A RESOLUTION OF PRELIMINARY DETERMINATION
AND OF INTENTION TO FORMI PARKING DISTRICT
IN THE CITY OF HUNTINGTON BEACH .AND TO
ISSUE BONDS TO PAY THE COSTS AND EXPENSES
THEREOF.
PING DISTRICT NO, 1.
RESOLVED, by the City Council of the City of
Huntington Beach, California, that
WHEREAS, a verified petition for the formation
of Parking District No. 1 of the City of Huntington Beach} signed
by the owners of real property in the proposed district, as shown
by the last equalized assessment roll used by the City for purposes
of City taxation, owning real property of an assessed value of not
less than fifty-one percent (51%) of the total a.ssened value of

all taxable real property in the proposed district as shown by the
assessment roll, and owning taxable land in the proposed district
constituting not less than fifty-one percent (51%) of the total
area of all taxable land therein, has been filed in the office
of the City Clerk;
WHEREAS, the City Clerk and City Engineer have
examined said petition and have certified to this Council that
said petition is signed by the requisite number of qualified
signers and is sufficient;
WHEREAS, on the 19th day of January, 1959, this
Council adopted Resolution No, 1356, A Resolution of Approval
and Agreement to Terms of Petition for the Formation of Parking

District No. 1, and Directing Preparation of Report, wherein
said Council approved said petition, found that said petition
had been signed by the requisite number of qualified signers and
is sufficient, agreed to allocate and pledge that portion of the
net revenues of on-street parking meters proposed to be allocated
and pledged in said petition, determined that the public interest,
convenience and necessity require that parking meters be continued
to be maintained as proposed in said petition, and directed the
preparation of a report, as required by Ordinance No. 689, An
Ordinance Relating to Vehicle Off-Street Parking Districts, adopted
by this City Council on June 2, 1958;
WHEREAS, said report has been prepared and filed
in the office of the City Clerk and has been read and considered
by this Council, and preliminarily approved by Resolution No..
1357 A Resolution of Preliminary Approval of Engineer's
Report Pursuant to Ordinance No. 689, adopted by this Council on
January 19, 1959;
NOW, THEREFORE, IT IS HEREBY RESOLVED, DETER11INED
and ORDERED, as follows:
1, That the public interestt convenience and
necessity require the acquisitions and improvements herein
described, and that it, intends to order the formation of Parking
District No. 1, and to issue bonds in the amount and for the
purposes hereinafter stated.
2. That the name of the proposed District is
Parking District No. I of the City of Huntington Beach.

3. That the boundary of the proposed district is
generally described as set forth in Exhibit "A" hereto attached and
by reference incorporated herein.
4. That the parking places proposed to be acquired
are generally described as follows:
PARKING LOT NO. A
Lots 4, 5 and 6, Block 104, Hap of Huntington
Beach, Orange County Records, California.
PAWYCING LOT NO. B
Lots 4,5,6,7 and 8, X33OX Block 103, Hap of
Huntington Beach, Orange County Records, California.
PARKING LOT NO. C
Lots 1,3,5,7 and 9, Bloc?- 203, Hap of Huntington
Beach, Orange County Records, California.
PARKING LOT NO. B
Lots 22, 24, ,26 and 28, Block 204, excepting rear
portions of Lots 26 and 28 occupied by existing
building, Hap of Huntington Beach, Orange County
Records, California.
5 All of said work and improvements are to be con-
structed at the places and in the particular locations, of the forms,
sizes, dimensions and material's, and at the grades and elevations, as
shown and delineated on the plans and specifications to be made there-
for and filed in the office of the City Clerk, reference to which is
hereby made for a full, detailed description of such proposed work and
for further particulars.
6. That the improvements proposed to be made or con-
structed on said proposed parking places are the removal of all
existing buildings and structures which cannot be utilized in the
operation of the off-street parking lots, grading,

including the removal of Obstructions, and the construction
thereon of pavement, curbs,driveway approaches, drains, car
bumpers, parking meters, painting and signs; and the making of
all acquisitions and the constructing of all improvements and
the performance of all work auxiliary thereto and necessary to
complete same as off-street parking facilities. Said improve•
ments may be constructed by the City or acquired as constructed,

8. That the assessed valuation of the taxable real
property within the proposed district, as shown on the last
equalized assessment roll used by the City of Huntington Beach
for purposes of City taxation is $ 888,262—.
9. That an estimate of the average annual gross
revenue which may be expected to be derived from the operation
of the proposed parking places and of the average annual cost
of the maintenance and operation of said parking places, and of
the net revenues to be derived therefrom, are as follows**

10. That an estimate of the annual net revenues
which can be expected to be derived from the parking meters on
the streets within the Parking District from which moneys will
be available to make payments towards the principal and interest
of the bonds, and any other pnrposes authorized by the law,
provided to be made pursuant to the pledge, is as follows;
Average annual net revenue 10,570
11,, That the amount of money which it is proposed
the City contribute towards the cost and expense of the acquisitions
and improvements herein proposed is none.
12. The foregoing statement of the amount of City
contribution shall not prevent the City from making additional
contributions or further pledge to the project from any available
funds, before or after the issuance of the bonds herein, or to
the interest and redemptien .fund to be created therefor, pursuant
to the authority provided in Article XI, Section 18-1/4 of the
Constitution of the State of California, or any other lawful
authority.
13. It is proposed that bonds be issued in the
amount of 1 348,000 and that the maximum number of years the
bonds are to run is thirty -five (35) years, and that the .maximum
rate of interest to be payable thereon is not in excess of six
percent (6%) per annum.
14. That the limits, as stated in the petition,
as to time and rate upon any ad valorem assessments which may
be levied upon the taxable real property in the disti-ict,-:1or the
purposes permitted pursuant to said Ordinance No. 689, are none.

