HomeMy WebLinkAboutCity Council - 1767 RESOLUTION No. 1767 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH GIVING NOTICE OF PROPOSED ANNEXATION TO THE CITY OF HUNT- INGTON BEACH OF THAT CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED AS "SUNSET HEIGHTS No. 2 ANNEXATION", AND GIVING NOTICE OF TIME AND PLACE FOR HEAR- ING OF PROTESTS THERETO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH: 1. That pursuant to the provisions of the "Annexa- tion of Uninhabited Territory Act of 1939, " a petition was signed by owners of not less than one-fourth of the land in the hereinafter described territory by area and by assessed value as shown on the last equalized assessment roll of the County of Orange, was filed with the Council of the City of Huntington Beach on May 6th, 1963, requesting annexation of the f hereinafter described territory to said City; that said terr- itory which said petitioners request be annexed to the City of Huntington Beach and which said City and its Council propose to annex to the City of Huntington Beach is situate in the County of Orange, State of California, hereby designated "Sun- set Heights No. 2 Annexation", and described as follows: Beginning at an angle point in the existing bound- ary of the City of Huntington Beach, as established by Ordinance No. 667 adopted by the City Council of said City of Huntington Beach July 1, 1957, and certified by the Secretary of the State of California on August 2, 1957, said angle point being the intersection of the westerly line of Graham Street, Forty Feet (4o, ) wide, 1. Res. No. 1767 as now laid out; with the line twenty feet (201 ) south of the center line of Heil Avenue, previously called Gerhart Avenue; thence S 00 46' 44" E,follow- ing said existing boundary of the City of Huntington Beach as established by said Ordinance No. 667, 948.74 feet; thence leaving said existing boundary S 89 40' 44" W, 642.10 feet; thence N 00 9' 00" W, 940.64 feet to the existing boundary of the City of Huntington Beach as established by said Ordinance No. 667, which is also 20 feet south of the center line of Heil Avenue, previously called Gerhart Avenue; thence N 890 41, 00" E. following said existing city boundary, which is also twenty feet (201 ) south of the center line of Heil Avenue, previously called Gerhart Avenue, 642.72 feet to the point of beginning. 2. That the County Boundary Commission of Orange County, California, did in session duly assembled on April 22nd, 1963, approve the proposed annexation boundaries of said "Sunset Heights No. 2 Annexation". as above described, and as submitted to said Commission by the proponents of said annexation of said territory to said City. 3, That June 17th, 19639 at the hour of 8:00 o'clock P.M. of said day, in the Council Chambers, in the City Hall, in the City of Huntington Beach, County of Orange, California, is hereby fixed as the time and place when and where any person owning property within the uninhabited territory above describ- ed and proposed to be annexed to the City of Huntington Beach and having any objection to the proposed annexation may appear before the Council of the City of Huntington Beach and show cause why such uninhabited territory should not be so annexed to said City of Huntington Beach. Such protest must be in writing, may be filed at any time before the hour set for hear.. 2. Res. No. 1767 ing ob3ections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property in general terms. 4. The City Clerk of the City of Huntington Beach is hereby authorized and directed to cause a copy of this resolu. tion to be published at least twice, but not oftener than once a week, in the "Huntington Beach Newsl , a newspaper of general circulation published in said City of Huntington Beach the city to which it is proposed to annex the aforesaid terr- itory, and also in the "Westminster Herald", a newspaper of general circulation published outside the City of Huntington Beach, but in. the County of Orange, California, the County in which is located the territory proposed to be annexed to the City of Huntington Beach, said publication to be complete at least twenty (20) days prior to the date set for hearing. 5. And the said City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above proceed- ings were initiated, at the addresses shown on said assessment roll or as known to said Clerk, and to any person who has fil- ed his name and address and the designation of the lands in which he has any interest; either legal or equitable with said Clerk, such notice to be given not less than twenty (20) days Res. No. 1767 prior to the date set for hearing. 6. In the event any land within the territory pro- posed to be annexed is owned by a county, the said City Clerk is directed to cause written notice of such proposed annex- ation to be mailed to the Board of Supervisors of such County, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 7. The said City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto in the manner required by law.
