HomeMy WebLinkAboutCity Council - 1711 RESOLUTION No. 1711 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH TERMINATING ANY RIGHTS HELD BY VIRTUE OF CITY ORDINANCE No. 835 AND DECLARING SAID ORDINANCE TO BE NULL AND VOID. WHEREAS, City Ordinance No. 835 was adopted by the City of Huntington Beach on May lst, 1961, granting to the California Gas Transmission Company a franchise to construct, maintain, operate, renew, repair, change the size of and re- move or abandon in place a pipe line, necessary or convenient for the grantee's business in, under, over, along, or across certain public ways in the City of Huntington Beach; and WHEREAS, under the terms of said Ordinance the franchise "shall become null and void in the event the California Public Utilities Commission shall deny the pending application of the California Gas Transmission Company under date of December 5: 1960, being application No. 42931 for a Certificate of Public Convenience and Necessity;" and WHEREAS, the application for a Certificate of Public Convenience and Necessity has been denied the California Gas Transmission Company; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Huntington Beach that City Ordinance No. 835 is declar- ed to be null and void and all rights granted under said ordi- nance are terminated.
