HomeMy WebLinkAboutCity Council - 1420 RESOLUTION No. 1420 AN ORDER OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH VACATING A PORTION OF A CERTAIN STREET COMMONLY KNOWN AS THE STEARNS RANCHO EASEMENT. WHEREAS, the City Council of the City of Huntington Beach, California, did, by unanimous vote on the 21st day of March, 1960, at a regular meeting of said body, regularly and duly adopt Resolution No. 1415, entitled, "A Resolution of Intention of the City Council of the City of Huntington Beach to Vacate a Portion of a Certain Street commonly known as the Stearns Rancho Easement and Giving Notice of a Hear- ing on said Vacation''; and WHEREAS the CityCouncil ounc of the City 1 e of Huntington Beach did elect to proceed under the provisions of the Street Vacation Act of 191+1; and WHEREAS, the portion of the street to be vacated lies within the City of Huntington Beach and is not a portion of a State Highway; and WHEREAS, the City Clerk of the City of Huntington Beach did cause a copy of said resolution of intention to be pub- lished in the Huntington Beach News, a newspaper of general circulation printed and published in the City of Huntington Beach, by one insertion on the 24th day of March, 1960; and WHEREAS, said resolution contained a notice that the 2nd 1. No. 1420 day of May, 1960, at the hour of 8:00 o'clock P.M. in the Council Chamber in the City Hall, Huntington Beach, was the time and place when and where a public hearing was to be held upon said resolution of intention, at which hearing all persons interested in or objecting to the proposed vacation may be heard; and WHEREAS, notice of street vacation was posted as requir- ed by law; NOW THEREFORE, the City Council of the City of Huntington Beach does resolve as follows: Section 1. The City Council of the City of Huntington Beach, after hearing the evidence offered by all persons in- terested appearing before said Council, does hereby find from all the evidence submitted that the street herein describ- ed is unnecessary for present or prospective public street purposes. Section 2. It is hereby ordered that that certain street in the City of Huntington Beach, described as: Commencing at an axle per C.S.T.B. 136-3, at the center of Section 20, Township 5 South, Range 11 West thence N. 00 1+1' 19" W. 695.07 feet to a 2" iron pipe marked "L.S. 2955" set at the point of beginning, thence N. 00 41' 19" W. 191-5.22 feet to a 2" iron pipe marked "L.S. 295511 , thence N. 890 37' 58" E. 20.00 feet to a point, thence S. 2. Res. No. 1420 00 411 19" .E. 1945.23 feet to a point, thence S. 890 38' 35" E. 20.00 feet to the point of beginning. be and the same is hereby vacated for public street pur- poses. Section 3. The City Clerk is hereby authorized and directed to cause a certified copy of this order, attested by the Clerk under the seal of this City, together with a certified copy of Resolution No. 1415, to be recorded in the office of the County Recorder of Orange County, California.
