A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF HUNTINGTON BEACH, CALI-
FORNIA, REGULATING AND FIXING THE FEES
FOR THE USE OF THE MEMORIAL HALL IN
SAID CITY AND REPEALING RESOLUTIONS
IN CONFLICT HEREWITH.
The City Council of the City of Huntington Beach,
California, do resolve as follows:
Section 1: RESOLVED, that the Memorial Hall in the City of
Huntington Beach is a public building, erected by and at the cost
of the People of said City, and the ground floor thereof shall at
all times be, subject to the necessary regulations hereinafter
specified, open to the convenient use of the same by the people
of the City of Huntington Beach; and
Section 2: RESOLVED, that the City Council of said City
shall have and retain the control of said Memorial Hall and shall
from time to time prescribe its uses and rules and regulations
governing the same; and
Section 3: RESOLVED that the word "person" when used in

this Resolution shall include firm, copartnership, association,
society or guild, incorporated or unincorporated; and
Section 4: RESOLVED, that the City Clerk of the City of
Huntington Beach shall be the custodian of the keys to and per-
sonal property of said Memorial Hall, and shall receive all appli-
cations and fees and issue all permits for the use of the same and
may, in his discretion and in the interest of the people of the
City of Huntington Beach, subject to the final decision of the

City Council, reject any application for the use of said building
or require any applicant to pay a fee in addition to the regular
charges hereinafter set forth in an amount sufficient to pay for
supplemental police protection deemed necessary to protect the
City's interest; and
Section 5: RESOLVED, that said Memorial Hall may be used
by the people of the City of Huntington Beach for any purpose for
which persons may lawfully assemble together; provided, that in
no way shall said building be used for the regular meeting place
of any person or association except by special permission of the
City Council of the City of Huntington Beach; and
Section 6: RESOLVED, that any person desiring to use Memorial
Hall shall first apply to the City Clerk therefor, upon application
form to be furnished by the City Clerk, at least five days prior
to date when such use is desired; and
Section 7: RESOLVED, that the following charges shall be
made in the use of Memorial Hall where the object of the meeting
is not financial gain:
A. $35.00 for any rental of the Hall, which will include
full use of kitchen privileges .
B. If determined by the City Clerk that the organization
applying to use the hall is one that is concerned with
Huntington Beach community affairs , the fee shall be
$15.00 for any rental of the Hall, which will include
full use of kitchen privileges .
C. $10.00 cash deposit to cover broken, lost or stolen
dishes, silverware, cooking utensils , and other equip-
ment belonging to the City of Huntington Beach, and
improper securing of the building following use thereof,
including lights left burning and doors unlocked, shall
be required of all applicants for said hall, any unused
portion of which shall be returned to the applicant; and

Section 8: RESOLVED, that the words "one that is concerned
with Huntington Beach Community Affairs" as used herein shall be
defined to be persons living within the City of Huntington Beach
and shall include any established club, church, lodge, society,
or association, or corporation that has a regular established
office, meeting place or headquarters within the City of Huntington
Beach, and shall include the Orange County League of Cities, the
Associated Chambers of Commerce of Orange County, the Orange County
Coast Association, and the Orange County Peace Officers Association;
and the words "financial gain" as used in this Resolution shall
mean and shall be construed to mean that said applicant expects
to derive any profits from the use of said Memorial Hall, whether
or not said profits are to be obtained by a charge for admission
or by taking up a collection, and whether or not said profits or
receipts are to be used for charitable, philanthropic, civic,
political or any other purpose; and
Section 9: RESOLVED, that any person, other than those
mentioned in Section 7 hereof, to whom permission may be here-
inafter given by the said City Clerk or the City Council to
use said Hall, shall pay to the City Clerk at the time of
making application, a fee of Thirty-five Dollars ($35. 00)
for each day, or any part thereof, that said person might

wish to use said Hall; and
Section 10: RESOLVED, that any person dissatisfied
with the decision of the City Clerk in rejecting any applica-
tion made to him hereunder, or in demanding an additional fee
for supplemental police protection? may :appeal to the City
Council from such decision, and the decision of the City
Council shall be final and conclusive; and
Section 11: RESOLVED, that the City Clerk shall at all
times keep the Memorial Hall securely locked when not in use,
and shall from time to time inspect the premises and the
personal property thereof, and shall require the city janitor
to report to him promptly any and all damages and loss occas-
ioned by the use of said building and personal property, and
shall promptly notify the person responsible for such damage
or loss to make proper settlement therefor with the City
Clerk; and
Section 12: RESOLVED, that Resolution numbered 989
is hereby repealed.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach, California, at a regular meeting thereof
held on the 1_199t_h day of June 1961.

of the City of Huntington Beach is five; that the foregoing
resolution was passed and adopted by the affirmative vote of
more than a ma3ority of all the members of said City Council
at a regular meeting thereof held on the 19th day of June
1961.
