HomeMy WebLinkAboutCity Council - 1487 RESOLUTION NO. 1487 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF I NTINGTON BEACH ORDERING WORK IN WIWkERS;BU`,­,G AVENUE IM01ROVEMENT DISTRICT, ASSESSbENIT DISTRICT NO. 6002 WHEREAS, the City Council of the City of Hunting- ton Beach, California did, on the 20th day of March, 1961 pass and adopt its Resolution of Intention No. 1477 that the streets named in said resolution of intention be im- proved in the manner described in said resolution of intention; and "MERSAS, said resolution of intention was duly and legally published in the time, form and manner as required by law, as shown by the affidavit of publication of said resolution of intention on file in the office of the City Clerk of said City of Huntington Beach; and WHEREAS, after the adoption of said resolution of intention, notices of the passage thereof, headed "Notice of Improvement," were duly and legally posted in the time, form, manner, location and number as required by law, as appears from the affidavit of posting said notices on file in the office of the City Clerk of said City of Huntington Beach; and WHEREAS, after the adoption of said resolution of -1- intention, notices of the adoption thereof were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said resolution of intention, according to the names and addresses of such owners as the same appear on the last equalized assessment roll for real property taxes prior to the day of such mailing, or as known to the City Clerk, which said notices were duly mailed in the time, form and manner as required by law; and WHEREAS, protests or objections in writing or otherwise made by the owners of more than one-half of the area of the property to be assessed for said improvements against the proposed work and improvement, the extent of the district to be assessed, or the grades to which said work is proposed to be done, have not been made or presented up to the hour set for hearing in and by said resolution of intention, and the City Council of said City of Huntington Beach having acquired jurisdiction to order said work and improvement: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach, California in regular session assembled this 17th day of April, 1961 that the -2- public interest and convenience require the improvements herein referred to, and said City Council hereby orders that the work and improvements , as set forth and de- scribed in said Resolution of Intention No. 1477, passed and adopted by said City Council on the 20th day of March, 1961, and in the plans and specifications therein referred to and adopted, be done and made in the manner described in and provided by said resolution of intention and said plans and specifications. BE IT FURTHER RESOLVED that all objections, whether in writing or oral, to the proposed work, the grade to which said work is to be done, or the boundary of the district proposed to be assessed to pay the cost and expenses of said work, be and the same hereby are overruled and denied. BE IT FURTHER RESOLVED that the boundaries of the assessment district and the grades to which said work and improvement are to be constructed shall be those set forth and described in said Resolution of Intention No. 14771 in the plans and specifications therein referred to, and in the plat or map of said assessment district therein referred to, reference to which is hereby made for all further particulars. -3- BE IT FURTHER RESOLVED that the time hereby fixed for receiving said sealed proposals or bids for the doing of said work and making of said improvements herein ordered is Monday, the 1st day of May, 1961 at the hour of 8:56 o'clock P.M. , and the City Clerk of said City of Huntington Beach, California is hereby ordered to give notice inviting such sealed bids or proposals in the time, form and manner provided by law.
