HomeMy WebLinkAboutCity Council - 1531 RESOLUTION OF INTENTION NO. 1531 IN THE MATTER OF THE CONSTRUCTION AND INSTALLATION OF A SANITARY SEWER SYSTEM IN ASSESSMENT DISTRICT NO. 6101 IN THE CITY OF HUNTINGTON BEACH, CALIFORNIA. The City Council of the City of Huntington Beach, California, in regular session assembled this 16th day of October, 1961, does hereby resolve and determine as follows: SECTION 1: That the public interest and con- venience require, and that it is the intention of said City Council to order the following work to be done or improve- ments to be made in said City of Huntington Beach, to wit: The construction and installation of a sanitary sewer system, including 8" vitri- fied clay pipe sewer mains, except where specifically otherwise noted, 6" and 4" vitrified clay pipe laterals, standard and drop manholes , 8 vitrified clay pipe manhole stubouts, trenching, backfilling, and trench resurfacing, appurtenances and appurtenant work, as follows: 1. Beginning at an existing manhole in the center line of Warner Avenue at its intersection with Oak Lane; thence Southwesterly in said intersection 18 feet to a man- hole to be constructed, and using 15" vitrified clay pipe; thence Southerly in said intersection and Oak Lane to a manhole to be constructed in Oak Lane 1,297 feet South thereof. 2. From a manhole to be constructed at the inter- section of the center lines of Oak Lane and Sycamore Street; thence Easterly in Sycamore Street to a manhole to be -1- Res . No. 1531 constructed at the intersection of the center lines of Sycamore and Elm Streets; thence continuing from said manhole Southerly in Elm Street 918 feet to a manhole to be constructed. 3. In Beach Boulevard from a manhole to be con- structed 626 feet South of the center line of Cypress Street at its intersection with Beach Boulevard to a manhole to be constructed in Beach Boulevard 931 feet North thereof. 4. In Cypress Street from a manhole to be con- structed in the center line of Cypress Street 51 feet West of its intersection with the center line of Beach Boulevard � to a manhole to be constructed at the intersection of the center lines of Cypress Street and Oak Lane. 5. In Ash Street from a manhole to be constructed at the intersection of the center lines of Ash and Sycamore Streets to a manhole to be constructed in Ash Street 918 feet South thereof. 6. In Varner .avenue frm a manhole to be con- structed in Warner avenue at its intersection with the center line of Ash Street to a manhole to be constructed in Warner Avenue 431.53 feet West thereof. -2- Res. No. 1531 SECTION 2: All of the above mentioned work, in- cluding the grade to which said work shall be done and the location thereof in and upon the streets above mentioned, shall be done upon the grades, along the lines, between the points, of the dimensions, at the places and in the manner described and set forth in the plans , profiles and detailed drawings of said work, and to specifications for said work heretofore adopted by said City Council on October 16 , 1961 by its Resolution No. 1529 ,which plans, profiles, detailed drawings and specifications are on file in the office of the City Clerk of said city, and which are hereby referred to for a more particular description of said work, grade of said work, and location of said work in and along the streets hereinbefore mentioned; and which said plans, profiles, detailed drawings and specifications are hereby incorporated herein and made part hereof by reference as though set forth fully herein. SECTION 3: That said contemplated work and im- provements , in the opinion of said City Council , is of more than local or ordinary public benefit, and that the expenses and cost of said work and improvements shall be chargeable upon a district , which said district said City Council hereby declares to be the district benefited by the work and im- provements herein described and to be assessed to pay the cost and expenses thereof; said district shall include that -3- Res . No. 1531 territory in said City of Huntington Beach which is shown upon that certain plat or map thereof on file in the office of the City Clerk of said city, entitled "ASSESSMENT DISTRICT NO. 6101," and which said map or plat indicates by a boundary line the extent of the territory included in the proposed district and covers all details as to the extent of the area to be assessed; said map or plat is hereby incorporated herein and made a part hereof by refer- ence as though set forth fully herein. SECTION 4: Notice is hereby given that serial bonds shall be issued in the manner and form provided in Part 5 , Division 7 of the Streets and Highways Code of the State of California, the Improvement Act of 1911, to represent unpaid assessments of Fifty Dollars ($50.00) or over, which said bonds shall bear interest at the rate of six (6%) percent per annum and the last installment of which bonds shall mature nine (9) years from the second day of January next succeeding the first day of September following their date. SECTION 5: Notice is hereby given that on Monday, the 6th day of November, 1961, at the hour of 8: 00 o'clock P .M. of said day, in the council chambers in the City Hall of said City of Huntington Beach, the meeting place of said City Council, any and all persons having any objections to the proposed work or improvements, or any -4- Res . No. 1531 objections to the grades to which said work is to be done, or any objections to the boundaries of the district proposed to be assessed to pay the cost and expenses of said work or improvements may appear before said City Council and show cause why said proposed work or improvements should not be carried out in accordance with this resolution of intention, and may present written protests in the form and manner required by law not later than the hour herein- above set for hearing objections against the doing of said work, the grades to which said work is to be done, or the extent of the territory to be assessed to pay the cost and expenses thereof. SECTION 6: The City Clerk of said city shall cause this resolution of intention to be published twice in the HUNTINGTON BEACH NEWS , a newspaper of general circulation, published and circulated in said City of Huntington Beach, which said newspaper has heretofore been designated by said City Council as the newspaper in which shall be printed and published all notices, resolutions, orders and other matters required to be published in the proceedings to be taken pursuant to this resolution and under the provisions of the Improvement Act of 1911, and amendments thereto; the first publi- cation of said notice shall be not less than ten (10) days prior to the date herein fixed for the public -5- Res . No. 1531 hearing fixed by this resolution of intention. SECTION 7: The Superintendent of Streets of said city shall cause to be conspicuously posted along the line of said contemplated work and improvements , and on all the open streets within the assessment district, notice of the passage of this resolution of intention in the time, form and manner required by law. SECTION 8: The City Clerk of said city is hereby directed to mail notices of the adoption of this resolution of intention, postage prepaid, to all persons owning real property proposed to be assessed to pay any part of the cost of said work, whose names and addresses appear on the last equalized assessment roll for real property taxes, or as known to said City Clerk. Said mailing is to be completed at least fifteen (15) days prior to the day herein fixed for the public hearing on this resolution of intention, all in the time, form and manner prescribed in said Improvement Act of 1911, as amended. SECTION 9: The total estimated cost of said work and improvements, including estimated incidental costs , is in the amount of $50,622.20. SECTION 10: NOTICE IS HEREBY FURTHER GIVEN that the grades to which said work is to be done are, or -6- Res . No. 1531 may be in part , new and different from those heretofore established, or may be and in some cases are different from existing ground levels.
