HomeMy WebLinkAboutCity Council - 1303 RESOLUTION NO. 1303 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DECLARING ITS INTENTION TO CALL A SPECIAL ELECTION IN CERTAIN INHABITED TERRITORY CONTIGUOUS TO SAID CITY PROPOSED TO BE ANNEXED THERETO, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS RESIDING IN SAID TERRITORY THE QUESTION WHETHER OR NOT SAID TERRITORY SHALL BE ANNEXED TO THE CITY OF HUNTINGTON BEACH AND FIXING A TIME AND PLACE WHEN AND WHERE ANY PER- SON OWNING REAL PROPERTY WITHIN SUCH TERRITORY MAY APPEAR BEFORE SAID CITY COUNCIL AND SHOW CAUSE WHY SUCH TERRITORY SHOULD NOT BE SO ANNEXED. BE IT RESOLVED by the City Council of the City of Hunt- ington Beach: ! Section 1: That it is the intention of the City Council of the City of Huntington Beach to call a special election to be held on the 4th day of June, 1957, in certain inhabited territory contiguous to said city, proposed to be annexed thereto, for the purpose of submitting to the qual- ified electors residing in said territory the question wheth- er or not said territory shall be annexed to the City of Hunt- ington Beach, and the property in the territory subjected to taxation after annexation equally with property within the City of Huntington Beach to pay the bonded indebtedness of the City of Huntington Beach outstanding or authorized at the date of the filing of the petition for annexation for the acquisition, construction or completion of municipal improvements. • 1. Reso . No . 1303 • Said territory is described as follows: Beginning at the Southwest corner of the North half (N-J) of the Northeast quarter (NE' ) of Section 3, Township 6 South, Range 11 West, San Bernardino • Meridian, said corner being in the North Boundary line of the City of Huntington Beach, as now es- tablished; thence North 1290 feet, more or less, to a point in the South line of Garfield Street, sixty feet (601 ) wide as now laid out; thence West 20.00 feet, along said South line of Garfield Street; thence North 2690 feet, more or less,along the West line of Edwards Street, Forty feet (401 ) • wide as now laid out, and its Southerly prolonga- tion, to an intersection with the North line of Ellis Avenue, Forty feet (401 ) wide as now laid out; thence East 20.00 feet, along said North line of Ellis Avenue, to a point in the North, South quarter section line through Section 34, Township 5 South, Range 11, West, San Bernardino Meridian; • thence North 2620 feet, more or less, along said North, South quarter section line , to the North line of said Section 34; thence West 2640 feet, more or less , along the North line of said Section 34, to the Northwest corner thereof, thence North 2620 feet, more or less, along the Westerly line • 2. No . 1303 • of the Northwest quarter (N6 ) of said Section 1, to the Southwest corner of said East 4 Acres,here tofor last mentioned, said point being in the cen- ter line of Yorktown Street, said point being also in the boundary line of the City of Huntington • Beach as now established; thence West 1188 feet, more or less, to an angle point in said boundary line; thence North 1320 feet, more or less, to an angle point in said boundary line; thence West one and one-half (1*) miles, more or less, along said boundary line of the City of Huntington Beach to the true point of beginning of this description. • Section 2. That said territory hereby is designated and identified for such election purposes and for use upon the ballots at such election as "North Annexation." Section 3. Notice is hereby given that on the 25th day of March, 1957, at the hour of 1:4:5; P.M, , in the Council Chamber of the City Hall of the City of Huntington Beach,any • person owning real property within said territory so proposed to be annexed and having any objection to the proposed annex- ation may appear before said city council and show cause why such territory should not be so annexed. Such protest must be in writing and shall state the name or names of the owner or owners of the property affected by such annexation • 6, RESO. No . 1303 • and the location and area of such property in general terms. If it be found that protest is not made by the owners of one-half of the value of the territory proposed to be annex- ed as shown by the last equalized assessment roll ':or if protest is not made by public and private owners equal to • one-half of the value of the territory, far.ther proceedings shall be taken in accordance with the law for the holding of such special election. Section )+, That the City Clerk shall certify to the passage and adoption of this resolution and shall cause the same to be published in the Huntington Beach News, a week- ly newspaper published, printed and circulated in the City of Huntington Beach, Orange County, California, at least once a week for the two weeks prior to the said hear- ing.
