HomeMy WebLinkAboutCity Council - 1495 RESOLUTION No. 1495 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF HUNTINGTON BEACH OF THAT CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED AS "CALLENS-REVISED AN- NEXATION" AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH: 1. That pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939" , a petition signed by owners of not less than one-fourth of the land in the herein- after described territory by area and by assessed value as shown on the last equalized assessment roll of the County of Orange, was filed with the Council of the City of Huntington Beach on May15 , 1961, requesting annexation of the herein- after described territory to said City; that said territory which said petitioners request be annexed to the City of Huntington Beach and which said City and its Council propose to annex to the City of Huntington Beach is situate in the County of Orange, State of California, hereby designated "Callens-Revised Annexation" , and described as follows: Be inning at the Southeast corner of the North half (T of the Southeast quarter (SE-J) of the Southeast quarter (SE-J) of Section 28, Township 5 South, Range 11 West, said corner being a point on the boundary of the City of Huntington Beach as now established and the true point of beginning; thence North, a distance of 1960.00 feet, more or less, along said boundary 1. Res. No. 1495 line of the City of Huntington Beach, said boundary line being the East line of Section 28, Township 5 South, Range 11 West, S.B.B. & M. , to a point on the South line of Slater Avenue 40.00 feet wide, as now laid out; thence West 1320.60 feet, more or less, along the South line of Slater Avenue to an angle point in the boundary line of the City of Huntington Beach, said angle point also being the West line of the East half (EJ-) of the Southeast quarter (SFr of said Section 28• thence South, leaving the boundary of the City of Huntington Beach, 1960.00 feet, more or less, along said West line of the East half (E*' of the Southeast quarter (SE-J) of said Section 28 to the Southwest corner of the North half (N*) of the South- east quarter (SED of the Southeast quarter (SE-J) of said Section 28; thence East 1320.00 feet, more or less, along the South line of the North half (N*) of the Southeast quarter (SEJ) of the Southeast quarter (SE-J) of said Section 28 to the true point of beginning." 2. That the County Boundary Commission of Orange County, California, did in session duly assembled on January 9th9 1961, approve the proposed annexation boundaries of said Callens-Revised Annexation, as above described, and as sub- mitted to said Commission by the proponents of said annexation'; of said territory to said City. 3, That July 3rd, 1961, at the hour of 8:00 o'clock P.M. of said day, in the Council Chambers, in the City Hall in the City of Huntington Beach, County of Orange, Califor- nia is hereby fixed as the time and place when and where any person owning property within the uninhabited territory above described and proposed to be annexed to the City of Hunting- ton Beach and having any ob,ection to the proposed annexation may appear before the Council of the City of Huntington Beach and show cause why such uninhabited territory should not be 2. Res. N0. 1495 so annexed to said City of Huntington Beach. Such protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such prop. erty in general terms. 2+. The City Clerk of the City of Huntington Beach is hereby authorized and directed to cause a copy of this res- olution to be published at least twice, but not oftener than once a week, in the "Huntington Beach News", a newspaper of general circulation published in said City of Huntington Beach, the city to which it is proposed to annex the afore- said territory, and also in the "Westminster Herald", a newspaper of general circulation published outside the City of Huntington Beach, but in the. County of Orange, Califor- nia, the county in which is located the territory proposed to be annexed to the City of Huntington Beach, said publica- tion to be complete at least twenty (20) days prior to the date set for hearing. 5. And the said City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above 3• Res. No. 1495 proceedings were initiated, at the addresses shown on said assessment roll or as known to said Clerk, and to any person who has filed his name and address and the designation of the lands in which he has any interest, either legal or equitable with said Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 6. In the event any land within the territory proposed to be annexed is owned by a county, the said City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such County, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 7. The said City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
