarter (NW ) of said Section 1; thence South 1320 feet, more or less, along the West line of said East 4 acres, of the Southwest quarter (SW-4) of the Northwest quarter ( - ) of said Section 1, to the Southwest corner of said East 4 Acres, heretofore last mentioned, said point being in the center line of Yorktown Street, said point being also in the boundary line of the City of Huntington Beach as now established; thence West 1 1188 feet, more or less , to an angle point in said boundary line; thence North 1320 feet, more or less, to an angle point in said boundary line; thence West one and one-half (1*) miles, more or less, along said boundary line of the City of Hunt- ington Beach to the true point of beginning of this description. 1 7.
