HomeMy WebLinkAboutCity Council - 1741 RESOLUTION No. 1741 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH GIVING NOTICE OF PROPOSED ANNEXATION TO THE CITY OF HUNTINGTON BEACH OF THAT CERTAIN UNINHAB- ITED TERRITORY DESCRIBED HEREIN AND DESIG- NATED AS "NEWLAND NO. 2 ANNEXATION" , AND GIVING NOTICE OF TIME AND PLACE FOR HEAR- ING OF PROTESTS THERETO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH: 1. That pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939", a petition was signed by owners of not less than one-fourth of the land in the here- inafter described territory by area and by assessed value as shown on the last equalized assessment roll of the County of Orange, was filed with the Council of the City of Huntington Beach on March 18w , 1963, requesting annexation of the here- inafter described territory to said City; that said territory which said petitioners request be annexed to the City of Huntington Beach and which said City and its Council propose to annex to the City of Huntington Beach is situate in the County of Orange, State of California, hereby designated "Newland No. 2 Annexation", and described as follows: 1. Res. No. 1741 Beginning at an angle point in the existing boundary of the City of Huntington Beach, as established by Ordinance No. 697 adopted by the City Council of said City of Huntington Beach, July 1st, 1957, and certified by the Secretary of the State of California on August 2, 19579 said angle point being the intersection of the easterly prolongation of the southerly line of the north half of the southwest quarter of Sec- tion 25, ownship 5 South, Range 11 West, San Bernardino Meridian, with the easterly line of the present Newland Avenue (40 feet wide) ; thence leaving said existing boundary, S 00 12' 09" E. along; said easterly boundary of Newland Avenue, which is also the existing boundary of the City of Fountain Valley, incorporated June 13, 1957, 656.08 feet to the easterly prolongation of the south line of the northeast quarter of the south- east quarter of the southwest quarter of Section 25, Township 5 South, Range 11 West, San Bernar- dino Meridian; thence leaving said existing boundary of the City of Fountain Valley, incorplr- ated. June 13, 1957, N 890 54, 02" W, along said south line, 679.60 feet to existing boundary of the city of Huntington Beach as established by said Ordinance No. 667; thence N 00 11' 43" W, following said existing city boundary, 655.02 feet, to an existing angle point in said city boundary; thence S 890 59' 34" E. following said existing city boundary, 679.51 feet, to the point of beginning. Section 2. That the County Boundary Commission of Orange County, California, did in session duly assembled on March llth, 1963, approve the proposed annexation boundaries of said "Newland No. 2 Annexation", as above described, and as submitted to said Commission by the proponents of said an- nexation of said territory to said City. Section 3. That May 6th, 1963, at the hour of 8:00 o'clock P.M. of said day, in the Council Chambers, in the 2. Res. No. 1741 City Hall in the City of Huntington Beach, County of Orange, California, is hereby fixed as the time and place when and where any person owning property within the uninhabited territory above described and proposed to be annexed to the City of Huntington Beach and having any objection to the proposed annexation may appear before the Council of the City of Huntington Beach and show cause why such uninhabited terr- itory should not be so annexed to said City of Huntington Beach. Such protest must be in writing, may be filed at any time before the hour set for hearing objections to the pro- posed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property in general terms. Section 4, The City Clerk of the City of Huntington Beach is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not often- er than once a week, in the "Huntington Beach News" , a news- raper of general circulation published in said City of Hunt- ington Beach, the city to which it is proposed to annex the aforesaid territory, and also in the "Westminster Herald" a newspaper of general circulation published outside the City of Huntington Beach, but in the County of Orange, California, the county in which is located the territory proposed to be annexed to the City of Huntington Beach, said publication to be complete at least twenty (20) days prior to the date set for hearing. 3• Res. No. 1741 Section 5. And the said City Clerk is further author- ized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the , last equalized county assessment roll available on the date the above proceedings were initiated, at the addresses shown on said assessment roll or as known to said Clerk, and to any person who has filed his name and address and the desig- nation of the lands in which he has any interest; either legal or equitable with said Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. Section 6. In the event any land within the territory proposed to be annexed is owned by a county, the said City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such County, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexa- tion. Section 7. The said City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto in the manner required by law. 4. Res.
