HomeMy WebLinkAboutCity Council - 1437 RESOLUTION No.107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGT ON BEACH GIVING NOTICE CP PROPOSED ANNEXATION TO CITY CP HUNT INGT ON BEACH C F THAT CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED AS "NEWLAND No. 1 ANNEX- ATION", AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNT- INGTON BEACH: 1. That pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939" , a petition signed by owners of not less than one-fourth of the land in the here- inafter described territory by area and by assessed value as shown on the last equalized assessment roll of the County of Orange, was filed with the Council of the City of Hunting- ton Beach on September 26 , 19609 requesting annexation of the hereinafter described territory to said City; that said territory which said petitioners request be annexed to the City of Huntington Beach and which said City and its Council propose to annex to the City of Huntington Beach is situate in the County of Orange, State of California, hereby desig- nated "Newland #1 Annexation", and described as follows: "A portion of the North half of Section 25, Town- ship 5 South, Range 11 West, San Bernardino Base and Meridian in the Rancho Las Bolsas in the County of Orange State of California as shown on map recorded in Book 51 Page b of Miscellaneous Maps�Records of Orange 6ounty, described as follows: 1. Res. No. 1437 Beginning at the North quarter corner of Section 25, Township 5 South, Range 11 West, San Bernard- ino Base and Meridian, said quarter corner being the centerline intersection of Wintersburg Avenue 60 feet wide and Newland Street 40 feet wide; thence South 00 15t 35" West along the center- line of Newland Street a distance of 30 feet; thence, South 890 31t 25" East parallel with the centerline of Wintersburg Avenue a distance of 20 feet to the true point of beginning, said point lying in the east line of Newland Street also the west boundary line of the City of Fountain Valley thence, South 00 151 35" West along said east line of Newland Street and west boundary line of the City of Fountain Valley, a distance of 2591,00 feet to a point in the north line of Slater Avenue 40 feet wide, said north line of Slater Avenue also being the north boundary line of the City of Huntington Beach- thence North 890 311 25" West along said north line of Siater Avenue and the north boundary line of City of Huntington Beach a distance of 1338.75 feet to a point in the east boundary line of the City of Huntington Beach, said point being an angle point in the boundary line of the City of Huntington Beach; thence, North 00 16t 078 East along the said east boundary line of the City of Huntington Beach a distance of 2591.00 feet to a point in the south line of Wint- ersburg Avenue 60 feet wide and also the south boundary line of the city of Huntington Beach, said point being an angle point in the boundary line of the City of Huntington Beach; thence, South 890 31' 25"East along said south line of Wintersburg Avenue and the south boundary line of City of Hunt- ington Beach a distance of 1338.35 feet to the true point of beginning, said point being an angle point in the boundary line of the City of Fountain Valley. 2. That the County Boundary Commission of Orange County, California, did in session duly assembled on September 19th, 1960, approve the proposed annexation boundaries of said Newland #1 Annexation, as above described, and as submitted to said-Commission by the proponents of said annexation of said territory to said City. 2. Res No. 1437 3, That November 2th, 1960, at the hour of 8:00 6161ock P.M. of said day, in the Council Chambers, in the City Hall in the City of Huntington Beach, County of Orange, California is hereby fixed as the time and place when and where any per- son owning prope rty within the uninhabited territory above described and proposed to be annexed to the City of Hunting- ton Beach and having an objection to the proposed annexation Y ob� may appear before the Council of the City of Huntington Beach and show cause why such uninhabited territory should not be so annexed to said City of Huntington Beach. Such protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of prop- erty affected and the description and area of such property in general terms. 1+. The City Clerk of the City of Huntington Beach is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the "Huntington Beach News" , a newspap- er of general circulation published in said City of Hunting- ton Beach, the city to which it is proposed to annex the aforesaid territory, and also in the "Westminster Herald" a newspaper of general circulation published outside the City of Huntington Beach, but in the County of Orange, Calif- ornia, the county in which is located the territory proposed 3• Res. No. 1437 to be annexed to the City of Huntington Beach, said publica- tion to be complete at least twenty (20) days prior to the date set for hearing. 5. And the said City Clerk is further authorized and directed to cause written notice of such annexation proposed to be mailed to each person to whom land within the terri- tory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above pro- ceedings were initiated, at the addresses shown on said assessment roll or as known to said Clerk, and to any person who has filed his name and address and the designation of the lands in which he has any interest, either legal or equitable with said Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 6. In the event any land within the territory proposed to be annexed is owned by a county, the said City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such County, such notice to be given not less than twenty (20) days be- fore the first public hearing on the proposed annexation. 7. The said City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law. 4. Res.
