HomeMy WebLinkAboutCity Council - 1438A RESOLUTION No. 1438-A A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, RE: SALE OF WATER TO PROPERTY TO BE AN- NEXED TO THE CITY OF HUNT INGT ON BEACH. WHEREAS, the owners of the hereinafter described real property desire to secure city water for domestic purposes for the hereinafter described real property, which property is now outside the City limits and which property the own- ers have indicated their desire to have annexed to the City; and WHEREAS, the owners are taking steps to annex said prop- erty to the City of Huntington Beach; and WHEREAS, no water may be sold from the city water system outside the city limits unless the City Council shall, by resolution, determine that a surplus of water exists in ex- cess of that required by the inhabitants of the City; and WHEREAS, at the M esent time , the City has a surplus beyond the needs of the inhabitants; NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Huntington Beach does declare as follows: 1. That a surplus of water exists at the present time in excess of that now required by the inhabitants of the City. 2. That the Council is hereby empowered, by agreement, 1 . Res. No. 1438-A to contract for the furnishing of water, on a temporary bas- is, to the herein described real property for domestic pur- poses in accordance with the terms of this resolution. 3. That no water be furnished to said real property unless and until a valid and sufficient petition for annex- ation of the hereinafter described real property to the City of Huntington Beach has been filed with the City Clerk. �+. The property to be annexed to the City is now owned by RUBIN DOBKIN and IRENE DCBKIN and is described as follows: The Southeast quarter (SH:j) of the Northeast quarter (NEJ) of the Northwest quarter (NWJ) of Section 36, Township 5 South, Range 11 West, S.B.B. & M. , in the County of Orange, State of California 5, BE IT FURTHER RESOLVED that no water be served to said real property unless said annexation petition has been filed prior to ninety (90) days from the date hereof and in the event that the proposed annexation should not be completed for any reason, any contract for the service of water to said real property shall automatically termi- nate.
