HomeMy WebLinkAboutCity Council - 1332 RESOLUTION No. 133 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH GIFTING NOTICE OF PROPOSED ANNEXATION TO CITY OF HUNT- INGTON BEACH OF THAT CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNAT ED AS "NORTH No. 2 ANNEXATION" and GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO BE IT RE-SOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH: 1. That pursuant to the provisions of the 'Annexation of Uninhabited Territory Act of 1939", a petition signed by owners of not less than one-fourth of the land in the hereinafter described territory by area and by assessed value as shown on the last equalized assessment roll of the County of Grange, was filed with the Council of the City of Huntington Beach on January 20th, 1958, requesting annexation of the hereinafter described territory to said, City; that said territory which said petitioners request be annexed to the City of .Huntington Beach and which said City and its Council propose .to annex to the City of Hunt- ington Beach is situate in the County of Orange , State of California, hereby designated as"forth No. 2 Annexati.Wt and described as follows "Beginning at the intersection of a line that is parallel with and 30.00 feet Southerly, measured at right angles, from the North line of Section 20, Township 5 South, Range 11 West, San Bernardino Meridian, with line that is parallel with and 30.00 feet Westerly _ l® ,4 Res. No. 1332 measured at right angles, from the East line of said Section 20, said point of intersection being an angle point in the boundary line of the City of Huntington Beach, as now establish- ed; thence, leaving the boundary line of the City of Huntington Beach, North along said line parallel with the East line of said Section 20, and along a line parallel with and 30.00 feet West of the East line of Sections 17 and 8, of said Township and Range to an intersection with a line drawn parallel to and 30.00 feet South- easterly, measured at right angles, from the Rancho Los Alamitos Line, baid Rancho Los Ala- mitos Line being also the center lane of Rancho avenue, 60 feet wide, as now laid out; thence Northeasterly along said parallel line to a point in the boundary line of the City of West- minster; thence, Southerly, Easterly, Souther- ly, Easterly, and Southerly along said boundary to an angle point therein, said angle point be- ing the -Southeast corner of the West 50.00 acres of the. South one-half (S2) of the North- west one-quarter (Ng ) of Section 10, said last mentioned Township and Range; thence, Southerly along the Southerly prolongation of the East line of said hest 50.00 acres to an intersection with the Southerly right of way line of the Southern Pacific Railroad; thence Easterly along said Southerly right of way Line to the intersection of a line drawn parall- el with and 20.00 feet Westerly, measured at right angles from the North and South one-quar- ter section line running through the center of Section 10 of said Township and Range; thence Southerly along said parallel line and its Southerly prolongation to the intersection of a line that is parallel with and 40.00 feet Southerly, measured at right angles from the North line of Section 15 of said Township and Range; thence Easterly along said parallel line, 20.00 feet to an intersection with the North and South one-quarter section line running through the center of said Section 15; thence Southerly along said one-quarter sec- tion line to the Northwest corner of the South- west quarter (S J) of the Southeast quarter (SEA) of said Section 15; thence Easterly in a direct line to the Northeast corner of said Southwest quarter (SVT') of the Southeast quar- 2. No. 1332 ter (SEA) of said Section 15, thence Southerly along the Easterly line of the Southwest quar- ter {S of the Southeast quarter (S ) of said Section 115 and its Southerly prolongation. to an intersection with a line drawn parallel to and 30.00 feet Southerly, measured at right angles from the South line of said Sec- Lion 15, said point of intersection being in the boundary line of the City of Huntington Beach; thence Westerly along said boundary line to the point of beginning." 2, That the County Boundary Co=.fission of Orange County, California, did in session duly assembled on January 13, 1958, approve the proposed annexation bounda- ries of said "North No. 2 Annexation' , as above described, and as submitted to said Commission by the proponents of said annexation of said territory to said city. 3, That Mondm , March 17th , 1958, at the hour of 8s00 otclock P.M. of said day, it the Council Chambers in the City Hall in the City of Huntington Beach, County of Orange, California, is hereby fixed as the time and place when and where any person owning property within the uninhabited territory above described and proposed to be annexed to the City of Huntington Beach and having any objection to the proposed annexation may appear before the Council of the City of Huntington Beach and shoe cause why such uninhabited territory should not be so annexed to said City of Huntington Beach. Such protest .must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall 3. Res. No. 1332 state the name or names of the owner or owners of property affected and the description and area of such property in general terms. The City Clerk of the City of Huntington Beach is hereby authorized and directed to cause a copy of this res- olution to be published twice, but not oftener than once a week, in the "Huntington Beach News", a newspaper of gener- al circulation published in said City of Huntington Beach, the city to which it is proposed to annex the aforesaid territory, and also in the Westminster Herald"', a news- paper of general circulation published outside the City of Huntington Beach, but in the County of Orange , California, the county in which is located the territory proposed to be annexed to the City of Huntington Beach, said publication to be complete at least twenty (20) days prior to the date set for hearing. And the said City Clerk is further authorized and direct- ed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory pro- posed to be annexed is assessed in the last equalized county assessment roll available on the date the above proceedings were initiated, at the addresses shown on said assessment roll or as known to said Clark, and to any person who has filed his name and address and the designation of the lands in which he has any interest either legal or equitable with Res. No. 1332 said Clerk, such notice to be given not less than twenty I (20) days before the first public hearing on the proposed annexation. And in the event any land within the territory pro- posed to be annexed is owned by a county, the said City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such county, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation.. And the said City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by laws PASSED AND ADOPTED by the City Council of the City of 11antington Beach, at a regular adjourned meeting thereof held on the 29th day of January, 1958.
