HomeMy WebLinkAboutCity Council - 1628 RESOLUTION No 1628 AN ORDER OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH VACATING AN EASEMENT IN SAID CITY, WHEREAS, the City Council of the City of Huntington Beach, California, did, by unanimous vote on the 2nd day of July, 1962, at a regular meeting of said body, regularly and duly adopt Resolution No. 162.0, entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH TO VACATE AN EASEMENT IN SAID CITY,AND GIVING NOTICE OF A HEARING ON SAID PROPOSED VACATION" ; and WHEREAS, the City Council of the City of Huntington. Beach did elect to proceed under the provisions of the Public Service Easements Vacation Law; and WHEREAS, the City Clerk of the City of Huntington Beach did cause a copy of said Resolution of Intention to be pub- lished in the Huntington Beach News, a newspaper of general circulation printed and published in the City of Huntington Beach by two insertions on the 5th day of July, 1962 and on the 12th day of July, 1962; and WHEREAS, said resolution contained a notice that the 23rd day of July, 1962, at the hour of` 7 :30 o'clock P.M. , in the Council Chamber in the City Hall, Huntington Beach, California, was the time and place, when and where a public hearing was to be held upon said Resolution of Intenticn , at 1. Res. No. 1628 which hearing all persons interested in or objecting to the proposed vacation could be heard; and WHEREAS, Notice of Vacation of Easement was posted as required by law; NOW THEREFORE, the City Council of the City of Hunt- ington Beach, after hearing the evidence offered by all persons interested in said matter, does hereby find that said easement has never been used for any of the indicated purposes, is unnecessary for present or prospective public roads, railroads, ditches or street purposes and should be abandoned for the complete use of the property acquired by Douglas Aircraft Corporation and that the easement herein described as: An easement for roads, railroads and ditches reserved in deed recorded January 14, 1899, in Book 30, page 149 of Deeds, of Orange County, over the northerly 20 feet of the southwest quar- ter of Section 9, Township 5 South, Range 11 West partly in the Rancho Las Bolsas and partly in the Rancho La Bolsa Chica, in the City of Huntington Beach, County of Orange, State of California, as per map recorded in Book 51, Page 13 of Miscell- aneous Maps, in the office of the County Recorder of said County, be, and the same is hereby vacated. The City Clerk is hereby authorized and directed to cause a certified copy of this Order, attested to by the Clerk, under the seal of this City, to be recorded in the office of the County Recorder of Orange County, California.
