HomeMy WebLinkAboutCity Council - 1894 RESOLUTION No. 1894 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH GIVING NOTICE OF PROPOSED ANNEXATION TO THE CITY OF HUNTINGTON BEACH OF THAT CERTAIN UNIN- HABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED AS "BOLSA CHICA #3 ANNEXA- TION AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH: Section 1. That pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939," a petit- ion was signed by owners of not less than one-fourth of the land in the hereinafter described territory by area and by assessed value as shown on the last equalized assessment roll of the County of Orange, was filed with the Council of the City of Huntington Beach on November 16, 1963, requesting an- nexation of the hereinafter described territory to said City that said territory which said petitioners request be annexed to the City of Huntington Beach and which said City and its Council propose to annex to the City of Huntington Beach is situate in the County of Orange, State of California, hereby designated, "BOLSA CHICA #3 ANNEXATION" is described as follows: 1. Res. No. 1894 Beginning at a point on the Southerly line of Heil Avenue (formerly Gerhart Avenue) 40.00 feet wide, said point being South 06 40' 00"East 20.00 feet and South 890 39' 30"West 1295.12 feet more or less from the Northeasterly corner of the South- east one quarter of Section 20, Township 5 South, Range 11 West in the Rancho La Bolsa Chica as shown on a map recorded in Book 51, page 13 of Miscellane- ous Maps, records of Orange County, California; said point being also South 00 40' 00" East 20.00 feet and North 890 39' 30" East 1345.12 feet more or less from the Northwesterly corner of the Southeast one quarter of said Section 20; said point being also the intersection of the Northerly prolongation of the Easterly line of that certain private road (now known as Lynn Street) 50.00 feet wide lying between Blocks 10, 11, 14 and 15 of Tract No. 86, as shown on a map recorded in Book 10, pages 35 and 36 of Miscellaneous Maps, records of Orange County, California; with the Southerly line of the land described in Bolsa Chica No. 2 annexation to the City of Huntington Beach, certified by the Secretary of State on July 25, 1963 by Ordinance No. 982; thence South 00 40 ' 00" East along said Northerly prolongation of the Easterly line of said private road and the Easterly line of said private road 1325.66 feet more or less to the North- westerly corner of Lot 1 of Block 15 of said Tract No. 86, said point being also on the Southerly line of that Res. No. 1894 certain private road (now known as Pearce Street) 50.00 feet wide lying between Blocks 9, 10, 11, 13, 14 and 15 of said Tract No. 86; thence South 890 39' 30" West along the Southerly line of said private road 355.03 feet more or less to the Northwesterly corner of Lot 2 of Block 14 of said Tract No. 86, said point being also on the Easter- ly line of that certain private road (now known as Blanton Street) 25.00 feet wide, lying Easterly 25.00 feet measured at right angles from the Easterly line of Block E of Tract No. 349, as shown on a map recorded in Book 15, page 17 of Miscellaneous Maps , records of Orange County, California; thence South 00 40' 00" East along the Easter- ly line of said private road 635.33 feet more or less to the Northeasterly corner of Lot 3 of Block 14 of said Tract No. 86; thence South 890 39' 30" West along the Northerly line of said Lot 3 of Block 14 and its Wester- ly prolongation 355.03 feet more or less to the North- easterly corner of Lot 4 of Block 13 of said Tract No. 86, said point also being on the Westerly line of that certain private road (now known as Sims Street) 50.00 feet wide, lying between Blocks 13 and 14 of said Tract No. 86; thence North 00 40' 00" West along the Westerly line of said private road 635.33 feet more or less to the Northeasterly corner of Lot 2 of Block 13 of said Tract No. 86, said point being on the Southerly line of the above mentioned private road (now known as Res. No. 1894 Pearce Street) 50-00 feet wide, as shown on said Tract No. 86; thence South 890 39' 30" West along the Souther- ly line of said private road 615-06 feet more or less to its intersection with the Westerly line of the land described in "Sunset Harbor Annexation" to the City of Huntington Beach, certified by the Secretary of State on November 9, 1960 by Ordinance No. 800; thence North feet 00 40' 00" West 1345.66/more or less along said bound- ary to an angle point; thence continuing along said boundary South 890 39' 30" West 1341.38 feet more or less to an angle point in said boundary; thence con- tinuing along said boundary North 00 40' 00" West 660.07 feet more or less to its intersection with the Southerly boundary line of the land described in the "West Annexation" to the City of Huntington Beach, certified by the Secretary of State October- 26, 1959 by Ordinance No. 732; thence North 890 321 10" East along the Southerly line of said annexation 1990.62 feet more or less to the Northwesterly corner of the land described in the Bolsa Chica No. 2 annexation to the City of Huntington Beach, certified by the Secretary of State on July 25, 1963 by Ordinance No. 982; thence along the Westerly and Southerly lines of said annex- ation the following courses , to the point of beginning South 00 46' 50" East 130-00 feet more or less; North 890 -72' 15" East 20.00 feet more or less; South Res. no. 1894 00 46' 50" East 130.00 feet more or less; South 890 32' 15" West, 87.35 feet more or less; South 00 46' 50" East, 130.00 feet more or less; North 890 32' 15" East, 87.35 feet more or less; South 00 46' 50" East , 270.19 feet more or less to the Southwesterly corner of said Bolsa Chica No. 2 Annexation; thence North 890 39' 30" East, 655.00 feet more or less along the Southerly line of said Bolsa Chica No. 2 Annexation and the Southerly line of said Heil Avenue to the point of beginning. Pies. No. 1894 Section 2. That the County Boundary Commission of Orange County, California, did in session duly assembled on November 12, 1963, approve the proposed annexation of bound- aries of said "Bolse Chica #3 Annexation" as above described, and as submitted to said Commission by the proponents of said annexation of said territory to said city. Section 3, That February 3rd, 1964, at the hour of 8 :00 o'clock P.M. of said day, in the Council Chambers in the City Hall in the City of Huntington Beach, County of Orange, California, is hereby fixed as the time and place when and where any person owning property within the uninhabit- ed territory above described and proposed to be annexed to the City of Huntington Beach and having any objection to the pro- posed annexation may appear before the Council of the City of Huntington Beach and show cause why such uninhabited territory should not be so annexed to said City of Huntington Beach. Such protest must be in writing, may be filed at any time be- fore the hour set for hearing objections to the proposed an- nexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property in general terms. Section 4. The City Clerk of the City of Huntington Beach is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener 2. Ord. Aes.No 1894 than once a week, in the "Huntington Beach News", a news- paper of general circulation published in said City of Hunt- ington Beach, the City to which it is proposed to annex the aforesaid territory, and also in the "Westminster Herald" a newspaper of general circulation published outside the City of Huntington Beach, but in the County of Orange, Calif- ornia, the county in which is located the territory proposed to be annexed to the City of Huntington Beach, said publica- tion to be complete at least twenty (20) days prior to the date set for hearing. Section 5. And the said City Clerk is further author- ized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above proceedings were initiated, at the addresses shown on said assessment roll or as known to said Clerk, and to any person who has filed his name and address and the designation of the lands in which he has any interest; either legal or equitable with said Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. Section 6. In the event any land within the territory 3. Hest. No. 1894 proposed to be annexed is owned by a county, the said City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such County, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexa- tion. Section 7. The said City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto in the manner required by law.
