HomeMy WebLinkAboutCity Council - 1461 RESOLUTION NO. 1461 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH TO VACATE A PORTION OF UTICA STREET IN SAID CITY, ASD GIVING NOTICE OF A HEARING ON SAID VACATION WIRREAS, the City Council has received a written request for the vacation of a portion of Utica Street, within the City of Huntington Beach; and WHEREAS, said portion of Utica Street is not now being used as a public street and highway for the general public; and WHEREAS, the best interests of the citizens of Hunt- ington Beach would be served by the vacation of a portion of Utica Street; NOW THEREFORE, the City Council of the City of Hunting- ton Beach, California, does resolve, determine, find and declare, as follows: Section 1. The City Council of the City of Huntington Beach does hereby declare its intention to vacate a portion of Utica Street, within the City of Huntington Beach, described as follows: "A portion of Lot "A", Tract No. 260, as per map recorded in Book 13, Page 34, of Miscell- aneous Maps, records of said Orange County: said portion being more particularly described as follows: The westerly 397.00 feet of the parcel of land dedicated for street purposes to the City of Huntington Beach in a deed dated September 26, 1925, and recorded on Page 139 of Book 235, Official 'Records, as found in the Office of the County Recorder, Orange County, California; 1. For further particulars as to the proposed vacation reference is hereby made to a map on file in the office of the City Clerk of said City. Section 2. That notice is hereby given that the 20th clay of March, 1961, at the hour of 8:30 o'clock P.M. in the Council Chamber in the City Hall, Huntington Beach, California, is the time and place when and where a public hearing shall be held upon said resolution of intention to vacate said above described portion of Utica Street, at which hearing all persons interested in or objecting to th e proposed vacation may be heard. . Section 3. The City Clerk is hereby authorized and directed to cause a copy of this resolution of intention to be published in the Huntington Beach News, a newspaper of general circulation, printed and published in the City of Huntington Beach, by one insertion prior to the hearing as set forth in Section 2 hereof. Section 4. The City Council of the City of Huntington Beach, in vacating the portion of Utica Street, as above described, does elect to proceed under the provisions of the Street Vacation Act of 1941, Division 9, Part 3, of the Streets and Highways Code of the State of California. Section 5. The Street Superintendent is hereby authorized and directed to post notices of street vacation as required by law. Section 6. Resolution of Intention No. 1456, passed and adopted by the City Council of said City of Huntington Beach, California, on January 16, 1961, be and the same hereby is repealed. 2.
