A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH,CALIFORNIA, REGULATING
AND FIXING THE FEES FOR THE USE OF MEMORIAL
HALL AND LAKE PARK CLUBHOUSE IN SAID CITY AND
REPEALING RESOLUTIONS IN CONFLICT THEREWITH.
The City Council of the City of Huntington Beach, Calif-
ornia, does hereby resolve as follows :
Section 1. That Memorial Hall and the Lake Park Club-
house in the City of Huntington Beach are public buildings,
erected by and at the cost of the people of said city; and
that the said Lake Park Clubhouse and the ground floor of
Memorial Hall shall at all times be, subject to the necessary
regulations hereinafter specified, ol5en to the convenient use
of the same by the people of the City of Huntington Beach.
Section 2. That the City Council of said City shall
have and retain the control of said Memorial Hall and Lake
Park Clubhouse, and shall from time to time prescribe its
uses, and rules and regulations governing the same.
Section 3, That the word "person" when used in this
Resolution shall include firm, copartnership, association,
society or guild, incorporated or unincorporated, as well as
an individual or group of individuals .
Section 4. That the City Clerk of the City of Huntington
Beach shall be the custodian of the keys to and the personal
property of said Memorial Hall and Lake Park Clubhouse, shall

receive all applications and fees, and issue all permits
for the use of the same; and, at his discretion and in the
interest of the people of the City of Huntington Beach, sub-
ject to the final decision of the City Council, reject any
application for the use of said buildings , or require any
applicant to pay a fee in addition to the regular charges
hereinafter set forth in an amount sufficient to pay for sup-
plemental police protection deemed necessary to protect the
City 's interest.
Section 5. That said Memorial Hall and Lake Park Club-
house may be used by the- people of the City of Huntington
Beach for any purpose for which persons may lawfully assemble
together; provided however, that in no wise shall any build-
-Ings be used for the regular meeting place of any person or
.association except by special permission of the City Council
of the City of Huntington Beach.
Section 6, That any person desiring to use Memorial
Hall or Lake Park Clubhouse sha11 first apply to the City
Clerk for a permit therefor, upon application forms to be fur-
nished by the City Clerk, at least five (5) days prior to the
date when such use is desired.
Section 7, That any person who has been granted per-
mission to use Memorial Hall or Lake Park Clubhouse agrees to
indemnify the City of Huntington Beach for any loss or damages

occasioned by the use thereof, upon receipt of notification
from the City Clerk of the amount of such loss or damages
incurred.
Section 8, That the following charges shall be made for
the use of memorial Hall where the object of such rental is
not for profit or financial gain:
A $35.00 for any rental of the Hall which will include
full use of kitchen privileges .
B. If determined by the City Clerk that the person or
organization applying for use of the Hall is one
that is concerned with Huntington Beach Community
affairs, the fee shall be $15 .00 for any rental of
the Hall which shall include full use of kitchen
privileges.
C. The City Council of the City of Huntington Beach
May, at its discretion, direct the City Clerk to
waive any Fees for the use of said Memorial Hall
upon receipt of a petition or letter requesting
same.
Section 9. That the following charges shall be made for
the use of Lake Park Clubhouse where the object of such rent-
al is not for profit or financial gain.
A. $10.00 for any rental of the Clubhouse where no
use of the kitchen facilities is made, and the kitchen
is not included in said permit.

B. 15 .00 for any rental of the Clubhouse .where full
use of kitchen facilities is requested.
C. If determined by the City Clerk that the person or
organization applying for use of the Clubhouse is
one that is concerned with Huntington Beach Commun-
ity affairs, the fee shall be as follows :
1. $4.00 for any rental of the Clubhouse where
no use of the kitchen facilities is made, and
the kitchen is not included in said permit.
2. $6.00 for any rental of the Clubhouse where
full use of kitchen facilities is requested.
D. The City Council of the City of Huntington Beach
may, at its discretion, direct the City Clerk to
waive any fees for the use of said Lake Park
Clubhouse upon receipt of a petition or letter re-
questing same.
Section 10. That the words "one that is concerned with
Huntington Beach Community affairs' as used herein, shall be
defined to be persons living within the City of Huntington
Beach, and shall include any established club, church, lodge
society, association, or corporation that has a regular es-
tablished office, meeting place, or headquarters within the
City of Huntington Beach, and shall include the Orange County
League of Cities, the Associated Chambers of Commerce of
Orange County, the Orange County Coast Association and the
Orange County Peace Officers Association; and the words,

"Profit or financial gain" as used in this Resolution shall
mean and shall be construed to mean that said applicant
expects to derive any profits from the use of said Memorial
Hall and Lake Park Clubhouse, whether or not said profits
are to be obtained by a charge for admission or by the taking
up of a collection, and whether or not said profits or re-
ceipts are to be used for charitable, philanthropic, civic,
political or any other purpose.
Section 11. That the charges to be made in the use of
Memorial Hall or Lake Park Clubhouse, where the object of
such use is for financial gain, shall be set by the City
Council of the City of Huntington. Beach in each individual
instance, at the time of approval of the application for such
use.
Section 12. That any person to whom permission may be
hereinafter given by the said City Council or the City Clerk
to use said Memorial Nall or Lake Park Clubhouse, shall pay
to the City Clerk at the time of making application, the fees
specified in Sections 8 or 9 of this resolution for each day,
or any part thereof, that said person may wish to use said
hall or clubhouse.
Section 13. That any person dissatisfied with the decis-
ion of the City Clerk in rejecting any application made to
him hereunder, or in demanding an additional fee for supplement-

al police protection may appeal to the City Council from
such decision, and the decision of the City Council shall
be final and conclusive.
Section 14. That the City Clerk shall at all times see
that arrangements have been made to have Memorial Hall and
Lake Park Clubhouse securely locked when not in use, and shall
from time to time inspect the premises and the persona proper-
ty thereof, and shall require the janitors to report to him
promptly any and all damages and/or loss occasioned by the use
of said buildings and personal property, and shall promptly
notify the person or persons responsible for such damage and.
loss to make proper settlement therefor, with the City Clerk,
Section 15. That Resolutions No. 1498 and No. 1684 are
hereby repealed.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach, California, at a regular meeting thereof
held on the 20th day of May 1963-