15. The City shall continue to maintain, parking
meters as long as any of said bonds or interest thereon remain
unpaid on the following public ways within the District-,
Southwest side of Ocean Avenue between 1st
Street and 11th Street, the Northeast side of
Ocean Avenue between 3rd Street and 5th street,
Northeast side of Walnut Avenue between 3rd Street
and 5th Street, Southwest side of Walnut Avenue
between 3rd Street and the alley Northwest of
Main Street, Southwest side of Olive Avenue between
5th Street and the alley Southeast of Main Street,
both sides of Uain Street between Ocean Avenue and
Orange Avenue, and the Southeast side of 1st Street
between Ocean Avenue and Olive Avenue,
16o It is proposed that said parking meters be
maintained as long as any of said bonds or interest thereon
remain unpaid, subject to the provisions of said Ordinaneet
ralating to the elimination of parking meters or any thereof.
The City shall also install and maintain parking meters on other
such public ways within the Parking District as the City Council
shall from time to time find and determine that the pu'blic interest '
convenience and necessity require to be installed and maintained.
17. The City shall pledge, allocate and. pay
annually all5of the annual net revenues to be derived from the
off—street parking facilities to be required. and constructed
from the proceeds of the bonds to be issued pursuant hereto, to
pay the principal of and interest on said bonds as the same shall
come due.
18. The City shall pledge, allocate and pay
annually to the payment of the principal of and interest on the
bonds to be issued pursuant hereto, that part of the annual net
revenues to be received by it from the parking meters now or

hereafter located on the streets within the Parking District
within said City that is necessary to pay the balance of the
annual principal of and interest on the bonds as they shall
come due.
19. The City shall annually levy upon all of the
taxable real property within the off-street parking district
created pursuant hereto such annual sum as is necessary to pay
the remaining balance of the principal of and interest on any
of the bonds to be issued pursuant hereto, which have or shall
accrue before the proceeds of another such levy shall be avail-
able therefor, that is not provided to be paid from the proceeds
of the annual net revenues of the off-street parking facilities
to be acquired from the proceeds of said bonds and from the
foregoing pledge of and from the annual net revenues to be
derived from said street meterv.
20. Reference is hereby made to the report on
Parking District No. 1 dated January_19 , 1959, on file in the
office of the City Clerk,
21. The petition provides that the City Council
is authorized, at any time and following a hearing after such
notice thereof as it may prescribe, to determine that no parking
place commission shall be appointed for said district, or to
dissolve such commission if it has already been appointed.
22. These proceedings are had pursuant to the
Parking District Law of 1951 as modified by Ordinance No. 689
entitled "An Ordinance Relating to Vehicle Off-Stre6t Parking
adopted by this Council on June 2.Districts". 1958.

23. Notice is hereby given that Monday
the 2nd day of March 1959, at the hour of 8:00
o1clock P.M. at the Council Chambers, City Hall, Huntington
Beach, California, are hereby fixed as the time and place when
and where the Council will consider and finally determine whether
the public interest, convenience and necessity require said
acquisitions and improvements and when and where it will consider
and finally act upon the Engineer's report to which reference is
herein made, and when and where the Council will hear and deter-
mine all protests filed.
24. Any person interested and objecting to the
formation of the Parking District, the extent thereof, the in—
clusion of his property therein$ the proposed akcquisitionvand
improvements, the issuance of bonds, or to any other proposal
in the Resolution of Preliminary Determination and of Intention,
may file a written protest with the City Clerk at any time prior
to the time fixed- for hearing.
25. The City Clerk shall give notice of the adoption
of this resolution and of said hearing by publishing a copy of
this resolution once a week for two successive weeks in the
Huntington Beach News, a newspaper of general circulation printed
and published in said City, the first publication to be at least
30 days prior to the date of the hearing.
26. The City Clerk shall cause a copy of this
resolution to be posted on or near the Council Chamber door or
on a bulletin board in or adjacent to the City Hall, at least
30 days before said date of hearing,

27. Not less than 25 days prior to the date of
hearing, the City Clerk shall mail a copy of this resolution,
postage prepaid, to each person to whom real property in the
district is assessed as shown on the last equalized assessment
roll on which City taxes are collected, at his address as shown
upon the roll, and to each person, whether owner in fee or having
a lien upon, or legal or equitable interest in, any real property
in the district, whose name and address and a designation of the
real property in which he is interested, is on file in the office
of the City Clerk.
PASSED AND ADOPTED by the City Council of the City
of Huntington Beach, California, at a reaulir meeting
thereof held on the 12th day of January 1959.
