HomeMy WebLinkAboutCity Council - 1442 RESOLUTION No, 1442 A RESOLUTION CF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH GIVING NOTICE OF PROPOSED ANNEXATION TO CITY (I' HUNT- INGTON BEACH OF THAT CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED AS "NORTHEAST No. 3 ANNEXATION", AND GIVING NOTICE (F TIME AND PLACE FOR BEAR- ING M PROTESTS THERETO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNT INGT ON BEACH-. 1. That pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939", a petition signed by owners of not less than one-fourth of the land in the here- inafter described territory by area and by assessed value as shown on the last equalized assessment roll of the County of Orange, was filed with the Council of the City of Hunt- ington Beach on November 9th, 1960, requesting annexation of the hereinafter described territory to said City; that said territory which said petition requests be annexed to the City of Huntington Beach and which said City and its Council propose to annex to the City of Huntington Beach is situate in the County of Orange, State of California, hereby designated as "Northeast No. 3 Annexation", and described as follows: "Beginning at the Southwest (SW) corner of the Southeast one quarter (SEJ) of the Northeast one quarter (NEB of the Northwest quarter (NWU of Section 36, Township 5 South, Range 11 1. Res. No. 1442 West, San Bernardino Meridian, Orange County, Calif. ornia; said point being an angle point in the exist- ing boundary of the City of Huntington Beach; thence N. 00 11t 10" W. alon the West line of said South- east one quarter (h 5 and along the boundary line of Huntington Beach 60.07 feet to the Northwest (NW) corner of said Southeast one quarter (SE*) ; thence N, 890 481 11" W. along the North line and the North line produced of said Southeast one quar- ter (SEj) and along the boundary of Huntington Beach 679,81 feet to a point in the East right of way line of Newland Street 40 feet in width as now laid out, said point lying in the existing boundary line of the City of Fountain Valley; thence S. 0 52' 11" E. along the East right of way line of Newland Street and along the boundary line of Fountain Valley 643,0 feet more or less to an angle point iB the boundary line of Fountain Valley; thence S. l}+ 30t W, along the boundary line of Fountain Valley 21.0 feet more or less to a point; thence W. 890 47' 54" W. along the South line of the above mentioned Southeast one quarter (S ) of the Northeast one quarter (NEJ) of the Northwest one quarter (Nl ) of Section 36, 667.7 feet more or less to the true point of beginning". 2, That the County Boundary Commission of Orange County California, did in session duly assembled on October 31st 1960, approve the proposed annexation boundaries of said "Northeast No. 3 Annexation", as above described, and as submitted to said Commission by the proponents of said annex- ation of said territory to said city. 3. That January 16th, 1961, at the hour of 8:00 o'clock P.M. of said day, in the Council Chambers in the City Hall in the City of Huntington Beach, County of Orange, Calif- ornia, is hereby fixed as the time and place when and where any person owning property within the uninhabited territory 2, Res. No. 1442 above described and proposed to be annexed to the City of Huntington Beach and having any objection to the proposed annexation may appear before the Council of the City of Huntington Beach and show cause why such uninhabited terr- itory should not be so annexed to said City of Huntington Beach. Such protest must be in writing, may be filed at any time before the hots set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the descrip- tion and area of such property in general terms. The City Clerk of the City of Huntington Beach is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the "Huntington Beach News"; a news- paper of general circulation published in said City of Huntington Beach, the city to which it is proposed to an- nex the aforesaid territory, and also in the "Westminster Herald" , a newspaper of general circulation published out- side the City of Huntington Beach, but in the County of Orange , California, the county in which is located the territory proposed to be annexed to the City of Huntington Beach, said publication to be complete at least twenty(20) days prior to the date set for hearing. And the said. City Clerk is further authorized 3. Res. No. 1442 and directed to cause written notice of such proposed annex- ation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above proceedings were initiated, at the addresses shown on said assessment roll or as known to said Clerk, and to any person who has filed his name and address and the designa- tion of the lands in which he has any interest, either legal or equitable with said Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. And in the event any land within the territory proposed to be annexed is owned by a countyt the said City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such county2such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. And the said City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
