HomeMy WebLinkAboutCity Council - 1726 RESOLUTION No. 1726 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH OPPOSING ASSEMBLY BILL No. 28. WHEREAS, Assembly Bill No. 28 would be a legislative mandate compelling local agencies to enter into a contract not deemed by them to be mutually beneficial but designed for the primary benefit of only one party, to wit, the San Bernar- dino Valley Municipal Water District; and WHEREAS, such attempted legislative mandate would be an unwarranted invasion into home rule; and WHEREAS, the San Bernardino Valley Municipal Water Dis. trict has an adequate and proper method of relieving its water situation by joining the Metropolitan Water District;and WHEREAS, the voters of the San Bernardino Valley Munici- pal Water District have elected not to join the Metropolitan Water District and relieve their water situation, such action is a mandate of the people to accept the reduction in available water; and WHEREAS, Assembly Bill No. 28 would in effect provide the facilities of the Metropolitan Water District to the use of the San Bernardino Valley Municipal Water District without their joining and participating in the Metropolitan Water Dis- trice in violation of the terms of the Metropolitan Water Dis- 1. No. 1726 trice Act and as such would operate as an unfair and unjust enrichment to the San Bernardino Valley Municipal Water Dis- trict, a non-member of the Metropolitan Water District, to the detriment of all members of the Metropolitan Water Dis- trict. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Huntington Beach does hereby express its unequiv- ocal opposition to Assembly Bill No. 28 and does respectfully request that the California legislature vote solidly in opposit- ion to this measure or any modification thereof. BE IT FURTHER RESOLVED that all Cities in Orange County and all members of the Metropolitan Water District be sent copies of this resolution and that they be urged to voice their opposition to this Assembly Bill, AND BE IT FURTHER RESOLVED that copies of this resolution be sent to the Honorable John A. Murdy, Jr. , State Senator and to the Honorable William E. Dannemeyer, the Honorable James E. Whetmore, and the Honorable Hobert E. Badham, State Assembly men from Orange County.
