HomeMy WebLinkAboutCity Council - 1427 .A RESOLUTION No. 1427 RESOLUTION DECLARING THE INTENTION OF THE COUNCIL OF THE CITY OF HUNTINGTON BEACH TO INITIATE ON ITS OWN MOTION PROCEEDINGS TO ANNEX CERTAIN UNINHABITED TERRITORY BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HUNTINGTON BEACH: 1. That the Council of the City of Huntington Beach, for the reasons hereinafter mentioned, proposes to initiate on its motion, as soon as it can legally do so, proceedings to annex to the City of Huntington Beach all of the territory hereinafter described, as uninhabited territory, under pro- visions of the Annexation of Uninhabited Territory Act of 1939 as set forth in Sections 35300 to 35325, inclusive, of the Government Code of the State of California. 2. That the Council' s reasons for proposing to initi- ate said annexation proceedings are as follows: The annexa- tion of the hereinafter described territory will contribute to the orderly growth of the city„ provide the proper control of street layout, drainage, sanitary sewer design, and in- sure the proper use of land in conformity with the overall zoning plan of the city. 3. That the territory which the Council proposes to annex is hereby identified as "Sunset Harbour Annexation," and consists of all that real property situate in the County of Orange, State of California, described as follows: "Commencing at a point in the City Boundary of the City of Huntington Beach, said boundary having been established x 1. Reso. 1427 by "West Annexation" in Ordinance No. 732 of said city and having been certified by the Secretary of State of the State of ,California on October 26, 1959, said point being the point of 'intersection of the North line of Smeltzer Avenue, 60 feet in width as now laid out, said line being 30 feet North of and parallel to the North line of Section 20, T. 5.S. , R. 11.W. , S.B.B. & M. , with the northerly prolongation of the West dine of the East .one-half of the Northwest one-quarter of said Section 20, said point also be ing the true point of beginning: THENCE westerly along said parallel line a distance of 1320 feet, more or less to the West line of Section 17 of said Township and Range; THENCE continuing westerly along a line parallel with and distant northerly 30 feet, measured at right angles, from the North line of Section 19 of said Township and Range, a distance of 3526.82 feet, more or less, to the line common to the Ranchos Bolsa Chica and Los Alamitos; THENCE S 490 30' 00" W along said Rancho line 1955 feet, more or less , to the common boundary between the property conveyed to the Lomita Land and Water Company per deed recorded in Book 160, page 282, of Deeds , Records of Orange County, California, and the property conveyed to the Sunset Beach Company as described in a deed recorded in Book 108, page 46 .of said Deeds; THENCE S 160 30,00" E along said common line 1465. 2 feet to an angle point therein; x 2. No. 1427 THENCE S 420 45100" E along said common line 2727. 12 feet to an angle point in said line; THENCE S 470 30,000 E along said common line 1320 feet to an angle point therein; THENCE S 380 15100" E 901.44 feet along said common boundary to the North line of that certain 1.334 acre parcel shown on a =ap thereof recorded in Book 7, page 20, of Records of Suave of said Count Survey Y; THENCE N 890 42 ,45" E along said North line 307.48 feet to the East line of said parcel; THENCE S 00 171150 E along the East line of said parcel, 300 feet, to the north line of the Southerly 30 feet of the North one-half of the ,Northeast one-quarter of Section 30 of said Township and Range, said North line being also the North line of Los Patos Avenue, 60 feet in width as now laid out; THENCE easterly 3008 feet, more or less, to an angle point in said North line of Los Patos Avenue, said angle point being in the North line of the Southerly 30 feet of the North onehalf of the Northwest one quarter of Section 29, said Township and Range. THENCE, continuing on said street right of way line, Northerly 15 feet to a point and thence Northeasterly 877.44 feet on a curve, concave to the Northwest and 555 feet in radius, to a point, thence Easterly 15 feet to a paint in the West line of Algonquin Street, 50 feet in width as now laid out, said line being 30 feet West of and at right angles to the East line of said Northwest one quarter section, X 3• Reso. THENCE Northerly on said West line 748 feet, more or less , to the North line of Wintersburg ,Avenue, 60 feet in width as now laid out, said line also being the North line of the South 30 feet of Section 20; said Township and Range; THENCE Easterly 40 feet to the East line of Algonquin Street, 40 feet in width as now laid out, said East line being parallel to and distant, Easterly 20 feet, measured at right angles from the East line of the West one-half of said Section 20; THENCE Northerly 2610. feet more or less on said East line to a point in the South line of the North one-half of said Section 20; THENCE West .on said South line 13.41.39 feet, more or less, to the Southwest corner of the East one-half of the Northwest one-quarter of said Section 20; THENCE North on the West line of the East one-half of the Northwest one-quarter of said Section 20, a distance of 2670 feet, more or less, to the true point of beginning, the Northerly 2010 feet, more or less,,, being in said boundary of the City of Huntington Beach." 4. That the City Clerk of the City of Huntington Beach is hereby directed to file with the Boundary Commission of the County of Orange, State of California, this proposal to initiate proceedings to annex the hereinabove described uninhabited territory to the City of Huntington Beach, and to request a report by the Commission as provided for in Section 35002 of the Government Code. x 4.
