HomeMy WebLinkAboutCity Council - 1862 RESOLUTION 1862 AN ORDER OF'THE CITY COUNCIL VACATING 4 A PORTION OF YORKTOWN AVENUE IN THE CITY OF HUNTINGTON BEACH WHEREAS, the City Council of the City of Huntington Beach, California, did by unanimous vote on the 3rd day of September, 1963, at a regular meeting of said body, regu- larly and duly adopt Resolution No. 1846, entitled,"A' gesolu- tion of Intention of the City Council of the City of Hunting- ton Beach to vacate a portion of Yorktown Avenue in said City and giving notice of hearing on said Vacation"; and WHEREAS, the City Council of the City of Huntington Beach did elect to proceed under the provisions of the Street Vacation Act of 1941; and WHEREAS, the portion of the street to be vacated lies within the City of Huntington Beach and is not a portion of a state highway; and WHEREAS, the City Clerk of the City of Huntington Beach did cause a copy of said resolution of intention to be published in the Huntington Beach News, a newspaper of gener- al circulation, printed and published in the City of Hunting- ton Beach, by one insertion on the Sth day of September,1963; and 1. Ito. 1862 WHEREAS, said resolution contained a notice that the 7th day of Odtober, 1963, at the hour of 8 :00 o'clock P.M. in the Council Chamber in the City Hall, Huntington Beach, was the time and place when and where a public hearing was to be held upon said resolution of intention, at which hear- ing all persons interested in or objecting to the proposed vacation may be heard; and WHEREAS, notice of street vacation was posted as re- quired by law; and WHEREAS, there were no protests or, persons appearing against said proposed street vacation at said hearing; and WHEREAS, the City Council of the City of Huntington Beach finds and determines from all the evidence in said Resolution No. 1846 is unnecessary for present or prospective public street purposes: NOW, THEREFORE, the City Council of the City of Hunt- ington Beach hereby resolves as follows: Section 1. That it is ordered that that portion of Yorktown Avenue in the City of Huntington Beach, described as: A strip of land, 40 feet in width,lying 20 feet on either side of the East-West one quarter (EW4) section line of Section 5, Township 6 South, Range 10 West, San Bernardino Base &Meridian be- ing bounded on the west by the North-South one- quarter (N-S-) section line of above mentioned Section 5, and being bounded on the East by the west line of the Santa Ana River. 2. Ord. No. 1862 be and the same is hereby vacated for public street purposes. Section 2. That the City Clerk is hereby authorized and directed to cause a certified copy of this Order, attest- ed by the Clerk under the seal of this city, together with a certified copy of Resolution No. 1846 to be recorded in the office of the County Recorder of Orange County, California.
