IN -THE CITY OF HUNTINGTON BEACH, CALIFORNIA3, ,VASHINGTON AVENUE-PATTERSON WAY IMPROVEMENT DISTRICT.. The City Council of the City of Huntington Beach, California, in regular session assembled this 15th day of October , 1962, does hereby resolve and determine as follows: SECTION 1: That the public interest and convenience require, and that it is the intention of said City Council to order the following work to be done or improvements to be made in said City of Huntington Beach, to wit: A. The construction and installation of an 8" vitri, Hied clay pipe sewer, together with 4" vitrified clay pipe house laterals , f1.ve linear feet of 15" vitrified clay pipe sewer main, pre-cast manholes , a standard lamphole, and including trenching, backfillin-,, pavement replacement, appurtenances and appurtenant work, in: 1. Warner Avenue from a lamphole to be constructed therein 92 feet West of the inter- section of the centerlines of Warner Avenue and Lyndon Street to a manho,ie 'to be constructed in Warner Avenue 488 feet East of said inter- secting centerlines. 2. In the common intersection of Warner Avenue and Lyndon Street from an existing 15 ' stubout, using 15" vitrified clay pipe sewer. main, for a distance of 5 feet West of said existing stubout to Manhole irl to be constructed in said intersection with a 15" stubout facing West , said manhole to be located 8 feet West and 8 feet North of the intersection of the center- lines of said intersection. Thence North in said intersection and Lyndon Street from said Manhole #1 to a manhole to be constructed Fn Lyndon Street 395 feet North of the intersection of said centerlines . -1- Res. No. 1664 3 . In Washington Avenue from a manhole to be constructed in the common intersection of Lyndon Street and Washington Avenue 12 feet West of the centerline of Lyndon Street to a manhole to be constructed in Washington Avenue 488 feet east of said centerline. B. The construction and installation of an 8" vitri- fied clay pipe, sewer, together with 4" vitrified clay pipe house laterals and pre-cast manholes, and including trenching, back- filling, pavement replacement, appurtenances and appurtenant work, in: 1. Patterson Way from an existing manhole in the common intersection of Patterson Way and Ellis Avenue to a manhole to be constructed with an 8" stubout facing North in Patterson Way 460 feet North of the centerline of Ellis. Avenue. 2. In La Palma Street from a manhole to be constructed.. at the centerline of Patterson Way at its intersection with La Palma Street to a manhole to be constructed- in La Palma Street 288 feet East of said centerline. SECTION 2: All of the above mentioned work, including the grade to which said work shall be done and the location thereof in and upon the streets above mentioned, shall be done upon the grades , along the lines, between the points, of the dimensions , at the places and in the manner described and set forth in the plans, profiles and detailed drawings of said work, and to speci- fications for said work heretofore adopted by said City Council on October 15 , 1962 by its Resolution No. 166a , which plans, profiles, detailed drawings and specifications are on file in the office of the City Clerk of said city, and which are hereby referred to for a more particular description of said work, grade of said work, and location of said work in and along -2- Res. No. 1664 the streets hereinbefore mentioned; and which said plans, profiles , detailed drawings and specificatr�ons are hereby incorporated herein and made part hereof by reference as though set forth fully herein. SECTION 3: That said contemplated work and improve- ments , in the opinion of said City Council, is of more than local or ordinary public benefit, and that the expenses and cost of said wor'a.-, and improvements shall be chargeable upon a district, which said district said City Council hereby declares to be the district benefited by the work and improve- ments herein described and to be assessed to pay the cost and expenses thereof; said district shall include that territory in said City of Huntington Beach which is shown upon that certain plat or map thereof on file in the office of the City Clerk of said city, ent.ltled 'ASSESSMENT DISTRICT NO. 6201 ," and which said map or plat -indicates by a boundary line the extent of the territory included in the proposed district and covers all details as to the extent of the area to be assessed; said map or plat is hereby incorporated herein and made a part hereof by reference as though sErt forth fully herein. SECTION 4: Notice is hereby given that serial bonds shall be issued in the manner and form provided in Part 5 , Division 7 of the Streets and Highways Code of the State of California, the Improvement Act of 1911 , to represent unpaid assessments of Fifty Dollars ($50.00) or over , which said bonds shall bear interest at the rate of six (6%) percent per annum and the last installment of which bonds shall -3- Res. No. 1664 mature nine (9) years from the second day of January next succeeding the first day of September following their date. SECTION 5: Notice is hereby given that on Monday, the 5th day of November, 1962, at the hour of 8: 00 o' clock P .M. of said day, in the council chambers in the City Hall in said City of Huntington Beach, the meeting place of said City Council, any and all persons having any objections to the proposed work or improvements , or any objections to the grades to which said work is to be done, or any objections to the boundaries of the district proposed to be assessed to pay the cost and expenses of said work or improvements may appear before said City Council and show cause why said proposed work or improvements should not be carried out in accordance with this resolution of intention, and may present written protests ,n the form and manner required by law not later than the hour hereinabove set for hearing objections against the doing of said work, the grades to which said work, is to be done, or the extent of the territory to be assessed to pay the cost and expenses thereof. SECTION 6: The City Clerk of said city shall cause this resolution of intention to be published twice in the HUNTINGTON BEACH NLNTS , a newspaper of general circulation, published and circulated in said City of Huntington Beach, which said newspaper has heretofore been designated by said City Council as the newspaper in which shall be printed and published all notices, resolutions, orders and other matters -4- Res. No. 1664 required to be published in the proceed-�ngs to be taken pursuant to this resolution and under the provisions of the Improvement Act of 1911 , and amendments thereto; the first publication of said not+_ce shall be not less than ten (10) days prior to the date here-n fixed for the public hearing fixed by this resolution of intention. SECTION 7: The Superintendent of Streets of said city shall cause to be conspicuously posted along the line of said contemplated work and improvements , and on all the open streets within the assessment district , notice of the passage of this resolution of intention in the time, form and manner required by law. SECTION 8: The City Clerk of said city is hereby directed to mail notices of the adoption of this resolution of intention, postage prepaid, to all persons owning real property proposed to be assessed to pay any part of the cost of said work, whose names and addresses appear on the last equalized assessment roll for real property taxes , or as known to said City Clerk. Said mailing is to be completed at least fifteen (15) days prior to the day herein fixed for the public hearing on this resolution of intention, all in the time, form and manner prescribed in said Improvement Act or 1911 , as amended. SECTION 9: The total estimated cost of said work and improvements , including estimated incidental costs , is in the amount of $25 ,448.41. -5- Res. No. 1664 SECTION la: NOTICE IS HEREBY FURTHER GIVEN that the grades to which said work is to be done are, or may be in part, new and different from those heretofore established, or may be and in some cases are different from existin- ground levels.
