HomeMy WebLinkAboutCity Council - 1485 RESOLUTION No. 1485 AN ORDER OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH VACATING A PORTION OF HUNTINGTON AVENUE IN THE CITY QF HUNTINGTON BEACH. WHEREAS, the City Council of the City of Huntington Beach, California, did by unanimous vote on the 6th day of March, 1961, at a regular meeting of said body, regularly and duly adopt Resolution No. 1469, entitled, "A RESOLUTION OF INTENTION CF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH TO VACATE A PORTION OF HUNTINGTON AVENUE IN SAID CITY, AND GIVING NOTICE OF A HEARING ON SAID VACATION"; and WHEREAS, the City Council of the City of Huntington Beach did elect to proceed under the provisions of the Street Vacation Act of 1941; and WHEREAS, the portion of the street to be vacated lies within the City of Huntington Beach and is not a portion of a state highway; and WHEREAS, the City Clerk of the City of Huntington Beach did cause a copy of said resolution of intention to be pub- lished in the Huntington Beach News, a newspaper of general circulation printed and published in the City of Huntington Beach, by one insertion on the 9th day of March, 1961; and WHEREAS, said resolution contained a notice that the 3rd 1. Res. No. 1485 day of April, 1961, at the hour of 8:00 o'clock P.M. in the Council Chamber in the City Hall, Huntington Beach, was the time and place when and where a public hearing was to be held upon said resolution of intention, at which hearing all persons interested in or objecting to the proposed vacation may be heard; and WHEREAS, notice of street vacation was posted as required by law; and WHEREAS, there were no protests or persons appearing against said proposed street vacation at said hearing; and WHEREAS, the City Council of the City of Huntington Beach finds and determines from all the evidence submitted that the portion of Huntington Avenue described in said Resolution No. 11+69 is unnecessary for present or prospective public street purposes: NUd THEREFORE, the City Council of the City of Huntington Beach hereby resolves as follows: Section 1. That it is ordered that that portion of Huntington Avenue in the City of Huntington Beach, described as: Parcel l: Beginning at the Northwest (NW) corner of Lot 1, Tract No. 3522, as shown on a map record- ed in Book 134, Page 3, Miscellaneous Maps Records of Orange County, California; said point also being the true point of beginning; thence South 68.00 feet along the East right-of-way line of Huntington 2. Res. No. 1485 Avenue , as laid out on a map of Tract No. 3522, to a point; thence Southeasterly along a curve, concave to the Northeast, through an angle of 900 OOt 00" and having a radius of 20.00 feet, 31.42 feet to a point in the North right of way line of Cleveland Street; thence West, along the Westerly projection of said North line of Cleveland Street, 12.00 feet to a point; thence Northwesterly along a curve con- cave to the Northeast through an angle goo OOt 00" and having a radius of 20.00 feet, 31.42 feet to a point; thence North 68.00 feet to a point; thence East along the North boundary line of Tract No, 3522, 12.00 feet to the true point of beginning. Parcel 2: Beginning at the Southwest (SW) corner of Lot 8, Tract No. 3522 as shown on the map record- ed in Book 134, Page 3 Miscellaneous Maps, Records of Orange County, California; said point also being the true point of beginning; thence North 68.00 feet along the East right of way line of Huntington Aven- ue, as laid out on the map of Tract No. 3522, to a point; thence Northeasterly along a curve, concave to the Southeast through an angle of 900 OOt 00" and hav- ing a radius of 20.00 feet, 31.42 feet to a point in the South right of way line of Cleveland Street; thence West, along the Westerly projection of said South. line of Cleveland Street , 12.00 feet to a point; thence Southwesterly along a curve, concave to the Southeast , through an angle of 900 OOt 00" and having a radius of 20.00 feet, 3142 feet to a point; thence South 410.94 feet to a point; thence Southeasterly along a curve, concave to the Northeast, through an angle of 1400 45t 38" and having a radius of, 30.00 feet, 73.70 feet to a point; thence North 390 110 22" East 1897 feet to a point in the Northwesterly right of way line of Seventeenth Street; thence North- westerly along a curve concave to the Northeast, through an angle of 1400 45' 38" and having a radius of 30.00 feet , 73.70 feet to -a point in the East right of way line of Huntington Avenue , as laid out on a map of Tract No. 3522, to the true point of beginning. be and the same is hereby vacated for public street purposes. Section 2. That the City Clerk is lm reby authorized and directed to cause a certified copy of this Order, attested by the City Clerk under the seal of this city, together with a 3• Res. No. 1485 certified copy of Resolution No. 11+69 to be recorded in the office of the County Recorder of Orange County, California.
