HomeMy WebLinkAboutCity Council - 1429 RESOLUTION No. 1429' RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF TIC' CITY OF HUNTINGTON BEACH TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "SUNSET HARBOUR AN- NEXATION," AND GIVING NOTICE OF THE PRO- POSED ANNEXATION. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HUNTINGTON BEACH: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of Huntington Beach , on its own motion, to annex to the City of Huntington Beach all that uninhabited territory situate in the County of Orange, State of California, hereby designated as "SUNSET HARBOUR ANNEXATION" and described as follows: "Commencing at a point in the City Boundary of the City of Huntington Beach, said boundary having been established by "West Annexation" in Ordinance No. 732 of said city and having been certified by the Secretary of the State of California on October 26, 1959, said point being the point of intersection of the North line of Smeltzer Avenue , 60 feet in width as now laid out, said line being 30 feet North of and parallel to the North line of Section 20, T. 5.S. 7 R.11.W. 9 S.B.B. & M. , with the northerly pro- f Res. No. 1429 longation of the West line of the East one-half of the Northwest one-quarter of said Section 20, said point also being the true point of beginning: TaFNCE westerly along said parallel line a distance, , of 1320 feet, more or less to the West line of Section 17 of said Township and Range; THENCE continuing westerly along a line par- allel with and distant northerly 30 feet, measured at right angles, from the North line of Section 19 of said Township and Range, a distance of 3526.82 feet, more or less, to the line common to the Ranchos Bolsa Chica and Los Alamitos; THENCE S 1+90 30t 0011 W along said Rancho line 1955 feet, more or less, to the common boundary be- tween the property conveyed to the Lomita Land and Water Company per deed recorded in Book 160, page 282, of Deeds, Records of Orange County, California, and the property conveyed to the Sunset Beach Company as described in a deed recorded in Book 108, page 1+6 of said Deeds; THENCE S 160 301 0011 E along said common line 1465.2 feet to an angle point therein; THENCE S 420 1+5t 00" E along said common line 2727.12 feet to an angle point in said line; THENCE S 1+70 30t OOt' E along said common line 1320 feet to an angle point therein; 20 Res. No. 1429 THENCE S 380 15t 00" E 901.44 feet along said common boundary to the North line of that certain 1,334 acre parcel shown on a map thereof recorded in Book 7, page 20, of Records of Survey of said County THENCE N 890 42t 45t' E along said North line 307.48 feet to the East line of said parcel; THENCE S 00 171 151' E along the East line of said parcel, 300 feet, to the north line of the Southerly 30 feet of the North one-half of the Northeast one-quarter of Section 30 of said Town- ship and Range, said North line being also the North line of Los Patos Avenue, 60 feet in width as now laid out; THENCE easterly 3008 feet, more or less, to an angle point in said North line of Los Patos Avenue , said angle point being in the North line of the Southerly 30 feet of the North one half of the Northwest one quarter of Section 29, said Township and Range. THENCE, continuing on said street right of way line, Northerly 15 feet to a point and thence Northeasterly 877.44 feet on a curve, concave to the Northwest and 555 feet in radius, to a point, thence Easterly 15 feet to a point in the West line of Algonquin Street, 50 feet in width as now 3• Res. No. 1420 laid out, said line being 30 feet West of and at right angles to the East line of said Northwest one-quarter section; THENCE Northerly on said West line 748 feet I more or less, to the North line of Wintersburg Avenue , 60 feet in width as now laid out, said line also being the North line of the South 30 feet of Section 20 , said Township and Range; j THENCE Easterly 40 feet to the East line of Algonquin Street, 1+0 feet in width as now laid out, I said East line being parallel to and distant, East- erly 20 feet, measured at right angles from the East line of the West one-half of said Section 20; THENCE Northerly 2610 feet, more or less on said East line to a point in the South line of the North one-half of said Section 20; THENCE West on said South line 131r1.39 feet, more or less, to the Southwest corner of the East one-half of the Northwest one-quarter of said Sec- tion 20; THENCE North on the West line of the East one-half of the Northwest one-quarter of said See- tion 20, a distance of 2670 feet, more or less, to the true point of beginning, the Northerly 2010 feet, more or less, being in said boundary of the City of Huntington Beach.' 4. Res. No. 1429 2* That the Council of the City of Huntington Beach desires to annex said uninhabited territory to the City of Huntington Beach for the following reasons: The territory is contiguous to the City of Huntington Beach, and its pro- posed annexation will contribute to and facilitate the or- derly growth and development of both the City and the terr- itory proposed to be annexed; will facilitate and contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks, sanitary and storm water sewers and drainage facilities, both within the City and within the territory proposed to be annexed; and will provide and facilitate proper overall planning and zoning of lands, and subdivision of lands in said City and said uninhabited territory, in a manner most conducive to the welfare of said city and said uninhabited territory. 3. That the County Boundary Commission of Orange County, California , did in session duly assembled on the day of July, 1960, approve the proposed annexation boundaries of said "Sunset Harbour Annexation" as above de- scribed, and as submitted to said Commission by the Council of the City of Huntington Beach, 1+. That the 19th day of September, 1960, at the hour of 8:00 o'clock P.M. in the Council Chambers in the City Hall in the City of Huntington Beach, County of Orange, Califor- nia, is hereby fixed as the time and place when and where Res. No. 1429 any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Huntington Beach, and having any objections to the proposed annexation, may appear before the Council of the City of Huntington Beach and show cause why such uninhabited territory should not be so annexed to said City of Hunting- ton Beach. Such protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected, and the descrip- tion and area of such property, in general terms. 5. The City Clerk of the City of Huntington Beach is hereby authorized and directed to cause a copy of this res- olution to be published at least twice, but not oftener than once a week, in the "Huntington Beach News", a newspaper of general circulation published in said City of Huntington Beach, the city to which it is proposed to annex the afore- said territory, and also in the "Westminster Herald", a newspaper of general circulation published outside the City of Huntington Beach, but in the County of Orange, California, the county in which is located the territory proposed to be annexed to the City of Huntington Beach, said publication to be complete at least twenty (20) days prior to the date set for hearing. 6. The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above sad proceedings were initiated, at the addresses shown on said Ili assessment roll or known to the Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable , with the Clerk, such notice to be given not less tha n n twenty (20) days before the first public hearing on the proposed annexation. 7. In the event any land within the territory proposed to be annexed is owned by a county, the City Clerk is direct- ed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of the county, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 8. In the event there is, upon the land proposed to be annexed, a structural improvement owned, being acquired or leased by a county fire protection district, the said Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such dis- trict, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation.
