HomeMy WebLinkAboutCity Council - 1474 RESOLUTION NO. 1474 AN ORDER OF THE CITY COUNCIL VACATING A PORTION OF UTICA STREET IN THE CITY OF HUNTINGTON BEACH WHEREAS, the City Council of the City of Huntington Beach, California, did by unanimous vote on the 16th day of January, 1961, at a regular meeting of said body, regularly and duly adopt Resolution No. 1461, entitled "A RESOLUTION of INTENTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH TO VACATE A PORTION OF UTICA STREET IN SAID CITY, AND GIVING NOTICE OF A HEARING ON SAID VACATION" ; and WHEREAS, the City Council of the City of Huntington Beach did elect to proceed under the provisions of the Street Vacation Act of 1941; and WHEREAS, the portion of the street to be vacated Lies within the City of Huntington Beach and is not a portion of a state highway; and WHEREAS, the City Clerk of the City of Huntington Beach did cause a copy of said resolution of intention to be published in the Huntington Beach News, a newspaper of general circulation printed and published in the City of Huntington Beach, by one insertion on the 23rd day of February, 1961; and WHEREAS, said resolution contained a notice that the 20th day of March, 1961, at the hour of 8:30 P.M. 1. Res. No. 1474 in the Council Chamber in the City Hall, Huntington Beach, was the time and place when and where a public hearing was to be held upon said resolution of intention, at which hearing all persons interested in or objecting to the proposed vacation may be heard; and WHEREAS, notice of street vacation was posted as required by law; and WHEREAS, there were no protests or persons appearing against said proposed str et vacation at said hearing; and WHEREAS, the City Council of the City of Huntington Beach finds and determines from all the evidence submitted that the portion of Utica Street described in said Resolution No. 1461 is unnecessary for present or prospective public street purposes: NOW THEREFORE, the City Council of the City of Huntington Beach hereby resolves as follows: Section 1. That it is ordered that that portion of Utica Street in the City of Huntington Beach described as: A portion of Lot "A" , Tract No. 260, as per map recorded in Book 13, Page 34, of Miscell— aneous Maps, records of said Orange County; said portion being more particularly described as follows.- The westerly 397.00 feet of the parcel of land dedicated for street purposes to the City of Huntington Beach in a deed dated September 269 1925, and recorded on Page 139 of Book 235, Official Records as found in the office of the County Recorder, Orange County, California, be and the same is hereby vacated for public street purposes 2. Res. No. 1474 Section 2: That the City Clerk is hereby author. ized and directed to cause a certified copy of this Order, attested by the Clerk under the seal of this City, together with a certified copy of Resolution No. 1Li�1, to be recorded in the office of the County Recorder of Orange County, California.
