HomeMy WebLinkAboutCity Council - 1620 RESOLUTION No, 1620 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH TO VACATE AN EASEMENT IN SAID CITY, AND GIVING NOTICE OF A HEARING ON SAID PROPOSED VACATION. WHEREAS, the Douglas Aircraft Corporation has purchased some 250 acres in the northwest portion of the City of Hunt- ington Beach and proposes to build thereon an industrial and research plant; and WHEREAS, there is presently an easement for roads, rail- roads and ditches reserved in a deed recorded January 14,1899, over the northerly 20 feet of the southwest quarter of See- tion 9, Township 5 South, Range 11 West, partly in Rancho Las Bolsas and partly in the Rancho La Bolsa Chica, in the City of Huntington Beach involving the above acreage; and WHEREAS, this said easement has never been used for any of the indicated purposes, is unnecessary for present or prospective public roads, railroads, ditches or street pur- poses and should be abandoned to provide for the completb use of the property acquired by the Douglas Aircraft Corpora- tion; and WHEREAS, the City Council desires to vacate the said easement, NOW, THEREFORE, the City Council of the City of Huntington 1. Res. No. 1620 Beach, California, does resolve, determine and declare as follows : Section 1. That the City Council of the City of Hunt- ington Beach does hereby declare its intention to vacate that certain easement reserved for roads, railroads and ditches reserved in a deed recorded January 14, 1899, over the northerly 20 feet of the southwest quarter of Section 9, Township 5 South, Range 11 West, partly in Rancho Las Bolsas and partly in the Rancho La Balsa Chica, in the City of Huntington Beach, and more particularly described as follows : An easement for roads railroads and ditch- es reserved in deed recorded January 14, 1899, in Book 30, page 149 of Deeds, of Orange County, over the northerly 20 feet of the southwest quarter of Section 9, Township 5 South, Range 11 West, partly in the Rancho Las Bolsas and partly in the Rancho La Bolsa Chiea, in the City of Huntington Beach, County of Orange, State of California, as per map recorded in Book 51, page 13 of Miscellaneous Maps, in the office of the County Recorder of said County. For further particulars as to the proposed vacation, refer- enee is hereby made to a map on file in the office of the City Clerk of said City. Section 2, That notice is hereby given that the 23rd day of July, 1962, at the hour of 7:30 o'clock P.M, in the Council Chamber in the City Hall, Huntington Beach, Califor- nia, is the time and place when and where a public hearing shall be held upon said resolution of intention to vacate 2. Res. No. 1620 said above described easement at which hearing all persons interested in or objecting to the proposed vacation may be heard, Section 3, The City Clerk is hereby authorized and directed to cause a copy of this Resolution of Intention to be published in the Huntington Beach News, a newspaper of general circulation, printed and published in the City of Huntington Beach for at least two successive weeks prior to the hearing. Section 4, The City Council of the City of Huntington Beach does hereby elect to proceed under the provisions of Article 5 . Title 5, Division 1, Part 1, Chapter 2, of the Government Code of the State of California, which Article is cited as "Public Service Easements Vacation Law". Section 5. The City Engineer is hereby authorized and directed to post notices of easement vacations as re.. quired by law, PASSED AND ADOPTED by the City Council of the City of Huntington Beach, at a regular meeting thereof held on the 2nd day of � l _ , 1962.
