HomeMy WebLinkAboutCity Council - 1404 RESOLUTION: No. 1404 AN ORDER OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH VACATING A PORTION OF A STREET WITHIN SAID CITY. WHEREAS, the City Council of the City of Huntington Beach, California, did, by unanimous vote on the 7th day of December, 1959, at a regular meeting of said body, regu- larly and duly adopt Resolution No. 1401, entitled "A Reso- lution of intention of the City Council of the City of Hunt- ington Beach to vacate a portion of a street in said city and giving notice of a hearing on such vacation"; and WHEREAS, the City Council of the City of Huntington Beach did elect to proceed under the provisions of the Street Vacation Act of 1941; and WHEREAS, the portion of the street to be vacated lies within the City of Huntington Beach and is not a portion of a state highway; and WHEREAS, the City Clerk of the City of Huntington Beach did cause a copy of said resolution of intention to be pub- lished in the Huntington Beach News, a newspaper of general circulation printed and published in the City of Huntington Beach, by one insertion on the loth day of December, 1959; and WHEREAS, said resolution contained a notice that the 28th day of December, 1959, at the hour of 6:00 o'clock P.M. in 1. Res. No. 1404 the Council Chamber in the City Hall, Huntington Beach, was the time and place when and where a public hearing was to be held upon said resolution of intention, at which hearing all persons interested in or objecting to the proposed vacation may be heard; and WHEREAS, notice of a portion of street vacation was posted as required by law: NOW THEREFORE, the City Council of tin City of Huntington Beach does resolve as follows; Section 1. The City Council of the City of Huntington Beach, after hearing the evidence offered by all persons in- terested appearing before said Council, does hereby find from all the evidence submitted that the street herein described is unnecessary for present or prospective public street pur- poses* Section 2: It is hereby ordered that a portion of that certain street in the City of Huntington Beach described as: "All that certain land situated in the State of California, County of Orange, City of Huntington Beach, described as follows: That portion of the land described in deeds to the City of Huntington Beach, recorded on September 29, 1914, in Book 259, Page 213 of Deeds and recorded on February 16, 1931 in Book 455, Page 400 of Official Records, lying within that portion of the Northeast quarter of Fractional Section 14, Township 6 South, Range 11 West, in the Rancho Las Bolsas as shown on a map recorded in book 51, page 11+ of Miscellaneous Maps$ 20 Res. No. 1404 records of Orange County, California, described as follows: Beginning at the intersection of the North- easterly line of the right of way 80 feet wide, of the Southern Pacific Railroad Company, as described in the second parcel of a deed recorded on December 20, 1905 in Book 123, page 96 of Deeds, with a line parallel with and distant Southerly 20 chains from the North line of said Northeast quarter; thence North 890 43' East 411.54feet along said parallel line; thence South 360 54' West 288.91 feet to the Northeast- erly line of Pacific Coast Highway, U. S. 101, described as Parcel 2 in deed recorded on June Recordsthenc 1936, in e©North,530 06ge 1 West Official along said Northeasterly line to said Northeast- erly line of the railroad right of way, being a point on a 1+0 curve concave Northeasterly;thence Northeasterly 115.19 feet along said curve and Northeasterly line to the point of beginning. be and the same is hereby vacated for public street purposes. Section 3, The City Clerk is hereby authorized and di- rected to cause a certified copy of this Order, attested by the Clerk under the seal of this City, together with a certified copy of Resolution No. 1401 to be recorded in the office of the County Recorder of Orange County, California, PASSED AND ADOPTED by the City Council of the City of Huntington Beach, California, this 28th day of December, 1959* Mayor ATTEST: City Clerk 3• Res.
