HomeMy WebLinkAboutCity Council - 1684 RESOLUTION No. 1684 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, REGULATING AND FIXING THE FEES FOR THE USE OF THE RECREATION HALL 1N LAKE PARK IN SAID CITY OF HUNTINGTON BEACH, AND REPEALING RESOLUTIONS IN CONFLICT THEREWITH. The City Council of the City of Huntington Beach, California, do resolve as follows: I Section 1. That the Recreation Hall in Lake Park in the City of Huntington Beach is a public building, erected by and at the cos `-, of the people of said City, and the said Recreation Hall shall at all times be, subject to the nee essary regulations hereinafter specified, open to the con- venient use of the people of the City of Huntington Beach. Section 2. That the City Council of said City shall have and retain the control of said Recreation Hall, and shall from time to time prescribe its uses, and rules and regulations governing the same. Section 3. That the word "person" when used in this resolution shall include firm, copartnership, association, society, or guild, incorporated or unincorporated. Section 4. That the City Clerk of the City of Hunt- ington Beach shall be the custodian of the keys to and personal property of said Recreation Hall, anal shall receive all applications and fees and issue all permits, for the use 1. Ord. No. 1684 of said Recreation Hall and may, in his discretion and in the interests of the people of the City of Huntington Beach, subject to the final decision of the City Council, reject any application for the use of said building. Section 5. That said Recreation Hall may be used by the people of the City of Huntington Beach for any purpose for which persons may lawfully assemble together; provided however, that in no wise shall said building be used for the regular meeting place of any person or association except by special permission of the City Council of the City of Huntington Beach, and provided further, that said building shall not be used, and no permit shall be issued for any function which includes dancing on Sunday. Section 6. That any person desiring to use said Recre- ation Hall shall first apply to the City Clerk for a permit therefor, upon application forms to be furnished by the City Clerk, and agree to indemnify the City on account of any loss or damage occasioned by the use thereof. Section 7. That the following charges shall be made for the use of said Recreation Hall where the object of the meeting is not financial gain: A. LOCAL USERS: 1. � 4.00, where no meals or lunches or refreshments are served, and the kitchen is not included in said permit. 2. Ord. No. 1684 2. $6.00, with the full use of kitchen privileges. B. OUT OF TOWN USERS: 1. $8.00, where no meals or lunches are served, and the kitchen is not included in said permit: 2. $12.00, with the full use of kitchen privileges. C. DEPOSIT: 10.00 cash deposit to cover broken, lost or stolen dishes, silverware, cooking utensils and other equipment belonging to the City of Huntington Beach, shall be requir- ed of all applicants for said Recreation Hall with kitchen privileges, any unused portion of which shall be returned to the applicant. Section 8. That the words "local users" as used here- in shall be defin6d to be persons living within the City of Huntington Beach and shall include any established club, church, lodge, society or association, or corporation that has a regular established office, meeting place or headquar- ters within the City of Huntington Beach, and shall include the Orange County League of Cities, the Associated Chambers of Commerce of Orange County, the Orange County Coast Assoc- iation, and the Orange County Peace Officers Association, and the words "financial gain" as used in this Resolution shall moan and shall be construed to mean that said applicant expects to derive any profits from the use of said Recreation Hall, whether or not said profits are to be obtained by a Ord. No. 1684 charge for admission or by taking up a collection and whether or not said profits or receipts are to be used for charitable, philanthropic, civic, political or any other purpose. Section 9. That any person, other than those mentioned In Section 7 hereof, to whom permission may be hereinafter given by the said City Clerk or the City Council to use said Recreation Hall, shall pay to the City Clerk at the time of making application, a fee of Fifteen ($15-00) Dollars for each day, or any part thereof, that said person might wish to use said Recreation Hall. Section 10. That any person dissatisfied with the de- cision of the City Clerk in rejecting any application made to him hereunder may appeal to the City Council from such de- cision, and the decision of the City Council shall be final and conclusive. Section 11. That the City Clerk shall at all times keep the Recreation. Hall securely locked when not in use, and shall from time to time inspect the premises and personal property thereof, and shall require the city janitor to re- port to him promptly any and all damages and loss occasioned by the use of said building and personal property, and shall promptly notify the person responsible for such damage or loss to make proper settlement therefor with the. City Clerk. Section 12. Resolution No. 990 is hereby repealed. 4. Ord.
