HomeMy WebLinkAboutCity Council - 1520 RESOLUTION No. 1520 A RESOLUTION OF THE CITY OF HUNTINGTON BEACH URGING COMPLIANCE WITH THE ORDER OF THE PUBLIC UTILITIES COMMISSION OF THE STATE OF CALIFORNIA REQUIRING METERING OF WATER UTILITIES DISTRIBU- TING WATER FOR DOMESTIC OR MUNICIPAL PURPOSES WITHIN THE AREA OF THE ORANGE COUNTY WATER DISTRICT. WHEREAS, the Public Utilities Commission has ordered all nonmetered water distributing utilities within the area of the Orange County Water District to install water meters on all service connections within certain specified times or at cer- tain specified rates of installation; and WHEREAS, a petition seeking an annulment of one of the Commission' s orders to install water meters was filed with the Supreme Court of the State of California; and WHEREAS, the Supreme Court of the State of California in Case No. S.F. 201+79 filed June 22, 1961 ruled, with all seven judges concurring, that the order to install meters was with- in the jurisdiction of the Public Utilities Commission; and WHEREAS, the rapidly increasing population and industrial development in Orange County require that ever-increasing quantities of water be imported for ground water replenishment; and WHEREAS, an analysis of water usage indicates that in many instances water usage per average connection in nonmetered 1. Res. No. 1520 areas is 50% greater than the water usage per average con- nection in metered areas; and WHEREAS, under the presently existing conditions in the area of the Orange County Water District such excess usage of water in nonmetered areas is being subsidized by users of water in metered areas. NOW THEREFORE, the City Council of the City of Hunt- ington Beach hereby resolves that the Public Utilities Commission of the State of California be; urged and request- ed to require immediate and continuing compliance by all water distributing utilities under its jurisdiction with its order to install water meters on all service connections and that all customers on flat rate service be transferred to the metered rate service following the installation of water meters. BE IT FURTHER RESOLVED that copies of this resolution be forwarded to the Public Utilities Commission of the State of California, to the Orange County Water District, to Senator John A. Murdy, Jr. and to Assemblymen Bruce Sumner and Richard T. Hama. PASSED AND ADOPTED by the City Council of the City of Huntington Beach, California, thi42nd day of Octo er 91961.
